Adopted June 4, 1970 H 3854 To establish the Florida Water Pollution Control and Sewage Treatment Plant Grant Act of 1970 setting up a State water pollution control fund administered by the Air and Water Pollution Control Board to provide grants to local agencies for sewage treatment projects eligible for federal funds. Law without approval, July 1, 1970 H 3882 To establish the Florida Environmental Inventory Council; providing that said council shall be advisory to the Department of Natural Resources. Adopted April 15, 1970 To allow a tax deduction to every person with respect to the amortization of the araortizable basis of any certified water or air pollution control facility in the manner, for the period and to the extent set forth in Section 169 of the Internal Revenue Code. The deduction, however, is available only with respect to a facility that is completed or acquired by the tax- payer before January 1, 1975. Violation of this law is punishable by a fine. The sum of $20,000 has been appropriated to the Water Resource Board for the purpose of a feasibility study of the Council Unit program. Another $150,000 has been appropriated solely for the purpose of making an independent economic feasibility study by the Board of the proposed development of the Mountain Home Division of the Southwest Idaho Water Development project. This study shall examine in depth, not only the joint venture proposal as now offered by the Board, but also the feasibility of the joining of other participants or of the State's developing all of the features of the project. This study shall provide the determinants for a conclusion by the legislature as to all of the benefits of the proposed project and who the recipients will be. Effective March 14, 1970. The Idaho State Board of Health may make pay- ments of 25 percent of the estimated reasonable cost of the project where water quality standards have been established for the waters into which the project discharges and where such action will result in a federal grant of not less than 50 percent of the estimated reasonable cost of the project. To provide for the issuance of general obligation bonds of the State to carry out the provisions of this Act. The Illinois Air Pollution Control Board and the State Sanitary Water Board are abolished and replaced with three new agencies: an Environ- mental Protection Agency for research, investigation and enforce- ment as well as negotiation for interstate compacts and other governmental arrangements; a Pollution Control Board, charged with establishing, promulgating and implementing control standards and rules and regulations; and an Illinois Institute for Environ- mental Quality to advise the agency and the Board in the formula- tion of regulations and the development of enforcement strategies. Citizens, under the Act, have the right to bring private actions upon written notice against polluters before the Board*, increase the penalties for violations; permit the Agency to seal equipment found to be creating pollution without a court order in cases of emergency, and appropriate $9 million for the environmental pro- tection program. The agency shall issue and serve upon the person complained against a written notice, together with a formal com- plaint, with the person so complained against appearing before the Board. To provide for the planning and regulation of solid waste storage, collection, transportation, processing and dis- posal systems. Provides that after June 30, 1976, in all counties of the State, it shall be unlawful for any person to operate a solid waste processing facility or a solid waste disposal area of a solid waste management system without first obtaining a permit from the Kansas State Department of Health. To authorize the Department to assist counties and municipalities by administering grants up to 50 percent of the costs of preparing official plans for solid waste management systems.
