Notices of Judgment report cases involving seizure actions
taken against products alleged to be in violation, and criminal and
civil actions taken against firms or individuals charged to be respon-
sible for violations. The following Notices of Judgment are approved
for publication as provided in Section 16(d) of the Federal Insecticide,

1551. In Re: Chemical Compounding Corp., EPA Region II,
October 17,1974. (I.F.&R. No. II-10C, I.D. No. 91906.)
This was a civil action charging the respondent with violating the
Federal Insecticide, Fungicide, and Rodenticide Act, 7
U.S.C.136j(a)(l)(E). The action pertained to a product held for dis-
tribution or sale on September 20, 1973, at Chemical Compounding
Corp., Jersey City, New Jersey. The pesticide involved was
CENTRAL VETSCO RIDZALL; charges included adulteration and
misbranding—product's strength or purity fell below the professed
standard of quality as expressed on its labeling.
The respondent was assessed a civil penalty of $900.00 by the Final
Order.
1552. In Re: Burris Chemical, Inc., EPA Region IV, November 12,
1974. (I.F.&R. No. IV-81C, I.D. No. 95351.)
This was a civil action charging the respondent with violating the
Federal Insecticide, Fungicide, and Rodenticide Act, 7 U.S.C.
136j(a)(l)(E); 136(q)(l)(G); 136(q)( 1 )(F); 136(q)(2)(A); 135(o);
135a(a)(1); and 135b. The action pertained to a shipment made on
July 10, 1973, from Atlanta, Georgia, to Cullman, Alabama. The
pesticide involved was FORMALDEHYDE 37%; charges included
nonregistration and misbranding—lack of adequate warning or
caution statement, lack of adequate directions for use and lack of
adequate ingredient statement on labels.
The respondent signed a Consent Agreement. The Final Order
assessed a civil penalty of $1,800.00.

standard of quality represented on labeling, products were
contaminated with additional active ingredients not declared on
labeling, lack of adequate ingredient statement, lack of adequate
directions for use, and lack of assigned registration number on labels.
The respondent signed a Consent Agreement. The Final Order
assessed a civil penalty of $3,800.00.

This was a civil action charging the respondent with violating the
Federal Insecticide, Fungicide, and Rodenticide Act, 7 U.S.C.

136(q)(2)(A); and 135(o). The action pertained to a shipment made on
November 26, 1973, from Atlanta, Georgia, to Cullman, Alabama.
The pesticide involved was CRESYLIC ACID; charges included
nonregistration and misbranding—labels did not bear an ingredient
statement, directions for use and the required precautionary
statements.
The respondent signed a Consent Agreement. The Final Order

This was a civil action charging the respondent with violating the
Federal Insecticide, Fungicide, and Rodenticide Act, 7 U.S.C.
136j(a)(l)(E}; 136(q)(l)(A); and 136(c)(1). The action pertained to a
product held for distribution or sale on March 28, 1974, at Erny
Supply Company, Tampa, Florida. The pesticide involved was ESCO
GERMICIDAL CLEANSER; charges included adulteration and
misbranding—its strength or purity fell below the professed standard
of quality as expressed on its labeling.
The respondent signed a Consent Agreement. The Final Order
assessed a civil penalty of $1,850.00.

product held for distribution or sale on March 14, 1974, at Thomp-
son-Hayward Chemical Company, Memphis, Tennessee. The
pesticide involved was DESICCANT-A; the charge was mis-
branding—lack of adequate warning or caution statement and lack
of the symbols or statements required for highly toxic substances on
labels.
The respondent signed a Consent Agreement. The Final Order
assessed a civil penalty of $3,000.00.
1559. In Re: Velsicol Chemical Corporation, EPA Region IV,

This was a civil action charging the respondent with violating the
Federal Insecticide, Fungicide, and Rodenticide Act, 7 U.S.C.
135a(a)(l) and 135b. The action pertained to a shipment made on
November 30, 1973, from Chattanooga, Tennessee, to Kansas City,
Kansas. The pesticide involved was BANVEL CAST ASSAY 77%;
the charge was nonregistration.
The respondent signed a Consent Agreement. The Final Order
assessed a civil penalty of $2,240.00.

1560. In Re: Union Carbide Corporation, EPA Region IV,
January 22, 1975. (I.F.&R. No. IV-88C, I.D. Nos. 116790,

This was a civfl action charging the respondent with violating the
Federal Insecticide, Fungicide, and Rodenticide Act, 7 U.S.C.
136j[a)(l)(E}; 136(q)(l)(F); 136(q)(l)(A); 135a(a)(l); and 135b. The
action pertained to shipments made on February 22, March 12 and
May 6, 1974, from Woodbine, Georgia, Jacksonville, Florida, and
Sylvester, Georgia, to Jacksonville, Florida, Sylvester Georgia, and
Fort Valley, Georgia. The pesticide involved was TEMIK 15G
ALDICARB PESTICIDE; charges included nonregistration and
misbranding—labels bore a false registration number implying that
the product was registered and lack of adequate directions for use on
labels.
The respondent signed a Consent Agreement. The Final Order
assessed a civil penalty of $8,000.00.

This was a civil action charging the respondent with violating the
Federal Insecticide, Fungicide, and Rodenticide Act, 7 U.S.C.
136j(a)(l)(E) and 136(c)(1). The action pertained to a product held for
distribution or sale on April 5, 1974, at Mayo Chemical Company,
Smyrna, Georgia. The pesticide involved was MAYO AL6AECIDE;
the charge was adulteration—its strength or purity fell below the
professed standard of quality as expressed on its labeling.

FANON MALATHION PREMIUM GRADE; charges included
nonregistration and misbranding—lack of adequate warning or
caution statement, lack of adequate directions for use, and lack of
adequate ingredient statement on labels.
The respondent signed a Consent Agreement. The Final Order
assessed a civil penalty of $4,650.00.
1564. In Re: Wine Art of Minnesota, EPA Region V, August 1,

This was a civil action charging the respondent with violating the
Federal Insecticide, Fungicide, and Rodenticide Act, 7 U.S.C.

lack of adequate ingredient statement on labels.
The respondent signed a Consent Agreement. The Final Order

This was a civil action charging the respondent with violating the

and 136j(a)(l)(E). The action pertained to a shipment made on
December 8, 1972, from Indianapolis, Indiana, to Omaha, Nebraska,

Brulin & Company, Inc., Indianapolis, Indiana. The pesticides involved
were BRULINCIDE 50, BRULIN KING SIZE BUG BOMB, BRULIN
NO-TOX BRAND AEROSOL INSECTICIDE, and BOWLAIDE;
charges included nonregistration, claims and directions differed from
those represented in connection with the products registration, mis-
branding and adulteration—strength or purity fell below the
standard of quality represented in labeling, lack of adequate warning

statements.

shipments made on February 23 and March 21, 1973, from Chicago,
Illinois, to Sioux City, Iowa, and Grand Forks, North Dakota. The
pesticides involved were FLOOR CARE SYSTEMS PHENE-A-CIDE
128 and LISTO-PHENE 256 CLEANER-DISFECTANT-
DEODORANT; charges included claims and directions differed from
those made in connection with registration and misbranding—labels
bore a false registration number.
The respondent signed a Consent Agreement. The Final Order
assessed a civil penalty of $1000.00.

This was a civil action charging the respondent with violating the

pesticide involved was ACORN RAT & MOUSE KILLER; the charge
was composition differed from that represented in connection with its
registration.

This was a civil action charging the respondent with violating the

sale on December 11, 1973, at BASF Wyandotte Corporation,
Wyandotte, Michigan. The pesticide involved was SPARTEC
QUATERNARY AMMONIUM COMPOUND; the charge was mis-
branding—labeling bore a statement as to the safety of the product
which was false or misleading.

This was a civil action charging the respondent with violating the

products held for distribution or sale on November 21, 1973, at Rose
Exterminator Company, Cincinnati, Ohio. The pesticides involved
