I. COMMUNICATIONS
The method employed to establish communication with the NCC-IBM 3090

available throughout EPA that may be used
1. Personal computers that have a modem and telecommunications software
(IBM compatible);
2. A Macintosh computer with a modem and telecommunications software;
3. Terminals that are hardwired directly into the IBM 3090;
4. Computers that are on a local area network (LAN) that can establish gateway
access to the 3090.
Each of the equipment options is described below.
A. PERSONAL COMPUTERS (IBM Compatible)
Personal computers (PCs) are stand-alone computers that operate many different
software packages. PCs require communications software and a modem to
communicate with the IBM 3090. Some PCs require additional hardware as well.
If you are using a PC, identify the communications software available to you as
well as the baud rate of your modem (baud rate is the speed at which
information is sent through the telephone lines to the mainframe or any other
computer via your modem). Most users will have access to Crosstalk
communications software and a 1200 or 2400 baud modem.
To communicate with the mainframe, your communications software must have
the following serial port settings:
Parity: Even
Bits Per Character: 7
Duplex: Full
Stop Bits: 1
You must also make sure that you are emulating a VT100 and that the baud rate
setting matches the baud rate of your modem (for example, if you have a 2400
baud modem, set the baud rate of your software to 2400). See your Information
Management Branch or Data Processing Center for assistance m setting up your
communications software.
Once your settings are correct, you may then attempt to connect to the NCC IBM
3090. To do so, refer to the list of telephone numbers at the end of this chapter
and find the number for your location and baud rate. Within Crosstalk (or
whichever communications software you are using), dial the telephone number
that you chose from the list at the end of this chapter (refer to your
communications software's users' manual for exact instructions on dialing).

B. MACINTOSH COMPUTERS
A Macintosh may also be used to gain access to the NCC IBM 3090. Red Ryder, a
communication package, is available from the EDRS Project Manager (Tai-ming
Chang, FTS 382-2564 or 202-382-2564) in the Office of Enforcement and
Compliance Monitoring. This software is free of charge and will be mailed to
you upon request.
Communications via a Macintosh are virtually identical to those via a PC. As
with a PC, you will need to use a modem; remember to identify the baud rate of
the modem that you are using (baud rate is the speed at which information is
sent through the telephone lines to the mainframe or any other computer via
your modem).
To communicate with the mainframe, your communications software must have

C HARDWIRED TERMINALS
Hardwired terminals are computer terminals that are directly linked to the NCC-
IBM 3090 through a protocol converter or a duster controller. These terminals
require no special communications software or user actions to access the
mainframe and generally emulate an IBM 3270-type terminal. An example of an
EPA hardwired terminal is a TELEX 078 or 171 terminal. If you have problems
with this method of access, please refer to your Information Management Branch
or Data Resource Center.
D. NETWORKED COMPUTERS
Certain computer local area networks (LANs) permit individual terminals on the
network to access the IBM 3090 via gateway access. Computers on the network
are usually IBM PC (or compatible). If you are using a computer on a LAN,
please see your LAN Administrator for more information regarding access to the
gateway.
If you have any questions or problems accessing any of the Legal Research
Systems through your LAN, please call Tai-ming Chang at FTS 382-2564 or 202-
382-2564 for assistance.
II. GETTING STARTED
A. PREPARING TO LOG ONTO THE COMPUTER
1. User ID
In order to execute any Legal Research System, each user must have a valid
user ID to access the NCC-IBM 3090-200 computer. If you do not have a
valid user ID, contact Tai-ming Chang (FTS-382-2564) at the Office of
Enforcement and Compliance Monitoring.
2. Bin Number
A bin number is similar to a mail box number. The bin number determines
where the computer operator puts your printouts in the computer or data
processing center. Before you begin to work with the Legal Research
Systems, determine what your bin number is at your location so that you can
receive printouts. If you have difficulty determining your bin number,
contact your Information Management Branch or Data Processing Center.

B. Special Symbols and Troubleshooting
The following special symbols may appear on the screen during a computer
session. Each symbol is explained and the required action, if any, is given below:
(Please refer to the keyboard conversion chart (page 9) if you are using a
keyboard other than that of an IBM 3270 for the equivalent keys for your
computer.)
NOTE: These symbols will only appear on the IBM 3270-type terminals. Other
symbols may appear on other terminal types.
*** Three asterisks in the lower left hand corner of the screen indicates that
there is more information to be viewed.
(Press the key to continue).
(C) A small clock on the bottom line of the screen indicates that the computer
is currently processing. You should wait until the dock disappears.
(No action is required Clock will appear on Telex computers only.
"X ()" will appear on PCs only.)
? + If you attempt to enter any information while the dock is on the screen
and the computer is currently processing, a question mark and plus sign
may appear on the bottom line of the screen.
(Press the key to continue).
This symbol indicates that you have lost your line of communications.
Contact your Information Management Branch or Data Processing Center
for assistance.
This symbol indicates that you have moved into a restricted area of the
screen. Press the key and use the cursor control arrows to move
out of this area.
STOP To cancel any current operation and return to a menu or to BASIS, press
the PA1 key (Fl for PCs). If you are in BASIS, type "/MENU" and press
the key to return to the menu screens.
Please note that the system accepts everything typed on the screen. If you make
an error entering a word or command, use the back-arrow or back-space key. If
the word or command that you re-enter is fewer characters, be sure to eliminate
any extraneous characters. This can be done using the space bar.
If you cannot see your cursor (the flashing bar on the screen), press the
key.

1. First Time Logon
When you log onto TSO for the first time, the system will not have any of the
logon screen information for your account. Therefore, you will need to
supply all of this information during the initial logon.
The cursor on the logon screen will be positioned at the USER ID line.
Type your three letter user ID and press the key.
The cursor will now be positioned at the PASSWORD field. Enter your
password and press the key.
NOTE: For security reasons, your password (four to eight characters) will not
show up on the screen as you enter it.
Using the key to move from field to field, make sure that the
following information is entered on the screen, (as shown in the following
screen):

2. Subsequent Logon
After an initial logon and a successful logoff, your user logon information
will be saved.
NOTE: Subsequent logons will require that you enter your user ID and
password; the remaining information will be supplied automatically.

A. SYSTEM DESCRIPTION
The Environmental Protection Agency's (EPA) Enforcement Document Retrieval
System (EDRS) is an automated search and retrieval system that contains EPA
enforcement documents. It is maintained by the Office of Enforcement and
Compliance Monitoring (OECM) and has been designed to establish a uniform
method of searching and retrieving the full text of enforcement documents pertinent
to enforcement activities. EDRS is a menu-driven, user-friendly system developed in
BASIS, a software package, on the NCC-IBM 3090 in Research Triangle Park, NIC. The
system can be accessed from terminals at EPA facilities that are directly wired to'the
NCC-IBM 3090 or from computers with communications software and a modem.
Similar in. concept to commercial data bases such as Lexis, WestLaw, and DOJ JURIS,
EDRS allows the user to search for'documents in a variety of ways. For example,
documents can be selected based on issue date, title, environmental law statute, or a
specific word (e.g., dioxin, landfill, pretreatment).
B. INFORMATION AVAILABLE
The Enforcement Document Retrieval System is a library of documents that are
considered pertinent to the Agency's enforcement activities. The Program areas
covered include Air, Water, Hazardous Waste, and Pesticides/Toxic Substances.
Documents within EDRS are currently divided into four categories: Policy/
Procedures, Administrative Enforcement, Judicial Action, and Model Forms and
Sample Documents. The following types of documents are included in the four
categories:

Administrative Decisions (Initial, Final, Interlocutories, and Permit Decisions)
Administrative and Judicial Briefs and Pleadings
Civil Judicial Consent Decrees, Defensive Litigation, and Decisions

The documents in EDRS have been organized into four categories based on the
type of document. This enables you to work with a smaller, manageable group of
documents with similar characteristics.
Each of the options is described below:
1. Display EDRS News - EDRS News provides the user with on-line
access to the number of documents currently in EDRS. Updated
monthly, EDRS News also lists the titles of documents that were added
to the system during the previous month.
2. Search Enforcement Policy/Procedure Documents - The Policices/
3. Search Administrative Enforcement Documents - The Administrative
Enforcement selection provides users with access to administrative
enforcement decisions, ranging from initial to final decisions. Also
included are briefs and pleadings.
4. Search Judicial Action Documents - The Judicial Action selection
provides users with access to civil judicial consent decrees, defensive
litigation, and briefs.
5. Search Model Forms and Sample Documents - The Model Forms and
Sample Documents selection provides users with access to model
administrative and judicial documents (e.g., Complaints, Consent
Orders, Motions, and Briefs).

B. CREATING A DOCUMENT SET
To create a document set, select option "1" from the Main Menu:

You may create a document set based on any of the following conditions:
1. Document Type:
Allows you to create a document set based on documents of a specific
type (e.g. CERCLA/SARA Policy).
2. Issue Date:
Allows you to create a document set consisting of documents issued
within a specified time period (e.g. 05/15/88 through 12/21/88).
3. Laws Referenced;
Allows you to create a document set containing documents that pertain
to a specified law (e.g. CWA, FIFRA, TSCA).
4. Text/Word Search:
Allows you to create a document set consisting of documents that
contain specified words within the document text. You may select all
documents that contain one word, two words, or three to rune words.
This option also allows you to use an on-line thesaurus. The thesaurus
can be browsed to enable the user to select the best word for a search.

5. Active/Expired Status:
Allows you to create a document set that contains only active or expired
documents.
6. Document Number:
Allows you to create a document set that contains the one document
with a specified document number (e.g. SARA;PC;9834.10).
7. Document Type. Date, and Status:
Allows you to create a document set that contains documents of a
specified type, a specified date range, and either active or expired status.
It you wish to create a set based on these three criteria, this option will
save time.
At this point, you may enter the number corresponding to the condition you wish to
use to select documents. Each of the above options is explained in detail in the
remaining pages of this section of the manual.
Once you have created a document set, you will return to the Document Set Creation
Menu so that you may create multiple document sets.

4. Select Documents By Text/Word Search
There are several options available for selecting documents based on a
specified word(s) within the document text:
a. One Word
This option allows you to select those documents which contain a
specific word in the document text.
b. Two Words in one Sentence
This option allows you to select those documents which contain two
specific words in the same sentence in the document text.
c. Two Words in One Document
This option allows you to select those documents which contain two
specific words anywhere in the document text. (The words do NOT
have to appear in the same sentence).
d. Several Words Within One or Several Sentences
This option allows you to select those documents that contain from one
to nine specific words, located within one to ten sentences of each other
in the document text (i.e., three words in the same sentence, four words
within three sentences,...).
e. Browse Thesaurus
This option allows you to browse an on-line thesaurus to help you select
the best word for a search.
IMPORTANT NOTES:
If you use a "stopword", no search will be executed. EDRS
"stopwords" are frequently used words such as "and", "the", "EPA",
and "of". For a complete list of EDRS "stopwords", refer to
Appendix E.
You can use an asterisk (*) to ensure that your search includes
variations of the word or words for which you are searching. The
asterisk may be used to locate words with various suffixes/prefixes
and variations in spelling. For example,
Bankrupt* = bankrupt, bankruptcy, bankrupted...
Catalogued = cataloged, catalogued.

If you would like to search for numbers/ you must enclose them in
double quotes. An asterisk may also be used when searching for
numbers. For example,
"3008*" = 3008,3008(3), 3008(h)...
A word is defined as a group of 1 or more characters ending with a
space or some other punctuation. A sentence is defined as a group of
1 or more words ending with some punctuation and 2 spaces.
To begin a word search from the Document Set Creation Menu:
Type "4", and press the key.

Browse Thesaurus
Option 5 on the Text/Word Search Menu allows you to search an on-line
thesaurus, which may assist your word search by providing you with
alternative words.
To use the thesaurus from the Text/Word Search Menu:

7. Select Documents Based On Document Type. Date, and Status
This selection will allow you to create a document set based on document type, date
issued, and document status without combining sets. It also allows you to instantly
view the set that you have created. This selection will generally save you time when
performing a search using these three criteria.

C COMBINING DOCUMENT SETS
This option allows you to combine from two to five previously created document
sets. The new document set can then be displayed, printed, or combined with other
document sets. This allows you to create document sets that satisfy several select
conditions.
To combine document sets from the Main Menu:
Type "2", and press the key.

A. INTRODUCTION
This sample search has been designed to demonstrate how you might use the Enforcement
Document Retrieval System for a legal research question. This tutorial takes you from the
formulation of the objective of this search session through each step required to accomplish
the objective. This includes creating, combining, displaying, and printing document sets.
Objective
You are a new attorney in the Waste and Toxic Substances Branch in Region 3 and have
been assigned the In the Matter of Disposer Inc. case. Disposer Inc. is a company that, at all
relevant times, was engaged in the business of electrical construction, maintenance, and
repair at its facility in Virginia. In June 1989, an EPA inspector inspected the facility to
determine Disposer's compliance with the PCB rules. During the inspection, the inspector
determined that PCB transformers and drums containing PCBs and PCB-contaminated
debris had been stored for over one year at the facility. The inspection also revealed that
the facility has a surface impoundment which contains listed hazardous waste under
RCRA and PCBs. Disposer asserts that it did not generate, store, treat, or dispose of any of
the hazardous waste, PCBs, or PCB items. Can Disposer be found liable for any violations
under current environmental statutes?
You will evaluate this problem by looking at the Agency's policy and guidance regarding
strict liability under TSCA, RCRA, and CERCLA. You should also check to see if there are
any Administrative decisions relating to this problem. The sample search will begin by
looking at the Enforcement Policy/Procedures documents.

BASIS SCROLL COMMANDS USED DURING DISPLAY OPTION
Once you begin displaying a document set in EDRS, part of the first document will be
displayed followed by:
SCROLL COMMANDS (STOP, HIT, NEXT, UP, DOWN, TOP)
ENTER SCROLL COMMANDS /
These BASIS scroll commands enable you to move through your document set. If your
document set was created based on word searches within the text, those areas in the docu-
ment which satisfy the search criteria will be highlighted with two asterisks in the far left
columns. Each of the above commands are explained below.
HIT Displays the next area of the current document that satisfies the text
search condition.
NEXT Displays the first area of the next document that satisfies the text
search condition.
TOP Moves to the top fo the current document and displays the entire
document. (This may take some time if the document is several
pages).
STOP Ends the display session.
In addition, the following commands are useful when displaying a document:
UP Scrolls up to the previous screen of the document.
DOWN Scrolls down to the next screen of the document.
100L Displays the next 100 lines of text. (May be any number.)
-SOL Displays one line of text 50 lines back. (May be any number.)

The document number is an alphanumeric field (containing numbers, letters, and other
characters) which may contain up to 60 characters. The document numbers have been
structured to indicate the category of the document (e.g., policy compendium) as well as
