     Final authorization is not contingent upon the State assuming permit
responsibility for RCRA permits issued by EPA, nor is it cause for termination
of an EPA-issued permit.  EPA-issued permits remain in effect until terminated-
under 40 CFR 240.43 for cause (e.g., noncompliance by the permittee) or trans-.
ferred by agreement between the permittee and EPA as provided in §271.8(b)(6).»
(See also §124.5(d).)  Eventually, once the State has authority, it must issue
a State RCRA permit or assume responsibility for administering the Federal RCRA
permit.  However, it does not need to do so immediately as a condition of
receiving final authorization.

     States with Phase II or final authorization must comply with 40 CFR
124.lO(e) which requires a copy of the fact sheet or statement of basis, the
permit application and the draft permit to be mailed to all persons identified
in §124.10(c)(l)(i)-(iv).

RCRA Section 3QQ5(a) applies.   That  is,  owners  and operators of
facilities tnat treat, store, or  dispose of  hazardous waste can
legally do so only when  tney  have  a  RCRA perm::.   Also, 3CRA
Section 30Q5(e) applies, allowing  qualified  facil::ias to continue
to operate under federal "interim  status",   vihen  the state receives
