EXECUTIVE SUMMARY
The Environmental Protection Agency, Region VIII, has completed the
first phase of a program to identify potential hazardous waste sites on
Indian lands which may be eligible for investigation or other response
actions under the Comprehensive Environmental Response, Compensation,
and Liability Act (CERCLA), or Superfund.
Under this initial phase, EPA conducted a site discovery effort that
has resulted in the identification of forty-one (41) potential hazardous
waste sites on Indian lands within Region VIII. These sites, and the
basis for their discovery, are described in this report.
Each site identified in this report has been entered into EPA's
Comprehensive Environmental Response, Compensation, and Liability
Information System (CERCLIS), a national data base of potential
hazardous waste sites. These 41 new sites, together with the 19 Indian
land sites previously included on CERCLIS, bring the total number of
potential hazardous waste sites on Indian lands within Region VIII to
60. These Indian land sites are among the over 30,000 sites on EPA's
CERCLIS inventory. Of these 30,000, approximately 1,200 are Superfund
National Priorities List (NPL) sites. None of the Indian land sites on
EPA's Region VIII CERCLIS inventory is a Superfund site.
Indian land sites previously listed on the CERCLIS inventory did not
arise as a result of any focused or systematic effort at discovering new
sites. The traditional site discovery mechanisms relied upon by EPA on
non-Indian lands (public awareness/reporting, state environmental
program files/data bases, state discovery programs) are not always
present or institutionalized on each reservation. As a result, EPA
believed it was necessary to conduct a deliberate search for potential
sites on Indian lands which may have gone unreported since the inception
of CERCLA.

As vith all other sites placed ori CERCLIS, the newly discovered
Indian lands sites will receive preliminary assessments (PA)s within one
year of their CERCLIS entry. These assessments will help EPA determine
whether the sites pose a threat to human health or the environment. As
a result of these PAs, further site characterization work (or emergency
response actions needed) will be scheduled. Sites determined not to
pose a significant threat to human health or the environment will be
designated "No Further Action" and no further site investigation work
will be conducted at them.
The site discoveries identified in this report occurred as a result
of a joint EPA-tribal effort at screening a wide range of possible sites
on each reservation. Critical to the success of this effort was the
early involvement and support of the Region VIII Indian Programs
Coordinator. Vith her guidance, a letter was prepared and sent to the
Tribal Chairperson of each Indian tribe within the region. The letter
(appended to this summary) announced EPA's broad program goals with
respect to site discovery and solicited tribal participation in the
activities being envisioned.
Region VIII contractors, Ecology and Environment, Inc., were
assigned the task of reviewing available information on already-known
hazardous waste problems on Indian lands. Site visits were then
scheduled for each reservation. The site visits were coordinated in
advance with each tribe's designated environmental contact person. The
Region VIII Indian Programs Coordinator facilitated communication among
EPA, contractor, and tribal staff throughout this process.
Upon completion of the site visits, a preliminary list of new
potential hazardous waste sites was developed and incorporated into a
draft report. This report was transmitted to each tribe and distributed
within EPA for review. Several helpful comments were received as a
result of this review and they have been incorporated into the final
report.

The Region VIII site discovery effort has laid the groundwork needed
to support both follovup investigations of the new sites plus a longer
term focus on addressing hazardous waste sites on Indian lands. EPA
procedures for responding to future site discoveries have been
introduced to the tribes and will be reinforced as preliminary
assessment work is conducted on each reservation. Additional outreach
efforts are also being planned by EPA.
With the completion of this initial site discovery phase, Indian
tribes within Region VIII have been brought into the mainstream of the
CERCLA site evaluation process. While there may well be additional
candidate sites on Indian land as yet undiscovered under the CERCLA
program, EPA believes this final report reflects those sites of most
apparent and current concern to the tribes. EPA Regional staff are
prepared to evaluate any additional potential hazardous wastes sites on
Indian lands for CERCLIS entry when and as they are brought to our
attention. In the meantime, a program is now in place to ensure the
Indian tribes of Region VIII full attention under the hazardous waste
response authorities of CERCLA.

1.0	INTRODUCTION
1.1	PURPOSE
This report is submitted to satisfy, in part, the requirements of
Technical Directive Document (TDD) F08-8809-10 issued to the Ecology and
Environment, Inc. Field Investigation Team (FIT) by the Region VIII U.S.
Environmental Protection Agency (EPA). This report provides a summary
of the CERCLA site discovery investigation performed by FIT on 24
federally-recognized Indian reservations assigned to the jurisdiction of
EPA Region VIII. These reservations are listed in Table 1 and their
locations shown in Figure 1. The following reservations or tribal
groups fall partly within Region VIII states, but are under the
jurisdiction of other EPA regional offices and thus were excluded from
the study at the request of EPA Region VIII: the Goshute Tribe and lands
in Utah, and the Navajo Tribe. The Northwestern Band of Shoshone Nation
was also not considered in this study. The Goshute Tribe comes under
the jurisdiction of EPA Region IX (San Francisco). The Navajo Tribe is
under the jurisdiction of Region VI (Dallas, Texas).
The purpose of this investigation was to conduct a CERCLA site
discovery program for Indian lands in Region VIII. The study provides a
detailed characterization of potential hazardous waste sites on 24
reservations and presents information sufficient to screen each
potential site for inclusion into the Superfund program or referral to
other EPA programs (e.g., RCRA). Sites identified through this
investigation have been referred to the Region VIII Superfund program
for entry into the Comprehensive Environmental Response, Compensation,
and Liability Information System (CERCLIS) and for appropriate
preremedial or emergency response follow-up. This study was carried out

with the participation of each tribe visited, as well as with the Bureau
of Indian Affairs (BIA), the Indian Health Service (IHS) and the EPA
Region VIII Montana Operations Office where appropriate.
This Region VIII site discovery effort was undertaken as a pilot
project at the request of the Office of Solid Waste and Emergency
Response (OSWER). The study was performed to meet, in part, EPA's
statutory responsibilities toward "Indian lands" as specified in section
126 of CERCLA as amended by the Superfund Amendments and Reauthorization
Act of 1986 (SARA). CERCLA, the Comprehensive Environmental Response,
Compensation and Liability Act, or Superfund, directs EPA to locate
abandoned industrial facilities and dumps which might release hazardous
wastes to the environment. Located sites are investigated by EPA or
other qualified authorities, including potentially the landowner, and
cleaned up so that the threat to humans and certain sensitive
environments no longer exists. EPA screens waste sites and conducts
investigations and cleanups on a "worst first" basis.
The report is presented in four sections: Section 1, Introduction;
Section 2, Methods; Section 3, Results; and Section A, Discussion and
Conclusions. The report includes appendices which contain CERCLIS data
entry forms for eligible sites, the Region VIII Vorkplan for conducting
this investigation, the meeting handout used to explain Superfund and
the study to tribal representatives and the letter report: "Indian Lands
Site Discovery Project, Phase I: Records Search."
1.2 PREVIOUS INVESTIGATIONS
Currently, there are 278 Federal Indian reservations in the United
States comprising an area of approximately 54 million acres, and with a
total population of 862,000 people. Half of these inhabitants are
native Americans (U.S. Environmental Protection Agency 1987). Several
nation-wide and one Region VIII EPA-led or funded studies have addressed
potential hazardous waste sites on Indian reservations. (In the Region
VIII case, the EPA RCRA program created a series of reports on tribal
solid waste facilities.) In 1985 the Council of Energy Resource Tribes

(CERT) prepared the EPA-funded report: "Inventory of Hazardous Waste
Generators and Sites on Selected Indian Reservations." This study
gathered information on hazardous waste sites and management practices
at 25 selected Indian reservations located near metropolitan areas
across the country. The report identified 1,196 hazardous waste sites
on, within a 25 mile radius, or in counties adjacent to the 25
reservations. Only 65 of the identified sites were located on
"reservation land" (CERT 1985). Four of the reservations surveyed in
the CERT study are included in the present investigation (Table 1).
Americans For Indian Opportunity (AIO) conducted a study in 1986
entitled: "Survey of American Indian Environmental Protection Needs on
Reservation Lands: 1986." This study provides data on environmental
protection needs for 48 reservations around the country. However,
information on hazardous waste sites is limited in comparison to the
CERT investigation (U.S. Environmental Protection Agency 1987).
In addition, a nationwide study by the Bureau of Indian Affairs
(BIA) has identified 34 potential hazardous waste sites on reservations.
The BIA performed 14 Preliminary Assessments (PAs) and three Site
Investigations (Sis) during fiscal year (FY) 1987. To date, 5 sites on
or near Indian lands have qualified for the National Priorities List
(NPL); however no NPL designations have been made on Indian lands in
Region VIII (U.S. Environmental Protection Agency 1987). Presently
CERCLIS lists 19 sites on Indian reservations in Region VIII (Table 2).
The table also indicates the status of EPA activity at the site based on
work done to date.
The FIT conducted a Phase I background document search and
interviewed Region VIII EPA, CERT, IHS and BIA personnel as the initial
step to determine potential CERCLIS additions on Indian lands in Region
VIII. This work was performed under TDD F08-8806-12 during June - July,
1988. The FIT identified 39 potential sites and reported these findings
in the letter report: "Indian Lands Site Discovery Project, Phase I:
Records Search," submitted to EPA on July 15, 1988. The present effort
was subsequently tasked under TDD F08-8809-10.

2.0	METHODS
2.1	APPROACH
The FIT utilized an EPA-developed Workplan to plan and direct field
activities and deliverables (Appendix B). The FIT inventoried potential
sites for inclusion in CERCLIS by visiting each of the 24 reservations
within Region VIII jurisdiction. These visits consisted of a formal
meeting with tribal and/or government health personnel designated by the
tribal chairperson for this task, and field visits to each site of
concern to the tribe. Meeting attendees and reservation contacts are
listed by reservation in Table 3. Visits to reservations were preceded
by both a letter from the EPA and telephone contact by the FIT to
apprise the tribe of the nature of the visit and to set up a meeting
with appropriate tribal members or staff. Throughout this planning
process the FIT was assisted by the Region VIII Indian Programs
Coordinator, Ms. Sadie Hoskie, and the Superfund Site Evaluation Section
Chief, Mr. David Schaller.
Field visits to reservations by FIT personnel were performed in
multiples; each trip consisted of visits to two to six reservations.
Initially field teams of two FIT members were used due to the large
number of sites anticipated at the larger reservations. A single FIT
member was used in cases where highly experienced personnel were
available and where the prospect of finding large numbers of sites was
minimal.
At each reservation, the FIT presented a general overview of the EPA
pre-remedial program strategy and discussed the general criteria used
for determining site eligibility under Superfund. FIT presented a
handout to meeting participants highlighting these aspects of the site
discovery effort (Appendix C). At each reservation the FIT solicited
information on all potentially eligible sites. In the case where tribal
representatives suggested that particular properties on their
reservation might be eligible, the FIT requested to visit each site.

site, visited the site to observe evidence of hazardous waste and noted
other eligibility features such as proximity to receptors (population,
wells in the vicinity, direct contact, surface water use and protected
habitat in the area of the site). Tribal representatives accompanied
FIT on most all visits to sites. Tribal representatives were often able
to provide supplemental historical information about sites.
When FIT encountered a site which was believed to have a potential
for emergency response action by EPA, the FIT staff was instructed to
immediately contact the EPA Project Officer. Although the FIT did not
identify any new sites for emergency response, the following three sites
are being investigated by the Emergency Response Branch: Evans Post and
Pole, Old Browning Sawmill and Chippewa Pole Treating.
The FIT applied the Region VIII Superfund Preremedial Program Site
Discovery Criteria to all sites visited. Sites are eligible for entry
into CERCLIS if the potential release of concern is not excluded from
federal response under CERCLA, and if both the severity of the release
and impacts on receptors is probable and sufficient. Table 4 outlines
the eligibility criteria used.
3.0	RESULTS
3.1	INTRODUCTION
This section provides a narrative of the findings for each site
considered for CERCLIS entry on 24 Indian reservations in Region VIII.
Table 5 accompanies this section and lists all sites which qualify for
CERCLIS. The number and type of all potential sites within each
reservation are discussed below. Sites found ineligible are named along
with the rationale for not recommending them for CERCLIS entry. In most
cases, sites are not pursued because there is no evidence that they are
sources of a potential hazardous waste release. If further information
about these ineligible sites comes to EPA's attention, the sites will be
reconsidered. Likewise, the eligible sites listed in Table 5 are
discussed with respect to those features which make them candidates for

I. The reviewer must ensure that the release of
concern is not excluded from receiving federal
response.
1.	Release Exclusions. CERCLA Section 101 defines
"release" and excludes four categories of events:
a.	exposure to persons solely within the
workplace;
b.	emissions from engine exhaust;
c.	release of nuclear materials subject to the
Atomic Energy Act;
d.	normal application of fertilizer.
2.	Response Limitations. CERCLA Section 104
precludes federal response in three types of
releases:
a.	Naturally occurring substances released
through naturally occurring processes;
b.	releases of products that are part of
residential buildings;
c.	releases into drinking water supplies due to
deterioration of the system through ordinary use.
3.	Policy Limitations. In addition to the statutory
exclusions, there are two EPA policy limitations
to be considered before entering new sites into
CERCLIS:
a. The Environmental Priorities Initiative (EPI)
calls for the screening of RCRA sites for
possible action under the CERCLA program. The
universe of treatment or storage facilities, or

closing land disposal facilities is open for
consideration by RCRA staff for referral to
CERCLIS. High priority RCRA permit sites are not
EPI candidates.
b. Solid waste landfills will be considered for
CERCLIS entry, however some discretion must be
applied when pursuing such sites, based on
whether known releases or disposal of industrial
hazardous waste can be documented. Sites without
such documentation will be held back from CERCLIS
entry.
II. Severity of the Release. The reviewer should make
a qualitative evaluation as to the severity of
the release by evaluating five factors:
1.	Waste Source. Consideration of the sources of
waste and methods of disposal would help in
evaluating migration pathways and persistence of
the release.
2.	Chemical Characteristics of the Release. The
reviewer must determine if the release is likely
to include hazardous substances or pollutants and
contaminants, as these terms are defined in
CERCLA Section 101.
3.	Time, Frequency, Amount of the Release. Together
with chemical characteristics, these factors
determine the severity of the release.
4.	Type of Evidence. The reviewer should evaluate
the strength of the evidence available to gauge
the overall certainty of the judgments made.

5. Receptors. The reviewer should evaluate the
distance from the waste source to the receptors
and estimate the quantity of impacted receptors.
The populations or resources to be considered
are: human, designated endangered animal species
and their habitats, croplands and recreational
areas.

inclusion into CERCLIS. Lastly, the interest which this site discovery
effort has generated among the Region VIII tribes is expected to result
in the identification of additional CERCLIS candidate sites in the
months ahead. The sites identified in this report should not,
therefore, be considered as representing the total universe of potential
hazardous waste sites on Indian lands. It should represent those that
were initially most obvious to the tribes and EPA.
3.2	COLORADO AREA TRIBES
The FIT made a site discovery visit to two reservations in Colorado,
the Southern Ute Indian Reservation and the Ute Mountain Indian
Reservation. The FIT visited the respective tribal landfills; however
little industry exists on these reservations and no hazardous waste was
reported or is believed to have been disposed of in the two landfills.
No sites in addition to those presently on CERCLIS were identified for
consideration at either reservation.
3.3	MONTANA AREA TRIBES
The FIT visited seven Indian reservations in Montana, the:
Blackfeet Indian Reservation, Crow Indian Reservation, Flathead Indian
Reservation, Fort Belknap Indian Reservation, Fort Peck Indian
Reservation, Northern Cheyenne Indian Reservation, and Rocky Boys Indian
Reservation.
The FIT identified at least one site at each of these reservations
for inclusion into CERCLIS.
3.3.1 Blackfeet Indian Reservation
The FIT considered eighteen potential sites on the Blackfeet
Reservation. Of these, four met the eligibility criteria and are listed
in Table 4; Evans Post and Pole, Fisher Flats Dump, Tucson Hebrew
Academy and the Old Browning Sawmill. The Sawmill and Evans Post and
Pole sites entail the potential release of pentachlorophenol and

possibly other organic chemicals. Pesticides have been disposed of at
the Fisher Flats Dump. The Tucson Hebrew Academy is a former Air Force
installation that may have released organic chemicals to ground water
and surface water. EPA's Montana Operations Office is also aware of a
potential asbestos problem at this site.
The remaining sites considered were not eligible because there was
no evidence that a hazardous waste was potentially present or released.
These sites are the: Blackfeet Pencil Company, Old Browning City
Landfill, existing Browning Landfill, Blackfoot Dump, and the following
unvisited landfills and area dumps: Two Medicine, Cut Bank Creek,
Blacktail, Whitetail, St. Marys Area, Babb Area, Del Bonita Area, Chalk
Butte Area, Birch Creek Area, and Squaw Flats Area. The latter sites
were not visited because tribal authorities did not feel that any of
them has received hazardous waste and because they were small facilities
not in the vicinity of industry.
3.3.2 Crow Indian Reservation
The FIT considered five potential sites on the Crow Indian
Reservation. Of these, only one site met the eligibility criteria and
is listed on Table 5: the Old Crow Agency Dump. This site is located on
an alluvial terrace above the town of Crow Agency and the Little Big
Horn River. It is eligible for CERCLIS primarily because the dump is
reported to have received waste chemicals, probably solvents and dyes,
from a nearby former carpet factory. The remaining four sites are not
eligible because they probably do not contain sources of CERCLA
contaminants. These sites are the: Old Pryor and St. Xavier Gas
Stations, Pryor Landfill and the Old Lodgegrass Dump. However,
information on the two gas stations has been forwarded to the Region
VIII Underground Storage Tank program for its consideration. Also, the
Old Lodgegrass Dump, a relatively large dump, is situated in coarse
alluvial material near ground water wells and may pose an environmental
threat to Lodgegrass. However, no information was available on disposal
of industrial or hazardous waste in this landfill, thus it was not
considered for CERCLIS entry.

3.3.3	Flathead Indian Reservation
The FIT considered 25 sites on the Flathead Indian Reservation. Of
these, eight are listed in Table 5 for inclusion in CERCLIS. These are
the: Agency Dump, Dixon/Perma Dump, Flathead Mine Area, Midway Store
Dump, Old Arlee Dump, Old Charlo Dump, Old Community Dump, and the
Revais Creek. Mine. These sites are eligible primarily because hazardous
waste may have been disposed in them, or potentially released from them,
and they are in proximity to human receptors or sensitive environments.
These ten sites concern the following hazardous materials: Agency Dump,
pentachlorophenol; Dixon/Perma Dump, pesticides, acid, and organic
chemicals; Flathead Mine Area, lead; Midway Store Dump, pesticides,
organic chemicals; Old Arlee Dump, industrial waste; Old Charlo Dump,
pesticides; Old Community Dump, organic chemicals; and the Revais Creek.
Mine, heavy metals.
The remaining 17 sites are not eligible because there were no
indications that any of them may have contained or released hazardous
waste. These sites were the: PowWow Dump, Old PowWow Dump, Dixon Scrap
Yard, North Crow Reservoir, Upper Post Creek Dump, Kicking Horse Job
Corp Site, Old Ronan Dump, Blue Boy Dump, Mill Soil Dump, Pablo Power
Plant, Old Gravel Pit Dump, Old Airport Dump, Pioneer Auto, Poison Power
Service Area, Old Poison Landfill, Old Elmo Dump and the Old Lodgepole
Dump. Of these, several were referred to other EPA programs. The Pablo
Power Plant and Blue Boy Dump were referred to the Toxic Substances
Control Act (TSCA) program for a possible PCB inspection; and the North
Crow Reservoir to the Federal Insecticide, Fungicide and Rodenticide Act
(FIFRA) program because of possible agricultural pesticide runoff
problems.
3.3.4	Fort Belknap Indian Reservation
The FIT considered ten sites on the Fort Belknap Indian Reservation.
Of these, two are listed in Table 5 for inclusion in CERCLIS. These
are: the Old Agency Landfill and the Zortman Mine. These sites are
eligible primarily because hazardous wastes may have been disposed in

them, or potentially released from them; and the sites are in close
proximity to human receptors or sensitive environments. The Old Agency
Landfill is eligible because it may contain PCBs and pesticides which
may have been disposed improperly and potentially released to the
environment. The Zortman Mine is releasing tailings into Peoples Creek
which flows onto the reservation. These tailings are from an active
gold mine, and may be releasing significant loads of heavy metals and
possibly process chemicals such as cyanide to surface water and the
alluvial aquifer.
The remaining eight sites are not eligible for CERCLIS because there
is no evidence that they contain, nor are suspected of releasing,
hazardous waste. These are the: East Hays Sawmill, Hays Townsite
Sawmill, Wilson Park Sawmill, Old Agency Lagoon Landfill, Existing
Agency Landfill, Hays Landfill, Lodgepole Landfill, and the Snake Butte
Turnoff Landfill. None of these remaining sites was referred to other
Region VIII programs.
3.3.5 Fort Peck Indian Reservation
The FIT considered five sites on the Fort Peck Indian Reservation.
Of these, three are listed in Table 5 for inclusion in CERCLIS. They
are the: Old Poplar Landfill, A & S Industries, and the Oswego Landfill.
These sites are eligible primarily because they are potential sources of
hazardous waste, and they are in close proximity to human receptors or
sensitive environments. The Old Poplar Landfill contains empty drums of
industrial waste; A & S Industries uses and disposes of a variety of
organic chemicals and paints. The Oswego Landfill may contain
pesticides, paint solvents and tar containers improperly or not
contained.
The remaining two sites are the Kenco Jet Fuel Plant and an old gas
station in Poplar. The Kenco site was previously investigated by
Superfund. The Old Poplar Gas Station site has been referred to the
Region VIII Underground Storage Tank program.

3.3.6	Northern Cheyenne Indian Reservation
The FIT considered nine sites on the Northern Cheyenne Indian
Reservation. Of these, four are listed in Table 5 as eligible for
CERCLIS. They are the: CCC Camp at Busby, Dull Knife College Drums, Old
Lame Deer Dump and the St. Labre Plastics Factory. These sites are
eligible primarily because they may contain hazardous waste which may be
released to the environment, and because of their proximity to human
receptors or sensitive environments. The CCC Camp site south of Busby
contains buried arsenic used to poison grasshoppers. The Dull Knife
College drum site consists of a group of 55-gallon drums containing
unknown liquids located at the Dull Knife education complex in Lame
Deer. The Old Lame Deer Dump site is a closed municipal dump which may
contain paint solvent containers. Finally, the St. Labre Plastic Factory
in Ashland is reported to have a lagoon used to dispose of solvents and
dyes. However the FIT was unable to locate this site precisely, because
tribal representatives were unable to accompany the field team.
The remaining five sites are not eligible for CERCLIS because there
is no evidence that they contain hazardous waste. These include the
Soldier Gulch Mine reclamation, the abandoned gas station in Lame Deer,
the Old Busby Landfill, the existing Lame Deer Landfill and the Katie
Cafe Gas Station in Lame Deer. The two gas stations have been referred
to the Region VIII Underground Storage Tank program.
3.3.7	Rocky Boys Indian Reservation
The FIT considered six sites on the Rocky Boys Indian Reservation.
Only one site, the Chippewa Pole Treating site was eligible for CERCLIS.
This site has released dioxins and polycyclic aromatic hydrocarbons to
the soil, ground water and possibly surface water (Ecology and
Environment, Inc. 1987).
Five sites were not eligible for CERCLIS because there was no
evidence that they contained or released hazardous waste. These sites
are the: Abandoned Tribal Complex Gas Station, Ravine Dump, Sangrey

School Dump, Ceremonial Ground Dump and the Box Elder Dump. The Tribal
Complex Gas Station has been referred to the Region VIII Underground
Storage program.
3.4 NORTH DAKOTA AREA TRIBES
The FIT visited five reservations in the state of North Dakota:
Fort Berthold Indian Reservation, Fort Totten Indian Reservation,
Sisseton Indian Reservation, Standing Rock Indian Reservation and the
Turtle Mountain Indian Reservation.
The FIT found at least one site eligible for CERCLIS on each of
these reservations with the exception of the Sisseton Indian
Reservation.
3.4.1	Fort Berthold Indian Reservation
The FIT considered eight sites on the Fort Berthold Indian
Reservation. Two of these sites, the Newtown and Parshall landfills are
eligible for CERCLIS and listed on Table 5. These sites are eligible
primarily because they may contain hazardous waste which may be released
to the environment. The Newtown Landfill is alleged to have received
pesticide waste and the Parshall Landfill may have received hazardous
waste including pesticide from the clean up of the Raub site, the
location of an EPA emergency response action.
Six other sites are not eligible for CERCLIS because there is no
evidence that they contain hazardous waste. These sites are the:
Northrup Manufacturing Plant, Raub Site, Hidatco, Inc., and the Twin
Buttes and White Shield Dump sites.
3.4.2	Fort Totten Indian Reservation
The FIT considered four sites on the Fort Totten Indian Reservation.
Three of these sites are eligible for CERCLIS. They are the: Fort

Landfill. These sites are eligible because they may contain hazardous
waste which may be released to the environment. The Fort Totten
Landfill has received industrial solvents including toluene, hexane and
methyl ethyl ketone from surrounding industries. The Devils Lake
Manufacturing Plant may have been a contributor of solvents to the Fort
Totten Landfill and may have contributed contaminants to the environment
through spills at the facility. Similarly, the Old Fort Totten Landfill
is alleged to have received solvents from two local manufacturing
plants.
The remaining site is a leaking underground tank in Warwick. This
site is not eligible for CERCLIS because it contains a petroleum product
likely exempt from CERCLA response action. However, this site has been
forwarded to the EPA Region VIII Underground Storage Tank program.
3.4.3	Sisseton Indian Reservation
The Sisseton Indian Reservation has land holdings in both North and
South Dakota. The FIT found no sites eligible and no sites to be
considered at this reservation.
3.4.4	Standing Rock Indian Reservation
The FIT considered seven sites for CERCLIS inclusion on the Standing
Rock Indian Reservation. Of these only one, the Fort Yates Landfill,
satisfied the primary criteria for eligibility of potentially containing
hazardous waste which has or could be released to the environment. The
landfill, known to contain pesticides, is located near the Missouri
River, which is an important regional municipal water source. Wastes at
the site are burned periodically and are in proximity to the community
of Fort Yates.
The other six sites are not eligible because there is no evidence
that they contain hazardous waste. These are the: Porcupine, Kennel,
Bullhead, Little Eagle, and Wakapala landfills.

3.4.5 Turtle Mountain Indian Reservation
The FIT considered four sites on the Turtle Mountain Indian
Reservation. Two of these are eligible for CERCLIS: Turtle Mountain
Landfill and Turtle Mountain Manufacturing. These sites are eligible
because they may contain hazardous waste which may release to the
environment. The Turtle Mountain Landfill has received paint solvents
and pesticides. The Turtle Mountain Manufacturing Plant utilizes an
unlined lagoon and incinerator to dispose of solvents. Municipal wells
are located within 1.5 miles of this waste lagoon and may be affected.
The remaining sites are not eligible because there is no evidence
that they contain hazardous waste or meet other CERCLIS eligibility
criteria. These sites are specifically excluded from CERCLIS
consideration; (Table 3 contains eligibility criteria). These sites are
the grasshopper spraying area(s) and nonpoint source pesticides in
ground water. However, both of these issues have been forwarded to the
Region VIII Indian Programs Coordinator.
3.5 SOUTH DAKOTA AREA TRIBES
The FIT visited seven Indian reservations in South Dakota: Cheyenne
River Indian Reservation, Crow Creek Indian Reservation, Flandreau
Indian Reservation, Lower Brule Indian Reservation, Pine Ridge Indian
Reservation, Rosebud Indian Reservation and the Yankton Indian
Reservation.
The FIT found CERCLIS eligible sites at five of these reservations.
No CERCLIS-eligible sites were found on the Crow Creek, Flandreau and
Lower Brule Indian reservations.
3.5.1 Cheyenne River Indian Reservation
The FIT considered seven sites on the Cheyenne River Indian
Reservation. Of the seven sites only the Eagle Butte Drum Removal Site
is eligible for CERCLIS. This site is eligible because it is a source

for potential release of pesticides to the environment and may yet
contain contaminants even though the primary source is planned for
removal. The remaining six sites are not eligible because there is no
evidence that they contain CERCLA hazardous waste. These sites are the:
Eagle Butte Fuel Spill Site, Cherry Creek. Landfill, Bridger Landfill,
LaPlant Landfill, White House Landfill, and the Blackfoot Landfill.
3.5.2	Crov Creek. Indian Reservation
The FIT found no sites for consideration on the Crow Creek Indian
Reservation.
3.5.3	Flandreau Indian Reservation
The FIT found no sites for consideration on the Flandreau Indian
Reservation.
3.5.4	Lower Brule Indian Reservation
The FIT found no sites for consideration on the Lower Brule Indian
Reservation.
3.5.5	Pine Ridge Indian Reservation
The FIT considered six sites on the Pine Ridge Indian Reservation.
Of these four are listed in Table 5 for inclusion in CERCLIS. These
sites are the: Bus Storage Site, Cuny Cafe Trailer, Maurice Twiss Lease
Site and the Porcupine Fish Bait Site. These sites are eligible because
they may contain hazardous waste which may release to the environment,
and because they are in proximity to human receptors or sensitive
environments. Three of these sites, the Bus Storage Site, Cuny Cafe
Trailer and the Maurice Twiss Lease Site involve a combined four tons of
the rodenticide, zinc phosphide. This poison was abandoned at three
locations by a BIA contractor. The Porcupine Fish Bait Site
was an EPA emergency response site involving abandoned organic

chemicals. This site could contain other sources or residual
contamination.
The two sites not eligible for CERCLIS are the Pine Ridge Landfill
and the Ogalala Dump. Neither site was suspected of containing
hazardous waste.
3.5.6	Rosebud Indian Reservation
The FIT considered four sites for CERCLIS on the Rosebud Indian
Reservation. Only one site, the Antelope PCB Spill Site, met the
criteria that hazardous waste was being released or had the potential to
be released, and is listed on Table 5. The other sites did not meet
this definition and were not eligible. These sites were the: Mission
Hydrocarbon Plume, Mission Lagoons and the Rosebud Dump. The tribal
Water Resources Director also expressed concern over the effects of
center-pivot irrigation and radon gas. These concerns were relayed to
the Region VIII Indian Programs Coordinator. The Mission Hydrocarbon
Plume has been under investigation by the State of South Dakota.
3.5.7	Yankton Indian Reservation
The FIT considered three sites on the Yankton	Indian Reservation.
All three sites were found eligible for CERCLIS.	These are the:
Greenwood Dump, Lake Andes Dump and Wagner Dump.	All three sites
may contain pesticides which could be released to	nearby human receptors
or sensitive environments.
3.6 UTAH AREA TRIBES
The FIT visited two Indian reservations in the State of Utah: the
Paiute Indian Reservation and the Uintah and Ouray Indian Reservation.

3.6.1	Paiute Indian Reservation
The FIT found no sites for consideration on the Paiute Indian
Reservation.
3.6.2	Uintah and Ouray Indian Reservation
The FIT considered two sites on the Uintah and Ouray Indian
Reservation. One site, the Fort Duchesne Pole Treating Facility is
eligible for CERCLIS. It may contain hazardous waste which may be
released to surrounding human receptors or sensitive environments. The
site consists of a 50 gallon pole treating vat containing wood treating
chemicals. The Fort Duchesne Landfill does not contain hazardous waste
from industrial sources and therefore is not eligible for CERCLIS.
3.7 WYOMING AREA TRIBES
3.7.1 Wind River Indian Reservation
The Wind River Indian Reservation is the only recognized reservation
in the State of Wyoming. The FIT considered 20 sites on the Wind River
Indian Reservation. None of these sites were eligible for CERCLIS,
primarily because there was no evidence identified that they contain, or
have released, hazardous waste to the environment. These sites are the:
Louisiana Pacific Pole Treating Facility, Riverton Concrete Products,
Tannery, Inc. and the following tribal landfills or dumps: Johnstown Big
Wind River Disposal Site, Crowheart Burris Disposal Site, Shoyo Lane
Disposal Site, Mexican Flat Disposal Site, Ethete Disposal Site,
Arapahoe 17 Mile Road Disposal Site, Arapahoe South Disposal Site, Mill
Creek/Boulder Flat Disposal Site, Armejo Disposal Site, BIA Disposal
Site, Sage Creek Disposal Site, St. Michael Hill Disposal Site, Riverton
Valley Disposal Site No. 1 and No. 2, St. Stephens/Sand Draw Disposal
Site, Thunder Lane Disposal Site, and the Mule Butte Disposal Site.

4.0 DISCUSSION AND CONCLUSION
As a result of visits to 24 federally-designated Indian reservations
located in Region VIII states, the FIT identified 41 sites containing or
alleged to contain hazardous waste which has a potential to be released
to the environment. This study reports those sites for inclusion in the
CERCLIS data base. Once sites are included in CERCLIS they are eligible
for investigation under the Superfund preremedial program. Under this
program, EPA will determine whether a hazardous waste source exists at
the site and, if so, whether it is releasing contaminants to the air,
surface water and ground water.
Of the 24 reservations visited, 16 had sites eligible for CERCLIS.
These reservations and their eligible sites are listed in Table 5.
CERCLIS data entry forms for each eligible site are grouped by
reservation in Appendix A. The 41 CERCLIS eligible sites are
distributed among the 16 reservations as follows: Blackfeet Indian
Reservation, four sites; Crow Indian Reservation, one site; Flathead
Indian Reservation, eight sites; Fort Belknap Indian Reservation, two
sites, Fort Peck Indian Reservation, three sites; Northern Cheyenne
Indian Reservation, four sites; Rocky Boys Indian Reservation, one site;
Fort Berthold Indian Reservation, two sites; Fort Totten Indian
Reservation, three sites; Turtle Mountain Indian Reservation, two sites;
Cheyenne River Indian Reservation, one site; Pine Ridge Indian
Reservation, four sites; Rosebud Indian Reservation, one site; Standing
Rock Indian Reservation, one site; Yankton Indian Reservation, three
sites; and the Uintah and Ouray Indian Reservation, one site.
A breakdown by state shows that the Colorado area reservations have
no new eligible sites; the Montana area, 23 sites; the North Dakota
area, eight sites, the South Dakota area, nine sites, the Utah area, one
site and the Wyoming area, no sites. Adding these newly discovered
sites to the current list of Indian Land sites (Table 2) by state area
brings the current total for Region VIII to 60. Current total CERCLIS
entries by state area are: the Colorado area, one; the Montana area,

30; the North Dakota area, eight; the South Dakota area, 10; the Utah
area, seven; and the Wyoming area, four.
The types of sites nominated for CERCLIS fall into eight categories,
listed here with the number of sites in each category and the percentage
of the whole which that number represents (Figure 2): Dumps/landfills,
21 sites (50 percent); pesticide disposal, five sites (11.9 percent);
wood treating sites and manufacturing sites, four sites each (9.5
percent); mining sites and drum storage sites, three sites each (7.1
percent); PCB sites and defense facilities, one site each (2.3 percent).

CERCLA Site Discovery Program
for Indian Lands
INTRODUCTION
EPA has initiated a CERCLA Site Discovery Program for
Indian lands in Region VIII. This initiative is to be carried
out with the full participation of each affected Indian tribe in
the Region and is intended to result in a more accurate
characterization of the universe of potential hazardous waste
sites on tribal lands. Potential hazardous waste sites
identified through this effort will be referred to the Region
VIII Superfund remedial or removal programs as appropriate for
followup action.
In coordination with the Region VIII Indian Programs
Coordinator, the Region VIII Superfund program contacted the
Tribal Chairpersons of each Federally-recognized Indian tribe in
Region VIII and invited their suggestions on how best a site
discovery program could be structured. Following an initial
response from some tribes, this workplan was developed.
The approach to be followed in the conduct of the Region
VIII CERCLA site discovery program on tribal lands is as follows:
1 . One or more teams of technical staff from Ecology and
Environment, EPA's preremedial Superfund support contractor in
Region VIII, will contact designated tribal representatives to
schedule field visits to each reservation. The assistance of
EPA's Indian Programs Coordinator will be sought, as needed, in
the establishment of these contacts. The field visits will be
conducted in such a manner as to make efficient use of FIT and
tribal resources.
2. Upon meeting with the designated tribal
representative(s), the FIT team will present a general overview
of the EPA preremedial program strategy. The FIT team will also
relate to the tribal representatives the general criteria used in
determining site eligibility for CERCLA response. The Region
VIII site discovery protocol/criteria will be used as the
standard against which potential reservation sites are evaluated
for CERCLIS eligibility. The FIT teams shall spend sufficient

time with each tribal representative to ensure that the above
criteria are clearly understood and the limits of the discovery
program appreciated to the extent possible.
Then, using information developed under an earlier TDD (F08-
8806-12), the FIT field teams will review data currently on hand
as to potential hazardous waste sites on each reservation
visited. Information will be solicited on all potentially
eligible sites, including those already identified, with site
visits being arranged with tribal representatives wherever
possible. The FIT shall also seek out and incorporate the
results of a survey of solid waste landfills on Indian lands,
conducted by EPA in 1982. A point of contact is Mr. Jerry Allen
in the RCRA program. These results were not included in the
earlier FIT records search report.
3.	The FIT teams shall also contact other knowledgeable
individuals or organizations with a presence on the reservations
visited. These could include the Bureau of Indian Affairs, the
Indian Health Service, any other Federal agency department or
bureau, any private sector organization or individual with
specialized knowledge of hazardous or solid waste disposal,
handling, transport, or generation.
4.	Throughout the course of the site discovery process, the
FIT teams shall seek information and report on any potential
candidate sites for emergency response action by EPA. The FIT
teams shall use the attached criteria for removal response in
considering candidates for EPA emergency action.
5.	Upon- determination that a site on Indian lands is a
candidate for CERCLIS entry, the FIT team shall prepare a draft
site discovery data entry form (attached) for submittal to the
Region VIII preremedial program manager. At the conclusion of
the field visits, FIT shall submit the completed draft data entry
forms as part of its final report.
6.	The FIT team shall coordinate with EPA's Montana
Operations Office in the course of discovery work at reservations
over which that office has jurisdiction.
DELIVERABLES
1. The initial deliverable will be an interim response that
identifies any candidate sites, for emergency response
consideration (non-time critical) as well as any sites which are
clearly candidates for preliminary assessments upon site entry
onto CERCLIS. In addition, this interim response shall identify
any information or training needs requested by tribal
representatives in the course of the field visits.

2. The major deliverable under this TDD shall be a report
which presents and summarizes the information gathered in the
course of the field visits to each Indian reservation in EPA
Region VIII. This report will be made available by EPA in both
draft and final form to the tribes included in the site discovery
effort. The report shall include the following:
a.	A breakdown, by reservation, of the number and types of
potential hazardous waste sites identified.
b.	A preliminary determination as to the CERCLA eligibility
of each site identified in (a) above'.
c.	The date, time, and other particulars of each visit made
to an Indian reservation in Region VIII, including names and
organizational affiliations of all individuals contacted.
d.	For each site identified in (a) above, the FIT shall
submit a draft CERCLIS data entry form, noting in the "comments"
section any concerns as to the potential eligibility of the site
for being addressed under CERLCA (using the Region VIII site
discovery protocol previously identified). To the extent that
other EPA authorities are applicable at a site, the report shall
identify these for referral to other Region VIII program offices.
TIMEFRAME AND MILESTONES
An interim response shall be provided within 10 days of the
completion of each set of field visits undertaken.
A draft final report shall be submitted by December 15,
1988, or within 15 working days of the completion of the last set
of field visits made, whichever is earlier.
Ten copies of a final report shall be submitted within 10
working days of receipt of EPA comments on the draft final
report. (Note: EPA's response to the draft final report will
incorporate comments, if any, from each of the tribes in Region
VIII. )
Finally, if questions arise in the course of any of the
field work, the FIT team leader(s) shall immediately contact
either David Schaller, Chief, Site Evaluation Section (293-2518)
or Sadie Hoskie, Indian Programs Coordinator (293-1439), for
guidance on how to proceed.

REGION VIII CERCLIS PROTOCOL
SITE DISCOVERY
Potential CERCLIS site discovery information generally comes from one
of four major sources:
o EPA Regional Office (Superfund and non-Superfund staff)
o State Superfund Office
o EPA Field Investigation Team
o the Public
Information on a potential CERCLIS site is compiled on a Site Discovery
Form by either EPA or State Superfund staff. Site Discovery Forms are
reviewed by the designated EPA Superfund pre-remedial staff person for the
State in which the candidate site is located. This review is based on Site
Discovery/CERCLIS Entry criteria developed by the EPA Region VIII Superfund
program.
If the site meets the CERCLIS entry criteria, the Site Discovery Form
is submitted by the EPA project manager (thru the Site Evaluation Section
Chief) to the Chief of the Superfund Management Office. The Chief of the
Superfund Management Office then instructs the CERCLIS Data Base Administrator
to enter the site as a new entry on the CERCLIS regional inventory. Once
CERCLIS entry has occurred, EPA and/or State may proceed with CERCLA-funded
pre-remedial work at the site.

EPA REGION VIII SUPERFUND PREREMEDIAL PROGRAM SITE DISCOVERY CRITERIA
The purpose of this document is to establish the criteria to be applied
by EPA and State personnel when evaluating potential site discoveries
under CERCLA. Sites which meet these criteria are then eligible for
entry onto CERCLIS, the Region's inventory of potential hazardous waste
sites eligible for consideration under CERCLA/SARA.
The first section addresses whether the release of concern at a potential
site is eligible to receive remedial response attention under CERCLA/SARA, as
there are several statutory and policy limitations to such response. The other
section relates to the severity of the release and impacts on target (or
receptor) populations. The criteria outlined in this second section are adapted
largely from the Superfund Program's existing Hazard Ranking System; they are •
so used in the presumption that all CERCLIS sites may eventually be ranked.
The criteria for proceeding from the PA stage to Site Inspection (both screening
and listing) stage will be spelled out in a followup document.
Given that the information available at the time of site discovery is of
a limited nature, reviewers can at best make only qualitative evaluations and
arrive at educated judgments as to the likely severity of the potential
release. The reviewer should use the criteria outlined below to help
formulate a qualitative evaluation and to locate the areas of uncertainty.
Eligibility for Federal Response Under CERCLA
I. The reviewer must ensure that the release of concern is not excluded
from receiving federal response.
1.	Release exclusions. CERCLA Section 101 defines "release" and
excludes four categories of events:
a.	exposure to persons solely within the workplace;
b.	emissions from engine exhaust;
c.	release of nuclear materials subject to the Atomic Energy Act
d.	normal application of fertilizer.
2.	Response limitations. CERCLA Section 104 precludes federal
response in three types of releases:
a.	Naturally occurring substances released through naturally
occuring processes:
b.	releases of products that are part of residential buildings;
c.	releases into drinking water supplies due to deterioration
of the system through ordinary use.
3.	Policy limitations. In addition to the statutory exclusions,
there are two EPA policy limitations to be considered before
entering new sites on CERCLIS:
a. The Environmental Priorities Initiative (EPI) calls for the
screening of RCRA sites for possible action under the
CERCLA program. The universe of treatment or storage
facilities, or closing land disposal facilities is open
for consideration by RCRA staff for referral to CERCLIS.
High priority RCRA permit sites are not EPI candidates.

b. Solid waste landfills will be considered for CERCLIS
entry, however some discretion must be applied
when pursuing such sites, based on whether
known releases or disposal of industrial hazardous
waste can be documented. Sites without such
documentation will be held back from CERCLIS entry.
II. Severity of the release. The reviewer should make a qualitative
evaluation as to the severity of the release by evaluating five
factors:
1.	Waste source. Consideration of the sources of waste and
methods of disposal would help in evaluating migration
pathways and persistence of the release.
2.	Chemical characteristics of the release. The reviewer
must determine if the release is likely to include
hazardous substances or pollutants and contaminants,
as these terms are defined in CERCLA Section 101.
3.	Time, Frequency, Amount of the release. Together with
chemical characteristics, these factors determine the
severity of the release.
4.	Type of evidence. The reviewer should evaluate the
strength of the evidence available to gauge the overall
certainty of the judgements made.
5.	Receptors. The reviewer should evaluate the distance from
the waste source to the receptors and estimate the quantity
of impacted receptors. The populations or resources to be
considered are: human, designated endangered animal species
and their habitats, croplands and recreational areas.
While on a case-by-case basis certain exceptions can be considered with
respect to "severity of release" and "policy limitations," the above
criteria are intended to be applied consistently when considering site

EPA REGION VIII SUPERFUND PREREMEDIAL PROGRAM SITE DISCOVERY CRITERIA
The purpose of this document is to establish the criteria to be applied
Dy EPA and State personnel when evaluating potential site discoveries
under CERCLA. Sites which meet these criteria are then eligible for
entry onto CERCLIS, the Region's inventory of potential hazardous waste
sites eligible for consideration under CERCLA/SARA.
The first section addresses whether the release of concern at a potential
site is eligible to receive remedial response attention under CERCLA/SARA. as
there are several statutory and policy limitations to such response. The other
section relates to the severity of the release and impacts on target (or
receptor) populations. The criteria outlined in this second section are adapted
largely from the Superfund Program's existing Hazard Ranking System; they are
so used in the presumption that all CERCLIS sites may eventually be ranked.
The criteria for proceeding from the PA stage to Site Inspection (both screening
and listing) stage will be spelled out in a followup document.
Given that the information available at the time of site discovery is of
a limited nature, reviewers can at best make only qualitative evaluations and
arrive at educated judgments as to the likely severity of the potential
release. The reviewer should use the criteria outlined below to help
formulate a qualitative evaluation and to locate the areas of uncertainty.
Eligibility for Federal Response Under CERCLA
I. The reviewer must ensure that the release of concern is not excluded
from receiving federal response.
1.	Release exclusions. CERCLA Section 101 defines "release" and
excludes four categories of events:
a.	exposure to persons solely within the workplace;
b.	emissions from engine exhaust;
c.	release of nuclear materials subject to the Atomic Energy Act;
do normal application of fertilizer.
2.	Response limitations. CERCLA Section 104 precludes federal
response in three types of releases:
a.	Naturally occurring substances released through naturally
occuring processes:
b.	releases of products that are part of residential buildings;
c.	releases into drinking water supplies due to deterioration
of the system through ordinary use.
3.	Policy limitations. In addition to the statutory exclusions,
there are two EPA policy limitations to be considered before
entering new sites on CERCLIS:
a. The Environmental Priorities Initiative (EPI) calls for the
screening of RCRA sites for possible action under the
CERCLA program. The universe of treatment or storage
facilities, or closing land disposal facilities is open
for consideration by RCRA staff for referral to CERCLIS.
High priority RCRA permit sites are not EPI candidates.

b. Solid waste landfills will be considered for CERCLIS
entry, however some discretion must be applied
when pursuing such sites, based on whether
known releases or disposal of industrial hazardous
waste can be documented. Sites without such
documentation will be held back from CERCLLS entry.
II. Severity of the release. The reviewer should make a qualitative
evaluation as to the severity of the release by evaluating five
factors:
1.	Waste source. Consideration of the sources of waste and
methods of disposal would help in evaluating migration
pathways and persistence of the release.
2.	Chemical characteristics of the release. The reviewer
must determine if the release is likely to include
hazardous substances or pollutants and contaminants,
as these terms are defined in CERCLA Section 101.
3.	Time, Frequency, Amount of the release. Together with
chemical characteristics, these factors determine the
severity of the release.
4.	Type of evidence. The reviewer should evaluate the
strength of the evidence available to gauge the overall
certainty of the judgements made.
5.	Receptors. The reviewer should evaluate the distance from
the waste source to the receptors and estimate the quantity
of impacted receptors. The populations or resources to be
considered are: human, designated endangered animal species
and their habitats, croplands and recreational areas.
While on a case-by-case basis certain exceptions can be considered with
respect to "severity of release" and "policy limitations," the above
criteria are intended to be applied consistently when considering site
additions to CERCLIS. EPA and State staffs working in the CERCLA
preremedial program should become familiar with these criteria and begin
applying them to all existing and future CERCLIS candidates.

I. INTRODUCTION
Under the direction of Technical Directive Document F08-8806-12 the
Region VIII Environmental Protection Agency(EPA) tasked the Ecology and
Environment Field Investigation Team (FIT) to initiate a background
documentation search for information pertaining to potential CERCLIS
site additions for the twenty-six Indian reservations located in Region
VIII.
This task is Phase I of the two-phase Indian Lands Project; Phase II
will entail field visits to the Region VIII reservations by FIT
personnel to verify suspected sites and to discover, through visual
observations and communication with the appropriate tribal contacts,
sites suitable for site discovery and inclusion in CERCLIS.
Initial contact with respective tribal officials will be performed
by the EPA through use of a form letter followed by telephone inquiries.

This should prove to be the most effective and efficient means of
creating rapport with the tribes, and gathering information on potential
discoveries and focusing all participants on site discovery.
This Phase I report includes the results of a document/file search
of existing reports and data bases that pertain to hazardous waste on
Indian Lands. In addition to file and data base sources the FIT was
also tasked to interview various state or Federal agencies in order to
obtain information on undocumented instances of hazardous waste spills,
storage, disposal, treatment or exposure.
II. METHODOLOGY
The FIT information search was generally conducted by
making telephone inquiries to representatives of various government
agencies. The most pervasive problem encountered by FIT during Phase I
was the lack of organized information dealing with hazardous materials
on Indian Lands. The results of this information gathering effort are
included in Table 1 which contains a listing of the sites, their
location by reservation, alleged problem or hazard, county in which the
reservation lies and the source of information. Sites already contained
in CERCLIS are not included because the goal of the project is to
nominate new sites for inclusion in the Superfund data base and not to
account for presently recognized sites. However, a list of current
CERCLIS sites located on or near Indian Lands has been provided in Table
2.
Some additional information was acquired by FIT during a June 21-
23, 1988 public meeting for Indian governments held in Billings,
Montana. During the course of this meeting the FIT had the opportunity
to converse withr representatives from the Northern Cheyenne, Pineridge,
Crow and Fort Peck Reservations. These conversations provided FIT with
information on specific hazardous material occurrences on their
respective reservations. The information gathered from these
conversations has been included in Table 1. Additional conversations
were held with Bureau of Indian Affairs representatives at the Billings
office. These officials helped to identify potential Superfund sites
for reservations located in Montana and Wyoming. This information is

also included in Table 1. In sum, the June 21-23 meeting (which
included a field trip to the Crov and Northern Cheyenne Reservations
with Regional, Headquarters, State and Tribal staff) was highly relevant
and assisted the project by familiarizing FIT with Native Americans and
Indian Land environmental concerns.
It should be noted that the information included in Table 1 is
surely incomplete. The FIT has made additional inquiries to various
regional government offices and will be receiving additional information
in the near future. Table 1 will be continuously updated to reflect new
information and submitted to EPA. The aforementioned EPA communication
to each tribe will most likely yield more information about potential
sites on Indian Lands.
The sites listed in Tables 1 and 2 are the result of inquiries made
to various governmental entities. Table 2 is a reference list of
current CERCLIS sites on Indian Lands in Region VIII. Included in the
inquiries made by FIT were various branches, programs and officials of
Region VIII EPA including: CERCLA (Mr. Dave Schaller), Indian
Coordinator (Ms. Sadie Hoskie), RCRA (Ms. Jill Mason), Municipal
Facilities Branch (Mr. Tony Medrano), FIFRA (Mr. Dallas Miller), UMPTRA
(Mr. Phil Nyberg), and various members of the Emergency Response Branch
and the E&E Technical Assistance Team. Additional information was
acquired from the 1985 Council of Energy Resource Tribes report titled
Inventory of Hazardous Waste Generators and Sites on Selected Indian
Reservations; the 1986 EPA report titled Survey of American Indian
Environmental Protection Needs on Reservation Lands: 1986; and various
reports by the Indian Health Committee of the National Environmental
Health Association. Additional information was gained from an
introductory meeting between FIT and the authors of the CERT report.
CERT has additional records of potential hazardous waste sites which
will be forwarded to FIT when located.
The broad scale of this pilot project calls for good communication
and close coordination between EPA, FIT and tribal representatives.
Details of the Phase II methodology and the scheduling of site visits
be formalized as contact with tribal representatives is made and
