REGULATORY & REQUIRED ACTIONS PREMANUFACTURE NOTIFICATION (PMN). .. SECTION 5 Under Section 5(a)(1) a person who intends to in- troduce into commerce a chemical substance not on the TSCA inventory must notify EPA at least 90 days before beginning manufacture, This rule would apply also to importers. The notice must give the chemical identity, production volume, uses, byproducts, oc- cupational exposure and other health and en- vironmental effects information in the submittor's possession. EPA is to use the review period to deter- mine if the substance might present an unreasonable risk that should be remedied through either an order to develop sufficient information or an immediately effective rule. Upon such a deter- mination, EPA issues an order to prohibit manufac- ture and then applies to the court for an injunction to this effect. This order must be issued 45 days before the notification period ends. The original period may be extended by EPA for up to 90 days for good cause noted in the Federal Register. Absent such an order or immediate rule, the manufacturer may proceed with his plans. EPA publishes in the Federal Register a summary of each PMN five days after its receipt and a status report on all current receipts at the beginning of each month. Copies of the revised pro- posed forms for manufacturers, importers and ex- porters are available from I AO for use by submittors during the interim period (See 44 FR 28564, May 15, 1979 and 44 FR 59764, Oct. 16, 1979). A final PMN rule is expected in the fourth quarter of 1980. EPA has published three PMN status reports, which are reproduced below. SECTION 5(e) Under Section 5(e) EPA may, after determining that there Is insufficient Information in a PMN to evaluate a potential unreaonable risk, order that manufacture of the new substance be prohibited until adequate data are developed. The manufacturer has 30 days from the order's receipt to object. If he does object, EPA then has 15 days to obtain a court order pro- hibiting manufacture until adequate data are developed. The company is under no time limit to submit the information, but until It does so, EPA's manufacturing ban remains in effect. On April 23rd EPA issued the first order under Sec- tion 5(e) to prohibit manufacture of six new phthalate ester plasticizers, pending development of adequate information to evaluate the following risks: causing cancer, reduction of fish populations, and blo- concentration in fish. Because no safety studies were submitted by the company in the PMN, informa- tion on their potential harm was derived from studies on existing plasticizers and their structural analogues, dialkyl phthalates. In particular, EPA cited the recent finding by the National Cancer In- stitute showing di-(2-ethylhexyl) phthalate to be a carcinogen. However, EPA judged the data available for the category of chemicals known as dialkyl phthalates to be Insufficient to evaluate the cancer risk. The PMN chemicals are plasticizers which are used to give flexibility to polyvinyl chloride plastic products such as garden hoses, floor tiles and refrigerator gaskets. EPA estimates that from 300 to 400 workers could be exposed during production and another 1,000 to 10,000 workers exposed during their use in making finished plastic goods. In a press an- nouncement, EPA stated, "Because this action Is the first of its kind, we hope that cooperation from the manufacturer will set the tone for future cases." In the PMN, the company claimed its identity as con- fidential. Since then, the manufacturer has withdrawn his Premanufacture Notices. The six chemical substances are: Polymer of phthallc anhydride, ethylene glycol, heptanol, and 2-ethylhexanol; Polymer of phthallc anhydride, 1,2-propylene glycol, 1,4-butanedlol, 1-octanol, and 1-decanol; Polymer of phthallc anhydride, ethylene glycol, heptanol, 1-decanol, and 1-octanol; Polymer of phthallc anhydride, 1,2-propylene glycol, 1,4-butanedlol, and 2-ethylhexanol; Polymer of phthallc anhydride, 1,3-butylene glycol, 1-octanol, and 1-decanol; Polymar of phthallc anhydride, 1,3-butylene glycol, 2-ethylhexanol. IMMEDIATELY EFFECTIVE RULE... SECTION 0(d) Section 6 authorizes EPA to control chemicals as hazardous substances If It finds that the chemical will present an unreasonable risk of Injury to human health or the environment. Under Section 6(d) EPA may declare a rule proposed under Section 6(a) to be Immediately effective If EPA determines that the risk of serious or widespread Injury la likely to exist before a final rule can be promulgated. Upon request, EPA Is to commence an "expedited hearing" on the proposal within five days and Is to promulgate or revoke the rule within 10 days of the conclusion of the hearings. Upon promulgation, the rule is subject to judicial review (of. Sec 19). On March 11th, 1980, ERA published an immediately effective rule under Section 6(d) which prohibited Vertac, Inc. from disposing specific chemical wastes contaminated with 2,3,7,8-TCDD (Tetrachlor- odlbenzo-p-Dioxin) at its Jacksonville, Arkansas facility. The rule also required any person to notify EPA at least 60 days before he Intends to dispose of any wastes resulting from the production of 2,4,5-Trichlorophenol and/or Its pesticide derivatives or from the production of other substances on equip- ment previously used to produce 2,4,5-Trichloro- phenol and/or its pesticide derivatives (45 FR 15547). The immediately effective proposal was published at 45 FR 15592. On April 18, 1980, EPA published a notice on the expedited hearings and shortened com- ment periods (45 FR 26386). Testimony was taken on April 16 and May 1. On May 19th, EPA published the final rule (45 FR 32676). SUBSTANTIAL RISK... Additional tests are noted. REPORTING RULES PRELIMINARY ASSESSMENT INFORMATION... SECTION 8(a) Under Section 8(a) EPA may require manufacturers and processors to submit various kinds of Informa- tion on named chemicals. Such a rule only applies to Information already in their posssesslon. The Preliminary Assessment Information rule, proposed on February 29, 1980 (45 FR 13646), would require manufacturers of 2200 named chemicals to complete a summary 1-1/2 page form containing Information basic for determining broad estimates of exposure to the chemicals. With these reports In hand, EPA will expeditiously rank the chemicals according to actual exposure potential and select those which warrant further evaluation of risk. It Is expected that about 100 chemicals will fall Into this follow-up category. The comment period closed on May 14, 1980. On March 17, 1960, the Chemical Manufacturers Association (CMA) petitioned EPA to provide a more complete rationale for selecting each of the 2200 chemicals for Section 8(a) preliminary assessment reporting, to collect ail Information CMA believed relevant In a single location, and to extend the com- ment period. On April 28, 1980, EPA published its response which Included ctarlflcatione and further details on the groups of chemicals comprised In the list (45 FR 28172). Also In this notice are certain cor- rections to the list; other corrections were noted on April 16th (45 FR 26386). In denying the petition, EPA nonetheless took the opportunity to correct and clarify the record at this stage in the rule-making rather than wait until the final rule. EPA stated that the basis for the proposal, as reflected in Its rule- making record, was adequate for the specified pur- pose of enabling the Agency to select chemicals for preliminary assessment and for the immediate end of commenting on the list and the feasibility of reporting. EPA has published an easy-to-read listing of the chemicals with the rationale-source for each one. The majority of them met more than one criterion. THE TSCA INVENTORY ... SECTION 8(b) On October 22,1979 (44 FR 60763), EPA announced that persons who reported for the Chemical Substances Inventory need not keep records documenting their reports beyond January 1,1983. On April 18,1980 (45 FR 26452) EPA declared that as of May 19,1980, no more "late" reports for the Inven- tory would be accepted. After that date any chemical substance manufactured In the United States, and any substance imported in bulk, that has not been reported for the Inventory is subject to Section 5 of TSCA, Premanufacture Notification. Since July 1, 1979, when Premanufacture Notification went into ef- fect, EPA has received late submissions for substances that would have been eligible for the In- ventory had they been reported on tlme and has add- ed them to the Inventory. Many of these additions will appear In the cumulative supplement expected in the summer. The cutoff does hot apply to persons reporting for the Revised Inventory substances which they process or import as part of mixtures or articles for the first time after December 31,1979. 10 ------- STUDIES & SUPPORT ACTIVITY TSCA PUBLICATIONS SERIES On March 13, 1980, EPA announced that it would publish as a series the reports and studies made by scientists in the course of implementing TSCA. This will be called the "TSCA Chemical Assessment Series" and will comprise volumes on single or several chemicals, preliminary or in-depth studies, and compendia of information received and evaluated under TSCA. Persons may receive volumes either by subscribing to the entire series or by asking to be notified of each volume as it appears. In the lat- ter case, If Interested in a particular volume, the per- son would request it through lAO's toll-free telephone service. IAO will maintain the subscription and the notification lists for the series. The first two publications will appear soon and are (1) a compen- dium of the initial evaluations of substantial risk notices received under Section 8(e) from January 1, 1977 through June 30,1979 and (2) a compilation of "Chemical Hazard Information Profiles" (CHIPS) done between August, 1976 and August, 1978. CHEMICAL HAZARD INFORMATION PROFILES... (CHIPS) A "Chemical Hazard Information Profile" Ia prepared by the TSCA staff to screen the many candidates for Its consideration under TSCA. This ten-page profile consists of Information drawn from off-the-shelf reference sources and quick-access literature on pro- duction, exposure, use, health and environmental ef- fects. It tells how the subject came to EPA's atten- tion and the rationale for doing a profile plus EPA's disposition after reviewing the profile. In addition, a short bibliography Is appended. This document Is the first rung on the ladder of TSCA chemical risk assessment. The first compilation of CHIPS with 43 profiles will be published about June 1st. It may be obtained through signing up for the TSCA Chemical Assessment Series, as described above. It covers the period #976-1978. The following chemicals are included in this volume.
