908R92003 C PPA HAZARDOUS WASTE INCINERATORS ^ CrM BOILERS AND INDUSTRIAL FURNACES UPDATE #1 United States Environmental Protection Agency DENVER, COLORADO • APRIL 1992 Region VIII INTRODUCTION This is the first in a series of information updates from the U.S. Environmental Protection Agency (EPA) regarding proposed incineration activities in Region VIII. TTiese updates will be developed in cooperation with state environmental agencies in Colorado, Utah, Wyoming, North Dakota, South Dakota and Montana. The purpose is to keep interested parties informed of possible incineration activity in their communi- ties. BACKGROUND Public interest in the incineration of hazardous waste has become intense throughout Region VIII. In response to this interest, EPA and state agencies have developed plans for keeping residents informed, especially in areas where inciner- ation activities may occur. To date, the following has been done to meet this commitment: 1. August, 1991. Established mailing list of interested resi- dents and organizations. 2. September, 1991. Established information repositories at local libraries in communities where hazardous waste incineration facilities have been proposed. 3. September, 1991. Distributed a Colorado Department of Health fact sheet on incineration to selected communities. 4. September, 1991. Distributed a press release regarding facilities which had attempted to achieve interim status. 5. October, 1991. Updated information repositories with new information. 6. November, 1991. Distributed information on the Resource Conservation and Recovery Act (RCRA) regulatory pro- cess as it relates to boilers and industrial furnaces. EPA is committed to providing information to the public on a timely and regular basis. With this mailing, EPA Region VIII is supplying information related to the February 21,1991 Boil- er and Industrial Furnace (BIF) Rules and an update on BIF and incinerator facilities. STATUS OF HAZARDOUS WASTE BOILERS & INDUSTRIAL FURNACES IN REGION Vffl On September 19,1991, EPA sent letters to all Boiler and Industrial Furnace (BIF) facilities which had submitted Part A applications by the August 21,1991 regulatory effective date, but had not begun managing hazardous wastes as of that date (i.e. cement kilns listed below). These letters requested an extensive amount of information in order to assist EPA in fully assessing the facilities' representations that they met the criteria for being considered a Federal "interim status" facility. See map on page 3 for location of all facilities referenced in this update. Status of Cement Kilns ASH GROVE CEMENT COMPANY AT CLANCY, MONTANA ASH GROVE CEMENT COMPANY AT LEAMINGTON, UTAH Legal Counsel for Ash Grove Cement West, Inc. responded to EPA*S request in an October 25,1991 joint letter, providing supporting documents for both facilities. EPA has reviewed the response and issued opinions that the facilities do not sat- isfy criteria to achieve Federal interim status (3125192). Ash Grove has expressed an intent to pursue a RCRA Part B per- mit. The Utah State Legislature in its 1992 session imposed a per- manent moratorium on new commercial incinerators. Cement kilns in Utah must meet the hazardous waste siting criteria established by the State as part of the permitting pro- cess. The State of Montana's Department of Health and Environ- mental Sciences proposed rules for BIFs in December, 1991. Montana's proposed rules specify that only those facilities which burned hazardous waste before EPA's August 21,1991 BIF effective date are qualified for interim status. A public hearing for oral testimony regarding the proposed rules was held on January 27,1992. The public comment peri- od for written comments on the proposed rules expired on February 10,1992. Numerous comments were received. A hearing to accept comments On EPA'S BIF rules was conduct- ed by Senator Max Baucus on March 28,1992. The Department has elected, at this time, to adopt only that portion of the proposed rule which disallows interim status for the burning of hazardous waste in boilers and industrial fur- naces. This rule became effective on March 13,1992. The Department has elected to defer a decision on adoption of the Federal boiler and industrial furnaces rule until the numerous comments have been fully addressed. Due to the volume of comments received, this process may take several months. ------- HOLNAM CEMENT PLANT AT THREE FORKS, MONTANA Holnam Inc. responded to EPA's information request in an October 22,1991 letter, providing supporting documents. EPA has reviewed the response. On March 25, 1992 EPA issued an opinion that the facility did not satisfy criteria to achieve Federal interim status. Holnam intends to pursue a Part B permit rather than interim status. MOUNTAIN CEMENT COMPANY IN LARAMIE, WYOMING Centex Cement Enterprises, Inc. responded to EPA's request in an October 4,1991 letter, providing supporting documents. EPA reviewed the response and stated in a letter dated Jan- uary 2,1992 that it does not believe the facility achieved Fed- eral interim status. The office of the Wyoming Attorney General and the Wyoming Department of Environmental Quality have deter- mined that State laws require a State hazardous waste treat- ment permit, which the facility does not have. SYNTEX CHEMICALS INC., IN BOULDER, COLORADO This facility processes waste industrial solvents generated at the plant. These reclaimed solvents are used as fuel substi- tutes in a steam boiler. On August 21,1991, the company sub- mitted information constituting a modification to its present hazardous waste storage permit to include its boiler unit. On February 21,1992 the company submitted a Permit Modifica- tion Application and a trial burn plan. EPA is reviewing this application and trial burn plan to determine if they conform to the requirements of the BIF rule. Syntex held a public meeting on April 2 in Boulder to explain the nature of its application and receive comments and ques- tions from the public. A 60-day period for the public to send written comments to EPA began February 27,1992 and ends April 27,1992. Comments should be directed to Harold Dunning at the address indicated below. OTHER There are four other cement kiln facilities in Region VIII which have previously expressed an interest in managing haz- ardous wastes at their facilities. They include the Holnam facility in Laporte, Colorado; the Holnam facility in Florence, Colorado; the Southwestern Portland Cement facility in Lyons, Colorado; and the South Dakota Cement Company in Rapid City, South Dakota. As of this date, none of these facil- ities has outlined a schedule to pursue RCRA Part B permits. The South Dakota facility is evaluating an Environmental Impact Statement for such activities. EPA will inform resi- dents of the surrounding areas if formal applications are sub- mitted to allow burning of hazardous waste fuel. STATUS OF HAZARDOUS WASTE INCINERATORS IN REGION Vm APTUS AT ARAGONITE, UTAH Several permit modifications have been or are being pro- cessed for this facility. A trial burn at Aptus began March 13, 1992 and will be concluded by May 1. Aptus will be operating under post trial burn conditions until evaluation of the trial burn data and a determination that full operation can begin. USPCI AT CLIYE, UTAH The Utah Department of Environmental Quality issued a RCRA permit to the facility on November 1,1991. EPA issued its portion of the permit on January 9,1992. Currently the facility is under construction. The State permit was appealed by the Utah Sierra Club to the Utah Solid and Haz- ardous Waste Control Board. A hearing on the appeal was held March 16-17,1992. A final discussion and decision on the appeal was scheduled for April 9,1992. OBSOLETE CHEMICAL MUNITIONS DESTRUCTION SYSTEMS - TOOELE, UTAH The U.S. Army has submitted trial burn plans for mustard agent incineration at the Chemical Agent Munitions Destruc- tion System (CAMDS) RD&D facility. Trial burns at the CAMDS facility were conducted in January, 1992. Construc- tion continues at the new Chemical Stockpile Disposal site. Utah also received an application for a Cryofracture/Inciner- ation Disposal Plant (CIDP) research, demonstration, and development (RDD) permit in February 1992. ROCKY MOUNTAIN ARSENAL AT DENVER, COLORADO A Superfund Interim Remedial Action (IRA) cleanup pro- gram at the Rocky Mountain Arsenal has begun. Construction of the Submerged Quench Incinerator for destruction of Basin F liquids is underway. EPA and the Colorado Department of Health have reviewed and commented on the TYial Burn and Startup Plans. Testing is planned for October 1992 and a trial burn is scheduled for December 1992. WASTE TECH AT GOLDEN, COLORADO This research scale fluidized bed incinerator received a permit in February 1989. The company reports that no hazardous waste has been incinerated in the unit since July 1989. OTHER There are at least two other potential hazardous waste incin- erators in Region VIII: CTI AT FLAGLER, COLORADO CTI is still discussing permit submittal requirements with the Colorado Department of Health and EPA. A permit applica- tion is expected to be submitted to the agencies in 1992. PUEBLO DEPOT AT PUEBLO, COLORADO The U.S. Army is pursuing planning and permit preparation for mustard agent incineration. These are the Cooperative Power Association Coal Creek Station in Underwood, North Dako- ta; the United Power Association Stanton Generating Station in Stanton, North Dakota; Pacific Power's Jim Bridger Plant at Point of Rocks, Wyoming; Pacific Power* Dave Johnson Plant at Glenrock, Wyoming; Pacific Power/Utah Power's Wyodak Power Plant in Gillette, Wyoming; and Geneva Steel in Provo, Utah.
