I.  SIGNIFICANT QUESTIONS AND RESOLVED ISSUES—SEPTEMBER 1989

   A: RCRA

      1. Manifest Requirements and the Off-Site Definition
      Within an industrial park, a corporation leases four contiguous plots of
      property to wholly owned subsidiaries on one large piece of land.  As all
      the companies use similar solvents, the corporation has built a central
      recycling facility which would accept transported spent solvents from each
      of the different production plants. While each of the four companies has a
      separate EPA ID Number, all facilities are connected via private roads on
      the corporation's property.  If the solvent wastes are trucked from one
      company, over another's leased property  in order to get to the central
      recycling facility, do the manifest regulations apply?

         When wastes are moved within a corporate park without use of public
         roads, the waste is not considered to be transported off-site. Therefore,
         a manifest is not required.  Section 262.20 of 40 CFR requires "a
         generator who transports, or offers for transportation, hazardous waste
         for off-site treatment... must prepare a Manifest...." The definition of
         "off-site" is interpreted as that which is not on-site.  Section 260.10
         defines  "on-site" to mean, "the same or geographically contiguous
         property which may be divided by public or private road—Non-
         contiguous properties owned by the same person but connected by a
         right of  way which he controls and to which the public does not have
         access, is also considered on-site property." As long as the  right of
         ways are controlled by the lessors, and the public access is restricted,
         the movement of hazardous waste does not constitute transportation
         "off-site"; a manifest, therefore, is not required.

2. Clarification of Land Disposal Restriction for Underground Injected Wastes

      A facility owner/operator generates spent pickle liquor (K062) which is a
      "First Third" land disposal restricted waste. The spent pickle liquor is
      disposed of in an on-site underground injection well.  K062 waste, which is
      disposed of by underground injection,  received a two-year national
      variance from treatment standards in the August 16,1988 Federal Register.
      (53 FR 30908)  Is this owner/operator subject to the notification/
      certification requirements for land disposal restricted waste?
         The EPA promulgated the regulatory framework for implementing
         land disposal restrictions for underground injection wells in the July 26,
         1988 Federal Register. (53 FR 28118) Pursuant to 40 CFR Section 148.5,
         generators of hazardous waste that are disposed of into Class I-H
         injection wells must comply with the requirements under 40 CFR
         Sections 268.7(a) and (b).  Section  148.5  also states owners and
         operators of Class I-H injection wells must comply with the applicable
         requirements of 40 CFR Section 268.7(c). (53 FR 28155) The November
         7, 1986, Federal  Register promulgated  the  hazardous waste
         management system land disposal restrictions. The preamble explains
         that generators who also treat, store, or dispose restricted waste on-site
         must place the corresponding notification, certification, waste analysis
         date, and other information required pursuant to 40 CFR Section 268.7,
         into their operating record. (51 FR 40597)

         The EPA provided a two-year national capacity variance for K062
         which is disposed by injection in the August 16,1988 Federal Register.
         (53 FR 30908) Restricted wastes which receive a national variance are
         subject to reduced requirements.  The November 7, 1986  Federal
         Register explains, "during the national variance, the generator must
         send a notice (as specified in Section 268.7(a)(3)) to the land disposal
         facility indicating that EPA has granted an extension of time in which
         to comply with the applicable Part 268 Subpart D treatment standard".
         (51 FR 40625) Accordingly, this generator disposing of K062 on-site
         would enter this notification into his operating record until August 8,
         1990. Effective August 8,1990, their operating record must contain all
         the paperwork required under 40 CFR Section 268.7.

3.  Petroleum USTs - Financial Responsibility Compliance Dates

      Owners of petroleum underground storage tanks (USTs) are required to
      comply with the financial responsibility requirements of 40 CFR Part 280
      Subpart H.  UST ownership is the basis for the compliance schedule set
      forth in Section 280.91.  For purposes of determining which category a
      person belongs in, is a parent company considered to be the UST owner of
      a wholly owned subsidiary's tanks?

         The preamble to the October 26, 1988 Federal Register Financial
         Responsibility Requirements Final Rule confirms that "EPA designated
         UST ownership as the factor determining compliance categories". (53
         FR 43330) EPA interprets the compliance category scheme under 40
         CFR Section 280.91 to be  based upon legal ownership of the tanks.
         Therefore,  under Section 280.91, subsidiaries holding titles  to
         petroleum USTs are considered to be the owners and should determine
         their proper compliance date based upon the size of the subsidiary,
         number of tanks owned and nature of the subsidiary's business as
         provided in this provision.  Unless the parent company holds legal title
         to the USTs, it would not be the "owner" of the subsidiary's tanks for
         purposes of determining the appropriate compliance date with the UST
         regulations under Section 280.91.

4. Release Notification: Transportation

      An owner or operator of a facility from which there is a transportation
      related release may meet the emergency release notification requirement
      by providing the information specified in 40 CFR Section 355.40(b)(2) to
      the 911 emergency operator, or in  the absence of a 911 emergency
      operator,  to the  regular  telephone operator. (40  CFR Section
      355.40(b)(4)(ii))

      What must a facility owner/operator do if the telephone operator typically
      has a different procedure for handling emergency calls, e.g., connecting the
      caller  directly to the police or fire department?  Must the facility
      owner/operator provide all of the required information to the telephone
      operator even if the telephone operator does not want to accept it?

4. Release Notification: Transportation (cont'd.)

         The alternative emergency release reporting method for transportation
         related releases was designed for transportation operators who may
         not know the telephone numbers of the relevant State and local entities.
         (52 FR  13386)   If  a 911 emergency  number is  available, the
         owner/operator reporting the release  should use it.  If no 911
         emergency number can be reached, the facility owner or operator must
         contact the telephone operator.  The telephone  operator may follow
         their own procedures for handling emergency calls. If their procedures
         are to take all of the caller's information, then it would be appropriate
         for transportation operators to supply them with the information
         required in 40 CFR Section 355.40(b)(2).   If  the 911 emergency
         operator's procedure requires connection of the caller to an emergency
         response agency, then the caller must report the release information to
         this agency.

5.  Chemical List Issues

      Ammonia is a reportable chemical under Sections 302, 304 and 313 of
      SARA. For Section 313 purposes, facility owners and operators  must
      report any release of ammonia if a Form R is required to be submitted for
      ammonia. These releases could be in the form of anhydrous ammonia or
      dissociated  ammonia from  ammonia salts in water.  Also, EPA has
      indicated that ammonium hydroxide is essentially a mixture of about 30%
      ammonia in water, and therefore would need to be considered as such for
      threshold and release determinations under Section 313.   How are
      chemicals such as ammonium hydroxide, with a CAS number of 1336-21-
      6, to be reported under Sections 302 and 304?

         The Section  302 list of chemicals corresponds  to a specific list of
         chemicals and CAS numbers. This list (also known as the extremely
         hazardous substance or  EHS list) provides a focus for emergency
         planning efforts. If a chemical mixture is assigned a number by CAS,
         then it would be reasonable to assume that different properties are
         associated with the release of the mixture than with the release of the
         constituents.  For emergency planning  and  emergency release
         purposes, EPA is concerned with die immediate effects associated with
         a specific list of chemicals. If a chemical mixture in storage releases a
         reportable chemical then the released substance would need  to be
         reported if it was identifiable as an EHS or CERCLA substance released

         above its reportable quantity (RQ). Mixtures containing ammonia only
         need to be considered for ammonia releases if ammonia is one of the
         identified chemical substances contained within the  mixture.
         Substances such as ammonium hydroxide would not be reportable as
         ammonia in water  under Section 302  or  304 if the substance is
         identified as a pure chemical with a CAS number such as 1336-21-6,
         which is not on the list of EHS's.

         Section 313 release  reporting is different than  this  in as much as it
         requires the reporting of all waste streams and releases which contain
         the reportable toxic chemical.  For Section 313 purposes,  a facility
         owner or operator must identify these releases even though the
         chemical released may  be in a mixture  which has a different CAS
         number than the reportable substance.

A. RCRA/Superfund Hotline Activities

  2. On September 11,18, and 25, Joe Nixon, Senior Program Manager, attended
    the OSWER Communications Meetings.

  3. On September 13, Joe Nixon, Senior Program Manager, briefed the USDA's
    Meat and Poultry Hotline on RCRA/Superfund Hotline operations.

  4. On September 14, Denise Sines, Hotline Project Director gave EPA Region 9
    Personnel a tour of the RCRA/Superfund Hotline.

  5. On September 14, Sonya Stelmac, OSW, briefed the Hotline on the new
    Hazardous Waste Incinerator Guidance.

  6. On September 18, Jace Cuje, Senior Hotline Information Specialist, attended
    the Science Advisory Board's Public Hearing on Municipal Incinerator
    Combustion Ash.

  7. On September 15, Denise Sines, Hotline Project Director, met with Lynn
    Hansen, OSW, regarding the Hotline contract.

  8. On September 27, Denise Sines, Hotline Project Director, signed the
    RCRA/Superfund Hotline contract extending service from October 1,1989
    to September 30,1990.

  9. On September 27, Michael Mastracci, ORD, and William Sproat, Technical
    Resources Inc., briefed the Hotline on the Alternative Treatment Technology
    Information Center (ATTIC).

B. Emergency Planning & Community Right-to-Know Information Hotline
   Activities

  10. On September 6, Anita Bartera, of the Title m Hotline staff, met with Lee
    Ann duFief, OTS, and Laurie Solomon, CEPPO, on the status of the Title IH
    Hotline.

  11. On September 6 and 13, the Title m Hotline staff attended the Title m
    Outreach Subcommittee meetings on the status of the Title m
    communications strategy.

  12. On September 11-15, Jon Roland, of the Title m Hotline staff, participated in
    a Chemical Safety Audit with EPA Region 5 and Headquarters
    representatives.

  13. On September 11-13, Ken Mitchell, of the Title m Hotline staff, attended the
    American Chemical Society's National Conference.

  14. On September 12, Jim Buchert, of the Title m Hotline staff, attended the Title
    ID Workgroup meeting on the status of Title HI activities.

  15. On September 13, Jim Buchert, of the Title m Hotline staff, attended the List
    Workgroup meeting on the development of an Agency- wide "List-of-Lists."

  16. On September 20, Anita Bartera, of the Title m Hotline staff, met with Lee
    Ann duFief, OTS, and Laurie Solomon, CEPPO, on the status of the Title m
    Hotline.

  17. On September 26, Jon Roland, of the Title m Hotline staff, attended the
    hearing before the Senate Environment and Public Works Committee on the
    status of the amendments to the Clean Air Act.

  18. On September 27, Anita Bartera, of the Title m Hotline staff, met with Lee
    Ann duFief, OTS, on the status of the Title m Hotline.

  19. On September 30, Tamara McNamara, of the Title m Hotline staff, attended
    the NRT meeting on the status of Federal preparedness and response
