Please update all community relations mailing lists to include all known PRPS. Notice to PRPs cannot be overstressed. Its significance is reflected in the statutory emphasis on public participation provided in section 113 of CERCLA, as amended. Giving PRPs the opportunity to be involved in the response selection may reduce cleanup delays caused by lack of communication. As you are aware, the Agency has several mechanisms in place to notify PRPs of impending actions. In most cases, we employ Federal j r notices for NPL listing, general notice letters at the completion of the PRP search, special notice or section 122(a) letters for removal and remedial actions, notices in local newspapers when the RI/FS and proposed plan are prepared, a newspaper notice of the public availability of tice administrative record file and an additional newspaper notice when the ROD is signed. The community relations mailing list will augment other notice procedures and can help ensure that all known PRPs are kept informed of the activities at the relevant site. ------- OSWER Directtve b98) , For further information or questions concerning this memorandum, please contact Sven—Erik Kaiser (FTS 475-9806) of the Office of Waste Programs Enforcement. cc: Hazardous Waste Branch Chiefs, Regions I - X Superfund Community Relations Coordinators, Regions I - X Lisa Friedman, OGC Glenn Tlnterberger, OECM Russ Wyer, OERR Lloyd Guerci, OWPE 2 ------- |
