BACKGROUND INFORMATION:  NATIONAL PRIORITIES LIST, PROPOSED UPDATE #6


     At this time, the U.S. Environmental Protection Agency (EPA) is
proposing 64 sites, including 1 Federal facility, as Update 16 to the
National Priorities List (NPL).  The update includes sites from  24 of the
50 States, the District of Columbia, and 6 Territories.  Pennsylvania
leads with 15 sites, followed by Virginia with 6.  This proposal brings
to 248 the number of sites proposed for the NPL.  Adding the 703 sites
already on the NPL brings the total to 951.

     The NPL identifies the targets for long-term "remedial action"
under the "Superfund" law, the Comprehensive Environmental Response,
Compensation, and Liability Act of 1980 (CERCIA) as amended by the Superfund
Amendments and Reauthorization Act (SARA), enacted on October 17, 1986.  The
laws provide a Trust Fund to pay costs not assumed by responsible parties
for corrective actions at abandoned or uncontrolled hazardous waste sites
that threaten public health or the environment.  EPA has the primary
responsibility for managing cleanup and enforcement activities under
Superfund.*

     To date, EPA has inventoried almost 26,000 uncontrolled
hazardous waste sites.  Seme require emergency action because they
represent an immediate threat.  EPA cleans up such sites promptly through
its "removal" program.  As of December 1, 1986, EPA had undertaken 819
removal actions, of which 194 were at NPL sites where initial cleanup
measures were required.  To. be eligible for a long-terra remedial action
under Superfund, however, a site must be included on the NPL.

     The 64 Update #6 sites are proposed for the NPL on the basis of
their scores on the Hazard Ranking System (HRS), a numerically based
system designed to evaluate the relative risks posed by a site to public
health or the environment.  Section 105(c) of SARA requires that the HRS
be revised by April 1988.  All Update #6 sites received HRS scores of
28.50 or above on the existing HRS and will not be reevaluated using
the revised HRS.

     Prior to Proposed Update #6, 887 sites were on or proposed  for the NPL.
These sites can be grouped in the following way:

     0 703 final sites
     0 184 proposed sites  (including 2 from Update #1, 86 from Update  *2,
       24 from Update  13,  27  from Update #4, and  45 from Update  #5)

     One site in Update #4, Silver Creek Tailings in Park City   Utah   was
removed from proposed  status on October 17, 1986, as. required Ivf
118(p) of SAPA.

BP-Related Sites
In Nov ber 1984, the Hazardous and Solid Waste hnendments were
enacted, expanding EPA’S authority to require corrective maasures under
Subtitle C of the Resource Conservation and Recovery Act ( h). As a
result of this broadened RA authority, EPA is revising its policy for
placing Rh-related sites on the NPL, and in June 1986, announced three
major ccznponents of a final W RP policy. The three are:
The facilities are c ined by persons who are bankrupt.
o The facilities have lost authorization to operate, and there are
additional indications that the ners or operators will be unwilling
to undertake corrective action.
o Sites, analyzed on a case-by-case basis, whose ners or operators
have shown an unwillingness to undertake corrective action.
In June 1986, EPA requested public ocmnent on a proposal to add
specificity to the third canponent. EPA will consider suppler nting the
final NPL/BCRh policy if ccmnents or experience with the new policy dei n-
strate that additional categories of RCM-related sites should be placed
on the NPL to ensure appropriate and expeditious resedial action.
Proposed Update #6 includes four 1 2RA-related sites. Three are
being proposed for the NPL ai the basis of the first ca anent:
° Parsons Casket Hardware Co., Belvidere, Illinois
Allied tin Inc., Portland Oregon
° Pala tto Recycling, Inc., Columbia, South Carolina
One RCRA-related site is being proposed on the basis of the second
ccx onent:
° Chan-Solv, Inc., Cheswold, Delaware

Federal Facilities
Section 120(a) of SARA requires that Federal facilities be subject
to and ca ply with CERCLA in the same manner as any nongovernmental
entity. In addition, listin Federal facilities is consistent with the
NPL’s purpose of informing the public about sites that present potential
hazards. CERCT.A section 111(e)(3), however, prohibits use of the Trust
Fund for remedial actions at Federally—owned facilities.
Update #6 proposes one Federal facility:

E scription of Lists
Each entry in the two lists of proposed Update #6 sites (one arranced
by two—letter State abbreviations and the other by group) contains the
name of the site and the State and city or county in which it is located.
Two additonal types of information are provided:
o The group in which the proposed site would appear in the
groups of 50 on the final NPL. Fbr example, the sites in Group 8
of the proposed update have RRS scores that fall within the
range of scores covered by the eiqhth group of 50 sites on
the final NPL.
° One or ,i ore notations referencing the type of response and
the status of cleanup activities.
Five response categories are used to designate the type of response
underway. One or more categories may apply to each site • The five are:
R = Federal and/or State response
F = Federal enforcement
S = State enforcement
V = luntary or negotiated response
D = To be determined
For informational purposes, cleanup status is indicated where field
activities are underway or canpieted. Many sites are cleaned up in
stages or °operahle units” —— that is, a discrete action taken as part
of the entire site cleanup that significantly decreases or eliminates
contamination, threat of contamination, or pathway of exposure. One or
more operable units may be necessary before EPA considers the cleanup
of a hazarrious waste site coi p1eted. A simple action such as constructing
a fence is not cons idereci an operable unit for coding purposes.

Three cleanup status codes are used. ( ily one code can be used at
a site because the codes are mutually exclusive). The three codes are:
I = Implenentation activities are underway for one or
more operable units.
0 = Implementation activities are canpleted for one or
more (but not all) operable units.
C = Implementation activities are canpieted for all
operable units.
In the third list (951 final and proposed sites), all sites are
arrarx ed alphabetically by State • The list provides the date each site
was proposed; the date the site became final and its position on the NPL;
and for a site still in proposed status, its group in the final NPL.
