National Environmental PerformanceTrack National Environmental Performance Track MACT Benefit Fact Sheet U.S. Environmental Protection Agency What is Performance Track? The U.S. EPA's National Environmental Performance Track program is a public-private partnership that recognizes and drives environmental excellence. The program encourages public and private facilities with strong environmental records to continuously improve their environmental performance beyond regulatory requirements while working collaboratively within their communities. A core value of Performance Track is that facilities that demonstrate environmental leadership should be treated differently from other facilities in order to encourage greater environmental innovation and set a positive example for others to follow. To foster continuous improvement, Performance Track offers its members public recognition and opportunities for regulatory and administrative benefits that reduce reporting requirements and other administrative costs, while maintaining or enhancing existing levels of environmental protection. Performance Track MACT Benefit Published on April 22, 2004 (69 FR 21737), this rule provides a benefit under EPA's Clean Air Act (CAA) that allows sources to submit periodic reports at an interval that is twice the length of the regular period, provided that major sources subject to permits under 40 CFR Part 70 or 71 report no less than once every six months. For minor air sources, this means that they may be able to report only once per year instead of twice. This rule may also allow a reduction in the level of detail of required reporting, under some circumstances, for facilities who reduce their emissions below 25 tons/year of aggregate hazardous air pollutants (HAPs) and 10 tons/year of each individual HAP, and that have reduced the level of all HAPs to at least the level of compliance. Additional reporting reductions are also available for these facilities depending on how the facility meets its National Environmental Performance Track RCRA Benefit Fact Sheet Reduced Self-Inspections for Certain Types of RCRA Units Updated February 3, 2009 requirements. If a facility meets MACT by using technology where there is a technology standard, then the facility may substitute a simplified annual report to meet all the required reporting elements and certify that they are continuing to do so. If a facility meets MACT by using pollution prevention (P2) to comply with a technology standard, then the facility may substitute a simplified annual report certifying that they are continuing to do so. If there is a P2 standard and a facility uses P2 to comply and reduces emissions by an additional 50% or greater, then the facility may substitute a simplified annual report certifying that they are continuing to do so. In all cases, the facility must still fulfill all monitoring and record keeping requirements and maintain records demonstrating the veracity of the certification. D Member facilities should submit a written request to their state permitting authority for permission to reduce their reporting burden. D Requests should identify the facility and state when the facility would like to take advantage of the incentive, describe the facility's emissions, applicable requirements, and methods for meeting the requirements of the incentive.
