United States Environmental Protection Agency vvEPA State Incentives for Achieving Clean and Renewable Energy Development on Contaminated Lands Wyoming The development of clean and renewable energy on formerly used land offers many economic and environmental benefits. Combining clean and renewable energy and contaminated land cleanup incentives can allow investors and communities to create economically viable clean and renewable energy redevelopment projects. This document provides information about incentives in your state that can be leveraged for clean and renewable energy and development of contaminated land. Incentives for Clean and Renewable Energy Tax Incentives (abatements, deductions, credits, etc.) Renewable Energy Sales Tax Incentive http://legisweb.state.wy.us/statutes/titles/Title39/T39CH12AR1.htm Provides an exemption from state excise tax on the sales of equipment used on projects up to the point of interconnection, with an existing transmission grid for the generation of electricity from renewable resources. Technical Assistance and Other Incentives State Anemometer Loan Program www.wyomingbusiness.org/business/energy_anemometer.aspx Lends 50 meter, 30 meter, and 20 meter anemometer towers to land owners for wind resource assessments. These assessments provide data for commercial and residential sized wind turbines. Net Metering http://psc.state. wy. us/ Applies to investor-owned utilities and electric cooperatives. Eligible technologies include solar, wind, biomass, and hydropower systems up to 25 kW. Wyoming Incentives for Clean and Renewable Energy - Page ' ------- Incentives for Development of Contaminated Land Technical Assistance and Other Incentives Brownfields Assistance Program http://deq.state.wy.us/volremedi/brownfields.asp Provides technical assistance to brownfield sites through Phase I and Phase II assessments, cleanup plan options, and limited site cleanup activities. If eligible, assistance is provided up to $400,000 per site ($200,000 for assessment and $200,000 for cleanup). The Wyoming Department of Environmental Quality (DEQ) will develop a scope of work for the project, hire a contractor to perform the work, and oversee work activities. Limitations on Liability Voluntary Remediation Program (VRP) http://deq.state.wy.us/volremedi/brownfields.asp Provides for a process that can be used by owners and developers interested in contaminated sites to put contaminated sites back into productive use. The VRP provides three types of liability assurances: 1) Covenants not to Sue (CNTS); 2) Certificates of Completion (COCs); and 3) No Further Action Letters (NFAs). The VRP law also allows owners of contaminated sites to petition "appropriate governmental entity or entities" for the creation of a Use Control Area. This mechanism precludes any other uses for a property other than that defined in the Use Control Area agreement; it does this by using tools such as institutional controls to ensure no exposure to contamination left onsite.
