1551. In  Re:  Chemical  Compounding Corp., EPA Region II,
     October 17,1974. (I.F.&R. No. II-10C, I.D. No. 91906.)

This  was a civil action charging the respondent with  violating the
Federal    Insecticide,   Fungicide,  and  Rodenticide  Act,   7
U.S.C.136j(a)(l)(E).  The action pertained to a product held for dis-
tribution or sale on  September 20, 1973, at Chemical Compounding
Corp.,  Jersey   City,  New  Jersey.  The pesticide involved   was
CENTRAL VETSCO RIDZALL; charges included adulteration  and
misbranding—product's strength or  purity fell below the professed
standard of quality as expressed on its labeling.

The respondent was assessed a civil penalty of $900.00 by the Final
Order.
1552. In Re: Burris Chemical, Inc., EPA Region IV, November 12,
     1974. (I.F.&R. No. IV-81C, I.D. No. 95351.)

This was a civil action charging the  respondent with violating the
Federal  Insecticide,  Fungicide,  and  Rodenticide Act,  7 U.S.C.
136j(a)(l)(E);  136(q)(l)(G);   136(q)( 1 )(F);   136(q)(2)(A);  135(o);
135a(a)(1); and  135b. The action pertained to a shipment made on
July  10,  1973,  from  Atlanta, Georgia, to Cullman, Alabama. The
pesticide involved was FORMALDEHYDE 37%; charges included
nonregistration  and  misbranding—lack of adequate warning or
caution statement,  lack of adequate  directions for use and lack of
adequate ingredient statement on labels.

The  respondent  signed  a  Consent Agreement.  The Final Order
assessed a civil penalty of $1,800.00.

M-45 and MASTER BRAND PHOSDRIN SPRAY; charges included
adulteration and misbranding—strength or purity of products below
standard  of  quality  represented  on  labeling,  products were
contaminated with additional active ingredients not declared on
labeling, lack of adequate ingredient statement, lack of adequate
directions for use, and lack of assigned registration number on labels.

The respondent  signed  a  Consent Agreement.  The Final Order
assessed a civil penalty of $3,800.00.
1554. In Re: Nottingham Company, EPA Region IV, December
     23,1974. (I.F.&R. No. IV-80C, I.D. No. 95352.)

This  was a civil action charging the respondent with violating the
Federal  Insecticide,  Fungicide,  and  Rodenticide Act, 7  U.S.C.
135a(a)(l);   135b;   136j(a)(l)(E);    136(q)(l)lG);    136(q)(l)(F);
136(q)(2)(A); and 135(o). The action pertained to a shipment made on
November 26, 1973, from Atlanta, Georgia, to Cullman, Alabama.
The  pesticide  involved was  CRESYLIC ACID;  charges included
nonregistration and misbranding—labels did not bear an ingredient
statement,  directions for  use  and  the  required precautionary
statements.

The  respondent signed  a  Consent Agreement.  The  Final Order
assessed a civil penalty of $1,200.00.
1555.  In  Re: Borden  Chemical  Company,  EPA  Region IV,
     January 6,1975. (I.F.&R. No. IV-94C, I.D. No. 116286.)

This was a civil action charging the respondent with violating the
Federal Insecticide,  Fungicide,  and  Rodenticide Act,  7  U.S.C.

shipment made on February 1, 1974, from Marietta, Georgia, to
Lake  Wales,  Florida.  The  pesticide  involved  was  VITA-BRITE
VEGATABLE WAX JC 3550; the charge was misbranding—labels
did not bear adequate precautionary statement, adequate directions
for use, adequate ingredient statement, net content statement, and
the assigned registration number.

The respondent  signed a  Consent Agreement.  The Final  Order
assessed a civil penalty of $1,940.00.
1556. In Re: Erny Supply Company, EPA Region IV, January 6,
     1975. (I.F.&R. No. IV-104C, I.D. No. 116257.)

This was a civil action charging the  respondent with violating  the
Federal  Insecticide,  Fungicide,  and Rodenticide Act,  7  U.S.C.
136j(a)(l)(E}; 136(q)(l)(A); and  136(c)(1). The  action pertained to a
product held for  distribution or sale  on March 28,  1974,  at Erny
Supply Company, Tampa, Florida. The pesticide involved was ESCO
GERMICIDAL  CLEANSER; charges  included adulteration  and
misbranding—its strength or purity fell below the professed standard
of quality as expressed on its labeling.

The respondent  signed a  Consent  Agreement.  The Final Order
assessed a civil penalty of $1,850.00.
1557.  In  Re: Riverside Chemical Company, EPA Region  IV,
     January 9,1975. (I.F.&R. No. IV-78C, I.D. No. 95344.)

This was a civil  action charging  the respondent with violating  the
Federal Insecticide,  Fungicide,  and  Rodenticide  Act,  7  U.S.C.
136j(a)(l)(E) and 136(c)(2). The action pertained to a product held for
distribution or sale on January  29,  1974, at Riverside Chemical

Company, Montgomery, Alabama. The  pesticide  involved  was
RIVERSIDE CHLORDANE  8;  the charge was  adulteration—con-
taminated with methyl parathion.

The respondent signed a  Consent  Agreement. The Final  Order
assessed a civil penalty of $3,500.00.
1558. In  Re:  Thompson-Keyword Chemical Company, EPA
     Region IV, January 9, 1975. (I.F.&R. No. IV-95C, I.D. No.
     116513.)

This was a civil action charging  the respondent with violating  the
Federal  Insecticide,  Fungicide,  and Rodenticide  Act,  7  U.S.C.
136j(a)(1)(E); 136(q)(2)(D); and 136(q)(l)(G). The action pertained to a
product  held for distribution or sale on March 14, 1974, at Thomp-
son-Hayward  Chemical   Company,  Memphis, Tennessee.  The
pesticide  involved  was  DESICCANT-A;  the  charge  was  mis-
branding—lack of adequate warning or caution statement and lack
of the symbols or statements required for highly  toxic substances on
labels.

The  respondent signed  a  Consent  Agreement. The  Final Order
assessed a civil penalty of $3,000.00.
1559. In Re: Velsicol  Chemical Corporation, EPA Region  IV,
     January 10,1975. (I.F.&R. No. IV-98C, I.D. No. 112804.)

This was a civil action  charging the respondent with violating  the
Federal  Insecticide, Fungicide, and  Rodenticide  Act,  7  U.S.C.
135a(a)(l) and 135b. The action pertained to a shipment made on
November 30, 1973, from Chattanooga, Tennessee, to Kansas City,
Kansas.  The pesticide involved was BANVEL CAST ASSAY 77%;
the charge was nonregistration.

The respondent  signed  a Consent Agreement. The Final  Order
assessed a civil penalty of $2,240.00.

1560.  In  Re:  Union  Carbide Corporation,  EPA Region IV,
     January 22,  1975. (I.F.&R. No. IV-88C, I.D. Nos. 116790,
     116774, and 116283.)

This  was a civfl action  charging the respondent with violating the
Federal Insecticide, Fungicide,  and  Rodenticide  Act,  7 U.S.C.
136j[a)(l)(E};  136(q)(l)(F); 136(q)(l)(A);  135a(a)(l); and  135b. The
action pertained to shipments made on February 22, March 12 and
May 6, 1974, from Woodbine, Georgia, Jacksonville, Florida, and
Sylvester,  Georgia, to Jacksonville, Florida, Sylvester Georgia, and
Fort  Valley, Georgia.  The pesticide involved was TEMIK  15G
ALDICARB  PESTICIDE;  charges  included  nonregistration   and
misbranding—labels bore a false registration number implying that
the product was registered and lack of adequate directions for use on
labels.

The  respondent  signed a Consent Agreement.  The Final Order
assessed a civil penalty of $8,000.00.
1561. In Re: Mayo Chemical Company, EPA Region IV, January
     27,1975. (I.F.&R. No. IV-97C, I.D. No. 116812.)

This  was a civil action charging the  respondent with violating the
Federal Insecticide,  Fungicide,  and  Rodenticide  Act,  7 U.S.C.
136j(a)(l)(E) and 136(c)(1). The action pertained to a product held for
distribution or sale on April 5, 1974, at Mayo Chemical Company,
Smyrna, Georgia. The pesticide involved was MAYO AL6AECIDE;
the charge was adulteration—its strength or purity fell below the
professed standard of quality as expressed on its labeling.

The  respondent  signed a Consent Agreement.  The Final Order
assessed a civil penalty of $1,480.00.

Federal  Insecticide,  Fungicide,  and  Rodneticide  Act,  7 U.S.C.
136j(a)(l)(E) and 136(c)(l). The action pertained to a product held for
distribution or sale on July 22, 1974, at C.  D. Terhune Company,
Cedartown,   Georgia.   The   pesticide  involved   was   DIXIE
MALATHION DUST; the charge was adulteration—its strength or
purity fell below the professed standard of quality as expressed on its
labeling.

The respondent  signed  a Consent  Agreement.  The  Final  Order
assessed a civil penalty of $150.00.
1563.  In Re:  Helena  Chemical  Company, EPA Region IV,
     January 29,  1975. (I.F.&R. No. IV-92C, I.D. Nos. 116593
     and 116900.)

This was a civil action charging the respondent with violating the
Federal  Insecticide,  Fungicide,  and  Rodenticide  Act,  7  U.S.C.
135a(a)(l); 135b; 136j(a)(l)(E); 136(q)(l)(G); 136lq)(2)(A); and 135(o).
The action pertained to  shipments made on March 15, 1973, and
May 5,  1974, from  Dothan, Alabama, and  Tampa,  Florida,  to
Marianna,  Florida, and Laurinburg, North Carolina. The pesticides
involved  were HELENA BRAND LIQUID SULFUR EIGHT and FY-
FANON  MALATHION  PREMIUM GRADE; charges  included
nonregistration and  misbranding—lack  of adequate warning  or
caution statement, lack of adequate directions for use, and lack  of
adequate ingredient statement on labels.

The respondent signed  a Consent Agreement.  The  Final  Order
assessed a civil penalty of $4,650.00.
 1564. In Re: Wine Art of Minnesota, EPA Region V, August 1,
     1974. (I.F.&R. No. V-083C, I.D. Nos 115201  and 115203.)

 This was a civil action charging the respondent with violating the
 Federal  Insecticide,  Fungicide, and  Rodenticide  Act,  7  U.S.C.
 135a(a)(l); 135b;  136j(a)(l)(E); 136(q)(l)(G); and 136(q)(2)(A). The

Minneapolis,  Minnesota,  to  Tomah,  Wisconsin. The  pesticides
involved were WINE ART SULPHITE CRYSTALS and WINE ART
CHLORINE  STERILIZER; charges  included  nonregistration  and
misbranding—lack of adequate warning or caution statement and
lack of adequate ingredient statement on labels.

The  respondent  signed a Consent Agreement.  The  Final Order
assessed a civil penalty of $600.00.
1565. In Re: Brulin & Company, Inc., EPA Region V, August 13,
     1974. (I.F.&R. No. V-050C, I.D. Nos. 102604,87371,87372,
     and 87374.)

This was  a civil action charging the respondent with violating the
Federal  Insecticide,  Fungicide,  and  Rodenticide  Act,  7  U.S.C.
135a(a)(l); 135b; 136(c)(l); 136(q)(l)(AJ; 136(q)(l)(F); 136(q)(l)(G);
and  136j(a)(l)(E). The action  pertained to a shipment made on
December 8,  1972, from Indianapolis, Indiana, to Omaha, Nebraska,
and to products  held for distribution or sale  on  July 25,  1973, at
Brulin & Company, Inc., Indianapolis, Indiana. The pesticides involved
were BRULINCIDE 50, BRULIN KING SIZE BUG BOMB, BRULIN
NO-TOX  BRAND AEROSOL  INSECTICIDE, and  BOWLAIDE;
charges included  nonregistration, claims and directions differed from
those represented in  connection with the products registration, mis-
branding   and adulteration—strength  or  purity  fell  below  the
standard of quality represented in labeling, lack of adequate warning
or caution statements  and labels bore false  or  misleading  safety
statements.

The respondent  signed a  Consent Agreement. The Final  Order
assessed a civil penalty of $3000.00.
1566. In Re: Castle Chemical Company, EPA Region V, August

pertained  to a product held for distribution or sale on August 24,
1974,  at  Castle  Chemical Company,  Savage,  Minnesota.  The
pesticide involved was MALATHION 5-EC; charges included claims
and directions differed from those represented in connection with the
products registration and misbranding—lack of adequate warning or
caution statements and lack of a net content statement.

The respondent signed  a Consent Agreement.  The Final  Order
assessed a civil penalty of $ 1500.00.
1567. In Re: Federal International Chemicals, EPA Region V,
     August 16, 1974. (I.F.&R. No. V-040C, I.D. Nos. 92635 and
     102491.)

This  was a civil action charging the  respondent  with violating the
Federal  Insecticide,  Fungicide, and  Rodenticide  Act,  7  U.S.C.
135a(a)(l); 136j(a)(l)(E);  and 136(q)(l)(A). The  action pertained to
shipments made on February 23 and March 21, 1973, from Chicago,
Illinois, to Sioux City, Iowa, and  Grand Forks, North Dakota. The
pesticides involved were  FLOOR CARE SYSTEMS PHENE-A-CIDE
128    and    LISTO-PHENE   256   CLEANER-DISFECTANT-
DEODORANT; charges included claims and directions differed from
those made in connection with registration and misbranding—labels
bore a false registration number.

The  respondent signed  a Consent  Agreement.  The Final Order
assessed a civil penalty of $1000.00.
1568.  In Re:  Lowman Company,  EPA  Region V, August  16,
     1974. (I.F.&R. No. V-064C, I.D. No. 93846.)

This was a civil action charging the respondent with violating  the
Federal Insecticide,  Fungicide,  and Rodenticide  Act,  7  U.S.C.
135a(a)(l).  The action'pertained to a shipment made on November

30,  1972,  from Waterloo,  Indiana, to Concord, Michigan. The
pesticide involved was ACORN RAT & MOUSE KILLER; the charge
was composition differed from that represented in connection with its
registration.

The  respondent signed  a Consent  Agreement. The  Final Order
assessed a civil penalty of $750.00.
1569. In Re: Misco International Chemicals, Inc., EPA Region V,
     August 16,1974. (I.F.&R. No. V-062C, I.D. No. 93720.)

This  was a civil action charging the respondent with violating the
Federal Insecticide,  Fungicide,  and  Rodenticide  Act,  7  U.S.C.
135a(a)(l); 135b; 136j(a)(l ){E); 136(c)(l); 136(q)(l)(A};  136(q)(l)(C);
136(q)(l)(G); and 136(q)(2)(C)(iii). The action pertained to a shipment
made on April  18, 1973, from Wheeling,  Illinois,  to Minneapolis,
Minnesota. The pesticide involved was POOL CONDITIONER
CONCENTRATE   SWIMMING   POOL   ALGAECIDE   AND
SURFACE  CONDITIONER;  charges  included  nonregistration,
misbranding and adulteration—label  of  the product bore a false
registration number, product was an imitation of another pesticide,
strength or purity  of product fell  below that  represented on its
labeling, lack of adequate warning or caution statements, misleading
or false safety statements  and failure to  bear a  net content
statement.

The  respondent signed  a Consent Agreement. The  Final Order
assessed a civil penalty of $1000.00.
1570. In Re: American Home Chemical Co., Inc., EPA Region V,
     August 19,1974. (I.F.&R. No. V-031C, I.D. No. 92665.)

This  was a civil action charging the respondent with violating the
Federal Insecticide,  Fungicide,  and  Rodenticide  Act,  7  U.S.C.
135a(a)(l); 135b;  136j(a)(l)(E);   136(q)(l)(A);   136(q)(l)(GJ;  and
136(q)(2)(A). The action pertained to a shipment made on February
19,  1973, from Indianapolis, Indiana,  to  Helena,  Montana. The

pesticide involved was RE ROOT ELIMINATOR; charges included
nonregistration  and misbranding—lack  of adequate  warning or
caution statements, lack of an ingredient statement and labels bore a
false or misleading safety statement.

The  respondent  signed  a  Consent Agreement.  The Final Order
assessed a civil penalty of $500.00.
1571.  In  Re: Mortemoth  Chemical  Laboratories,  Inc.,  EPA
     Region V, August 19,  1974. (I.F.&R. No. V-049C, I.D. No.
     102208.)

This was a civil action charging the respondent with violating the
Federal Insecticide, Fungicide,  and  Rodenticide Act,  7 U.S.C.
135a(a)(l); 135b; 136j(a)(l](E); 136(q)(l)(G); and 136(q)(2)(D). The
action pertained to a shipment made on or about May 14,1973, from
Milwaukee, Wisconsin, to Kansas  City, Missouri.  The pesticide
involved was  LETHOL FUR  STORAGE FUMIGANT; charges  in-
cluded nonregistration and misbranding—lack of adequate warning
or caution statement on labels.

The respondent  signed a Consent Agreement.  The Final Order
assessed a civil penalty of $500.00.
1572. In Re: BASF  Wyandotte  Corporation, EPA Region  V,
     August 27,1974. (I.F.&R. No. V-090C, I.D. No. 106248.)

This  was a civil action charging the  respondent with  violating the
Federal  Insecticide,  Fungicide,  and  Rodenticide Act,  7 U.S.C.
136j(a)(l)(E). The action pertained to a product held for distribution or
sale  on December 11, 1973,  at  BASF  Wyandotte  Corporation,
Wyandotte, Michigan. The pesticide  involved  was  SPARTEC
QUATERNARY AMMONIUM COMPOUND; the charge was mis-
branding—labeling bore a statement as to the safety of the product
which was false or misleading.

Federal  Insecticide,  Fungicide,  and  Rodenticide Act,  7  U.S.C.
136j(a)(l)(E) and 136(q)(l)(G). The action pertained to a product held
for distribution or sale on November 27, 1973, at Carajon Chemical
Co.,  Fremont, Michigan.  The  pesticide  involved was  FORCE'S
POISON PEANUTS; the charge was misbranding—label did not
bear necessary warning and caution statements for the protection of
health and the environment.

The  respondent signed  a Consent Agreement.  The Final Order
assessed a civil penalty of $1000.00.
1574. In Re: Farmers Union Central Exchange, Inc., EPA Region
     V, August 27, 1974. (I.F.&R. No. V-068C, I.D. No. 93968.)

This was  a civil action charging the  respondent with violating the
Federal  Insecticide, Fungicide,  and  Rodenticide  Act,  7  U.S.C.
136j(a)(l)(E) and  136(q)(2)(C)(v). The action pertained to a product
held for distribution or sale on August 14, 1973, at Farmer's Union
Central Exchange, St. Paul, Minnesota. The pesticide involved was
CO-OP KETOSIS TREATMENT; the charge was misbranding—lack
of assigned registration number on labels.

1576.  In  Re: Rose  Exterminator  Company,  EPA  Region  V,
     September 12,1974. (I.F.&R. No. V-088C, I.D. Nos. 106392
     and 106393.)

This was a civil action charging the  respondent with  violating the
Federal Insecticide, Fungicide,  and  Rodenticide  Act,  7  U.S.C.
136j(a)(l)(E);  136(q)(l)(A); and  136(c)(l).  The action  pertained to
products held for distribution or sale on November 21, 1973, at Rose
Exterminator  Company, Cincinnati, Ohio. The pesticides involved
were  ROSEX KILLS RATS AND MICE and  MAGIC BRAND
RESIDUAL   SPRAY;   charges   included   misbranding   and
adulteration—strength or purity fell below  the standard of quality re-
presented in labeling and when used  as directed the product would
not be effective.

The  respondent signed a  Consent  Agreement.  The  Final Order

This was a civil action charging the respondent with violating the

CENTRATE; the charge was misbranding—lack of adequate warning
or caution statements to protect health and the environment.

The respondent  signed  a Consent Agreement.  The  Final Order
assessed a civil penalty of $1000.00.

This was a civil action charging the respondent with violating the
