Although at times there are difficulties in applying the minimum thickness
concept, it is an important requirement that must be addressed in every RCRA

As you know, part o our onçjoing etfort to monitor regional
CRA permit programs invol7ea reviewing the final erTaits
issued by each Re ional Ottice. We have generally been impressed
by the quality of the permits issued by h egion II. However,
we recently r oticed a ricus omisaion in two 0 f the permits
that I want to bring to your attention. Specifically, the
requirement to est 1DlL fl rulni aum shell thicknesses for hazardous
waste etoraye/ treatruent tanks has oeen waived in the permits
issued to C & 0 uatt3rie s in riuguenot, NY, and the General
Electric R & D Center i.n Schenectady.
As stated in SZ70.32(b), ‘eacn RC1 A permit shaLl. include
permit coRditiona necessary to achieve conipliance with the Act
and reçulatione, including eson of the appLicable requirements
specified in 40 CFR Parts 264, 266, and 270.’ One of these
requirements is that ‘the Regional A dministrator shall require
that a ninimum shell tnlcknesR be naintaina’i at all times to
ensure 3ufficient shell str nyth ( 264.l9l). The regulations
contain no provision for ranting a waiver ot tne minimum shell
thickness requirei ent. eUthouç h I recogrtiz tnat there are
difficulties in ap lyi.ruj the minimum shell thic n ss concept,
it is nevertheless an i ’portant re.j’lldtory re uiremeflt, an It
ust be addressed in every CRA tank er it. I nope tnat
Region Ii will, act to ensure that the re utr ment will not be
