Monofills Exempt from the Minimum Technological Requirements RCRA §3004(o)(3) exempts certain monofills from the minimum technological requirements (MTR) for hazardous waste surface impoundments, landfills, and waste piles. How is "monofill" defined? What monofills are exempt? RCRA contains no general statutory or regulatory definition of a "monofill " RCRA §3004(o)(3) states that the MTR requirements "may be waived by the Administrator for any monofill, if — "(A) such monofill contains only hazardous wastes from foundry furnace emission controls or metal casting molding sand, "(B) such wastes do not contain constituents which would render the wastes hazardous for reasons other than the Extraction Procedure ('EP') toxicity characteristics set forth in regulations under this subtitle, and "(C) such monofill meets the same requirements as are applicable in the case of a waiver under §30050X2) or (4)" Section 3005(j)(2) provides that the unit must have at least one liner, for which there is no evidence of leakage, be located more than one-quarter mile from an underground source of drinking water, and be in compliance with the applicable groundwater monitoring requirements, found in 40 CFR Parts 264/265, Subpart F. Section 3005(j)(4) requires that the unit be "located, designed and operated so as to assure that there will be no migration of any hazardous constituent into groundwater or surface water at any future time " For a monofill to be exempt from MTR, it must meet the above criteria, as set forth in the unit-specific exemptions: §264 221(e) for surface impoundments, §264 251(e) for waste piles; and §264.301(e) for landfills 2. Applicability of F009 Listing to Cleaning Tank Sludge During its electroplating operations, a facility generates an F009 spent cleaning solution in a cleaning tank. During use contaminants settle out and form a sludge on the bottom of the cleaning tank. When the spent cleaning bath is removed it is managed as a F009 waste Would the sludge removed from the bottom of the cleaning tank also be classified an F009 waste ? Yes, the sludge removed from the bottom of the cleaning tank would be an F009 listed waste. The listing in 40 CFR §261.31 defines F009 wastes as "spent stripping and cleaning bath solutions from electroplating operations where cyanides are used in the process " The settled materials forming the sludge are part of the spent stripping and cleaning bath solutions, and, therefore, are an F009 waste. 1 ------- Hotline Questions and Answers June 1998 3. Exemption for Scrap Metal Destined for Recycling Applies at Point of Generation RCRA exempts from hazardous waste regulation scrap metal which is being recycled (40 CFR §261 6(a)(3)(a)) In addition, RCRA excludes from the definition of solid waste, and thus the definition of hazardous waste, processed and certain other scrap metal being recycled (§261 4(a)( 13)). A facility generates a scrap metal, which is not excluded under §261.4(a)(13), which exhibits the toxicity characteristic for lead (D008). The facility intends to send the scrap metal to a reclamation facility Must the facility handle this scrap metal as a hazardous waste, including compliance with manifesting provisions, until the material is actually placed in the reclamation unit7 The facility would not need to manage as hazardous waste scrap metal destined for reclamation which is not otherwise excluded under §261 4(a)(13) before placement in the reclamation unit, and would not need to manifest shipments of the material off site Scrap metal that is intended to be reclaimed is exempt from Subtitle C regulation at the point of generation. However, the mere intent to reclaim the material is not adequate for it to remain exempt. If the material is not reclaimed (e.g , if it is speculatively accumulated per §261.1(c)(8)), the exemption does not apply and the material remains subject to all applicable hazardous waste regulations from the point of generation. Only if the facility ensures that the material will be reclaimed will the hazardous waste regulations not apply. UST 4. Release Detection for Hazardous Substance Underground Storage Tank Systems Owners and operators of existing (installed on or before December 22, 1988) hazardous substance underground storage tank (UST) systems are required to provide release detection in accordance with 40 CFR §280 42, which specifies that the release detection methods must meet the requirements in §280 41 Section 280.41 outlines the release detection requirements for petroleum USTs, including monthly monitoring methods such as automatic tank gauging and vapor monitoring, as well as a temporary release detection method that combines monthly inventory control with tank tightness testing. Section 280.41(a)(1) allows owners and operators of petroleum USTs that meet the new or upgraded tank standards to use the temporary release detection method instead of one of the monthly monitoring methods. If the entire UST system is upgraded, this temporary method can be used until December 22, 1998, or for up to 10 years after the tank meets corrosion protection standards, whichever is later. In order to comply with the release detection requirements, can an existing hazardous substance UST use the temporary release detection method in §280.41(a)(l)? For how long can they use the method? Since existing hazardous substance USTs must meet the requirements of §280.41, they may use the combination method of inventory control and tank tightness testing as a means of release detection if they meet the conditions of §280 41(a)(1) However, unlike petroleum USTs, hazardous substance USTs cannot use the combination method beyond December 22, 1998. By December 22, 1998, all hazardous 2 ------- June 1998 substance UST systems must meet the release detection provisions of §280 42(b), which require the use of monthly interstitial monitoring (§280 42(a)) Owners and operators of hazardous substance USTs who choose to use the temporary method of release detection in §280 41(a)(1), must still change to interstitial monitoring as their method of release detection by December 22, 1998 5. Calculating Annual Throughput for Underground Storage Tanks (USTs) Owners and operators of petroleum USTs must demonstrate financial responsibility m both per occurrence and annual aggregate amounts The per occurrence financial responsibility requirements for petroleum USTs are dependent upon the type of facility as well as the average amount of petroleum handled at a facility in a month, based on annual throughput (§280 93(a)) Owners and operators of petroleum marketing facilities, or facilities that handle an average of greater than 10,000 gallons of petroleum per month based on annual throughput, are required to demonstrate $1 million in per occurrence coverage (§280.93(a)( 1)). Owners and operators of all other petroleum UST facilities are required to demonstrate $500,000 in per occurrence coverage (§280.93(a)(2)). Annual throughput depends on the amount of petroleum product removed or dispensed from USTs at all facilities of an owner and operator throughout the previous calendar year If a particular facility has a system in which petroleum is continuously pumped from a UST, used, and then repumped into the same UST, is this amount of product counted towards the annual throughput amount each time it leaves the UST, or only initially, since it is reused in the same system 7 Hotline Questions and Answers When calculating annual throughput for the purposes of UST per occurrence coverage, owners and operators must count any amount of petroleum that is dispensed or removed from the UST system, regardless of how many times the petroleum is recirculated through the tank system. Therefore, if 100 gallons of petroleum is removed from an UST system, is used and then returned to the system, and removed again during a calendar year, the amount counted towards annual reportable throughput is 200 gallons RCRA §9003(d)(5)(C) authorized EPA to create financial responsibility categories based on the amount of petroleum handled by a UST system, as well as the likelihood of releases from the system EPA did not intend to distinguish between a UST system re'dispensmg petroleum product from one that dispenses the same amount of new product. "Hazardous Waste Combustors; Revised Standards; Final Rule - Part 1: RCRA Comparable Fuels Exclusion; Permit Modifications for Hazardous Waste Combustion Units; Notification of Intent to Comply; Waste Minimization and Pollution Prevention Criteria for Compliance Extensions" June 19,1998 (63 FR 33782) EPA finalized some of the elements of the proposed revisions for air emissions standards for certain hazardous waste combustion units. The elements include a conditional exclusion from RCRA for fuels which are produced from a hazardous waste, but which are comparable to some currently used fossil fuels; a new RCRA permit modification provision which is intended to make it easier for facilities to make changes to their existing RCRA permits when adding air pollution control equipment or making other changes in ------- Federal Registers June 1998 FINAL RULES equipment or operation to comply with air emissions standards; notification requirements for sources which intend to comply with the final rule, and allowances for extensions to the compliance period in certain cases. The effective date of the rule is June 19, 1998. "Organobromine Production Wastes; Identification and Listing of Hazardous Waste; Land Disposal Restrictions: Listing of CERCLA Hazardous Substances, Reportable Quantities; Final Rule" June 29,1998 (63 FR 35147) EPA announced technical amendments to the May 4, 1998, rule promulgating the listing of two organobromine production wastes as hazardous (63 FR 24596). The effective date of the rule is June 29, 1998. CERCLA "National Priorities List, Notice of Deletion; Southern Shipbuilding Corporation Superfund Site" June 16,1998 (63 FR 32760) EPA announced the deletion of the Southern Shipbuilding Corporation Superfund Site, located in Louisiana, from the National Priorities List (NPL). EPA published its intent to delete the site on March 31, 1998 (63 FR 15346). EPA and the State of Louisiana have determined that no further response action by responsible parties is appropriate for the site "National Priorities List, Notice of Deletion; Beulah Landfill Site" June 22,1998 (63 FR 33855) EPA announced the deletion of the Beulah Landfill Site, located in Florida, from the NPL. EPA published its intent to delete the site on April 24, 1998 (63 FR 20361) EPA and the State of Florida have determined that no further response action by responsible parties is appropriate for the site. "National Priorities List, Notice of Deletion; Pine Bend Sanitary Landfill Site" June 23,1998 (63 FR 34132) EPA announced the deletion of the Pine Bend Sanitary Landfill Site, located in Minnesota, from the NPL. EPA published its intent to delete the site on April 28, 1998 (63 FR 34132). EPA and the State of Minnesota have determined that no further response action by responsible parties is appropriate for the site. "National Priorities List, Notice of Deletion; Berlin and Farro Liquid Incineration Site" June 24,1998 (63 EE 34320) EPA announced the deletion of the Berlin and Farro Liquid Incineration Site, located in Michigan, from the NPL. EPA published its intent to delete the site on January 19, 1998 (63 FR 3061) EPA and the State of Michigan have determined that no further response action by responsible parties is appropnate for the site. 10 ------- June 1998 PROPOSED RULES EPCRA "Emergency Planning and Community Right-to-Know Programs; Amendments to Hazardous Chemical Reporting Thresholds, Streamlining Requirements" June 8,1998 (63 FB 31268) EPA proposed to modify 40 CFR Parts 355 and 370, which implement EPCRA §§302, 303, 304, 311, and 312. Proposed changes include raising the reporting thresholds under §§311 and 312 for gasoline and diesel fuel in underground tanks at retail gas stations, and several additional hazardous chemicals. EPA is also proposing to clarify the mixture reporting requirements under §§311 and 312. The preamble to the rule contains draft guidance to provide states and local governments with more discretion in implementing the federal requirements EPA is also proposing to rewrite Parts 355 and 370 to make them easier to understand and to use. NOTICES RCRA "Paper Products Recovered Materials Advisory Notice II" June 8,1998 (63 FR 31214) EPA provided notice of the availability of the Paper Products Recovered Materials Advisory Notice II (Paper RMAN II), which revises EPA's 1996 recommendations for purchasing specified printing and writing papers containing postconsumer fiber. The effective date for the notice is December 31,1998. Federal Registers "Recovered Materials Advisory Notice I Update" June 8, 1998 (63 FR 31217) EPA provided notice of the issuance of an update to its May 1, 1195, Recovered Materials Advisory Notice (RMAN I) The update provides guidance to procuring agencies for purchasing certain items containing recovered materials Today's RMAN I update contains a new reference to GSA's carpet schedule and a recommendation for the recovered materials content level for plastic batt building insulation. "Hazardous Waste Land Disposal Restrictions: Notice of Public Meeting" June 9,1998 (63 ER 31463) EPA announced a public roundtable discussion on the Agency's efforts to evaluate important aspects of and potentially improve the RCRA LDR Program. "Agency Information Collection Activities - Proposed Collection; Comment Request; Survey of the Chlorinated Aliphatics Industry" June 18,1998 (63 FR 33370) EPA announced the submission of the following Information Collection Request (ICR) to the Office of Management and Budget (OMB): Survey of Chlorinated Aliphatics Industry. Comments on the ICR must be received on or before August 17, 1998. "Solicitation of Additional Pilot Projects Under Project XL; June 12,1998" June 23,1998 (63 EB 34161) EPA solicited proposals for facilities to participate in Project XL.
