                   EXECUTIVE SUMMARY

      The Multi-Media Noncompliance Profile is a comprehensive,
automated tool  designed to  aid  the Regions in a  cross-media
approach to enforcement targeting.  The profile is tailored to each
Region  and is  generated  by  the  Corporate  Cross-Regional
Identification Program (CCRIP).

      CCRIP is an automated process developed by the NEIC which
identifies
      •  facility multi-media noncompliance
      •  corporate cross-regional noncompliance
     The results of CCRIP are dependent on data contained in the
following database systems.

     •  AIRS Facility Subsystem (AFS) for air sources regulated
        under the Clean Air Act

     •  Permit Compliance System (PCS) for discharges regulated
        under the Clean Water Act

     •  Hazardous Waste Data Management System (HWDMS) for
        waste facilities regulated under the Resource Conservation
        and Recovery Act

     •  Comprehensive Environmental Response, Compensation
        and Liability Information System (CERCLIS) for sites listed
        in the CERCLA inventory

     •  Toxic Release Inventory  System (TRIS)  for  sources
        reporting under EPCRA  Section  313 (Title III of the
        Superfund Amendments and Reauthorization Act of 1986)

      •  Facility Index System (FINDS) for EPA ED Numbers

      •  Duns Market Identifiers (DMI) for Duns Numbers to
         provide the corporate relationship structure

      Acknowledging  the limitations of the  data, the purpose of
CCRIP is to provide a comprehensive, automated strategy using the
best available  technology  to identify  both  facility  multi-media
noncompliance and corporate cross-regional noncompliance.

      CCRIP was developed in ADABAS/NATURAL and resides on
EPA's IBM 3090 at Research Triangle Park.  Questions about CCRIP

                           INTRODUCTION

       The National Enforcement Investigations Center (NEIC) has been
 involved in  the  development  of a process to  identify multi-media
 noncompliance by regulated entities since the early 1980s.  Initial manual
 cross-references of data from Agency databases  evolved  into computer
 matching of significant  noncompliers using EPA ID number as a link.
 Targeting pilots included  testing SIC code criteria and approaches for
 ranking and screening facilities within specific geographic areas.

 Eventually, the process  was expanded  to encompass the entire United
 States.  Work focused on linking (via a  combination of manual  and
 computer methods) a  parent corporation with its related facilities  and
 subsidiaries to identify  noncompliance within the corporate structure.
 Resulting from this effort was the development in late 1986 of "Potential
 Noncompliance Profiles" for all 10 Regions.  Subsequently,  the Region IV
 Deputy Regional Administrator requested an update to that report.

      Prior to the Region  IV project in May 1987.  database retrieval
 selection logic were fine  tuned to more  closely approximate "significant"
 violation/noncompliance  criteria  for air, water,  and hazardous waste.
 Strategic Planning and Management System (SPMS) measures were used
 as a guideline, in conjunction with Regional program staflf.  In April 1988,
 the noncompliance  profiles were included as part of the Office of Pesticides
 and Toxic Substances' (OPTS) Compliance Monitoring Strategy for section
 313 of the Emergency Planning and Community Right-to-Know Act (Title
 in of the Superfund Amendments and Reauthorization Act of 1986).

      The identification of  corporate, cross-regional noncompliance was
 accomplished by an entirely automated process for the first time in March
 1989.  Instrumental to this achievement,  which represented a major
 milestone in the Agency's ability to integrate environmental compliance
 data from a multi-regional,  corporate perspective, was the Dun's Market
 Identifier (DMI) data leased by the Agency  from Dun & Bradstreet and
made available by OIRM's FACTS database. Access to the DMI file with its

 ability to link a corporate entity with its subsidiaries has enabled the NEIC
 to provide a comprehensive, automated tool for enforcement targeting.

       In December 1989,  the Deputy Administrator  called  for  the
 participation of the Regions in an initiative  to encourage a cross-media
 enforcement  focus.  In his request to the Regions for enforcement pilot
 projects demonstrating a cross-media approach, the Deputy cited NEIC's
 substantial experience in this area and offered NEIC's support to the
 Regions. Region  IV and NEIC have worked  closely in this regard since
 early 1990, and  the automated noncompliance profile has become an
 integral part of Region IV's pilot project and case screening methodology.
 The reports in this profile reflect the criteria agreed upon with Region IV.

       Concurrent with the cooperative  effort in Region  IV, the profile
 process itself has  continued to  evolve.  Most recent enhancements include
 the following:

       •     The addition of Superfund (CERCLIS) and EPCRA (TRIS) data
            as "risk indicators" to further screen the list of multi-media
            violators

       •     Conversion from the Compliance  Data System (CDS) to the
            AIRS  Facility Subsystem  (AFS)  for  sources subject to
            regulation under the Clean Air Act

       •     Re-formatting of the corporate cross-regional report (Multi-
            Regional Listing of Noncompliance Sources) to identify the
            media of each facility's noncompliance

       •     Availability of the software which produces the noncompliance
            profile reports in a user-friendly, menu-driven system

      The data  used in preparing this report are maintained in the
respective database systems by  Headquarters and Regional program staff.
The selection criteria used in data retrieval for these reports are controlled
by the user, and are directly related to the end product, as is the quality of

the data in the various media database systems. All data systems used in
the preparation of these reports reside on EPA's  IBM 3090 mainframe
computer at Research Triangle Park (RTF).  After retrieval from the media
databases, the data are further processed on the IBM 3090 using software
developed in ADABAS/Natural by NEIC.

      Significant noncompliers  in this media are those  active National
Pollutant Discharge Elimination System  (NPDES) permitted facilities
(excluding general and standard permits) designated as major dischargers
with at least one instance of significant noncompliance (SNC) as reportable
on the QNCR for effluent violations, compliance schedule violations, or
DMR nonreceipt between October 1,1989 and September 30, 1990.

RETRIEVAL SPECIFICATIONS

     To retrieve the  facilities which met the above  noncompliance
definition, the following retrieval specifications were established.

     •     Permit Type Indicator (PTYP) absent
     •     Facility Inactive Code (IACC) equal to A (active)
     •     Major Discharge Indicator (MADI) equal to M (major facility)
     •     QNCR Status Code, Previous Year Automatic (PYQS) equal to
           S (SNC Compliance  Schedule Violation), D (SNC  DMR Non-
           receipt); or E (SNC Effluent Violation)

                             AIR (AFS)
      Significant violators in this media include those  operating PSD,
 NESHAP,  NSR, and NSPS sources, operating Class A SIP sources, and
 Class B SIP  sources in non-attainment areas for  ozone with a plant
 compliance status in violation for any quarter corresponding to the period
 October 1,1989 through September 30,1990.
 RETRIEVAL SPECIFICATIONS
      To  retrieve the facilities which  met  the  above noncompliance
definition, the following retrieval specifications were established.

      •    Air program status (APST) equal to 0 (operating)

      •    Plant Compliance Status (DCH1) for the specified period equal
           to any of: 1 (in violation with no compliance schedule), 6 (in
           violation but not meeting compliance schedule, 7 (in violation
           but unknown with regard to schedule), B (in violation with
           regard to both emissions and procedural compliance), or W (in
           violation with regard to procedural compliance).

      •    Month or Quarter (MORQ) for historical compliance status
           equal to Q (Quarter)
AND:
           Historical Compliance Date (HDT1) corresponding to the
           period October 1,1989 through September 30,1990
           Air Program  Code (APCl) equal  to  6 (PSD), 7  (NSR),
           8 (NESHAP), or 9 (NSPS), or

           Air Program Code (APCl) equal to 0 (SIP) or 1 (SIP under
           Federal Jurisdiction) and State Classification Code equal to Al

regulated facilities listed as Treatment/Storage/Disposal (TSDa) facilities
and/or Large Quantity Generators (LQGs) with at least one High Priority
violator classification in one or more of the following areas:  groundwater
monitoring;  closure/post-closure;  compliance   schedule;  financial
responsibility; Part B; manifest; landban violation; or other, which was
discovered by an  evaluation conducted between  October  1,  1989 and
September 30,1990.

RETRIEVAL SPECIFICATIONS

      To retrieve those facilities which met the  above noncompliance
definition, the following retrieval specifications were established.

      •    TSD faculties where C305 exists

      •    Large quantity generators where C1101 equal to 1

      •    Date of Subsequent Evaluation (C2313) greater than or equal to
           October 1,1989 and less than or equal to September 30,1990 and
           at least one of the following:

      •    Class of violation (C2331) equal to H (High Priority Violator) in
           at least one of the following areas:

                Groundwater Monitoring violations (C2332)

                Closure/post-closure violations (C2333)

                Financial responsibility  violations (C2334)

                Part B violations (C2335)

                           EPCRA (TRIS)

      Facilities submitting Form R's under section 313 of the Emergency
 Planning and Community Right-to-Know Act (EPCRA) were selected from
 the Toxic Release Inventory System  (TRIS) if they had reported an actual
 release to any media during any 1-year period beginning in 1987.

 RETRIEVAL SPECIFICATIONS

      To  retrieve facilities which met the criteria  described above, the
 following retrieval specifications were established.

      •     Release  medium equal to  1  (fugitive  or non-point air
            emissions), 2 (stack or point air emissions), 3  (discharges to
            water), 4 (underground injection), or 5 (releases to land)

      •     Release estimate greater  than 0
                      SUPERFUND (CERCLIS)

      Sites  from  the  Comprehensive  Environmental  Response,
Compensation and  Liability Act Information System (CERCLIS)  were
selected baaed on their National Priority List (NPL) status. Sites which
were identified aa either final or proposed NPL sites were included.

RETRIEVAL SPECIFICATIONS

      Tax retrieve facilities which met the criteria described above, the
following retrieval specifications were established.

      •     National Priority List Indicator (C305) equal to F (final) or P
           (proposed)

                    FACILITY INDEX SYSTEM (FINDS)

       Having met the criteria defined above, facilities from the five media
 databases were cross-matched against each other and against FINDS data,
 using EPA identification number (EPA ID) as the common link.  A facility
 was defined by a unique identification number; either the EPA ID number,
 if one existed, or by a unique Source ID number in the respective  database.
 The matching process resulted in the identification of multi-media violators
 and associated risk indicators as shown for each Region.


                 DUNS MARKET IDENTIFIERS (DMI)

      Facilities from the Air, Water and Hazardous Waste noncomplier
 lists were  then  processed to  identify  corporate  cross-regional
 noncompliance.  This was accomplished by computer software developed by
 NEIC specifically for this purpose, involving a complex, iterative routine
 using DUNS and EPA ID numbers, facility and alias names and locations,
 company names  and secondary names.  Using the corporate/subsidiary
 relationships established by the  DMI file, this artificially  intelligent
 program produced the Multi-Regional Listing  of Noncompliance Sources
 for each Region.  The report associates each noncompliant facility with its
 respective corporation, along with other noncompliant facilities from other
Regions belonging to the same corporation.

                           DISCUSSION

      Tables 1, 2, and 3 (Noncompliance Sources in Air, Water, and RCRA,
 respectively), are simply a list of single media noncompliers based on the
 criteria here defined. Contained in the tables are data from the respective
 media database, including identification number, facility name, city, and
 state.

      The Multi-Media Noncompliers Report [Table 4] contains the EPA ID
 number by which the match was accomplished.  Lacking  EPA ID numbers
 in PCS  and AFS hindered the process.   However,  this was partly
 compensated for by using source identification  numbers to  obtain a
 corresponding EPA ID from FINDS and subsequently provided additional
 matches.

      The Multi-Regional Listing of Noncompliance Sources [Table 5] was
 produced  by  a  complex,  iterative  routine  which establishes
 corporate/subsidiary relationships using Dun &  Bradstreet data, and
 supplemented by a  computerized string-matching artificially intelligent
 algorithm based  on  name and location.  The report is comprised of Air,
 Water, and RCRA violators (from Tables 1, 2, and 3) related to a corporation
 which has shown noncompliance in more  than one Region.  Listed are
 corporate name (asterisked); violating facility name, location, and EPA ID
 number, company DUNS number, EPA Region number; media database
(Source) from which the facilities originated, and whether the  match was
accomplished on name (N) or number (#).  Whether or not the cross-
regional noncompliance is/is not multi-media,  the case is noted in the
Source
