State Incentives for Achieving Clean and Renewable
Energy Development on Contaminated  Lands
The development of clean and renewable energy on formerly used land offers many economic and environmental benefits. Combining clean and renewable energy and
contaminated land cleanup incentives can allow investors and communities to create economically viable clean and renewable energy redevelopment projects. This
document provides information about incentives in your state that can be leveraged for clean and renewable energy and development of contaminated land.
                    Incentives for Clean and Renewable Energy
Funding (grants, loans, bonds, etc.)
On-Site Small Wind Incentive Program

Provides up to $150,000 per site in incentive payments for eligible new
small wind systems. The payments are provided to an eligible installer of
wind system models and passed on to the site owner.

Solar Electric Incentive Program (PON 1050)

Provides incentives to cover approximately 40-45% of the installed cost of
a PV System. For commercial systems, incentives may be combined with
loan assistance from NYSERDA through the NY Energy Smart Loan
FundSM to the extent available. Applications will be accepted through
September 30,2009.

New York Energy $martSM Loan Program (PON  1060)

Provides an interest rate reduction of up to 4.0% below the lender rate for
10 years, or 6.5% off a participating lender's or lessor's normal loan
interest rate on  loans for certain renewable technologies. Loans may be
provided for up  to $30,000 for 1-4 family homes; $2.5 million for multi-
family buildings (plus an additional maximum of $2.5 million for projects
that include advanced meters); and $1.5 million for commercial buildings.
Applications will be accepted through July 31,2009.

Solar, Wind, and Biomass Energy Systems Exemption

Provides a 15-year real property tax exemption for real property that
contains a solar, wind, or farm waste energy system approved by the State
Energy Research  and Development Authority.

Technical Assistance and Other Incentives	
Long Island Power Authority (LIPA) - Solar Pioneer Program

Provides a rebate of $3.50 per watt for commercial and residential
customers in the territory of LIPA.

Fuel Cell Rebate and Performance Incentive (PON 1150)

Provides financial incentives to support installation and operation of in-
state fuel cell systems, with up to $1 million available per project. Basic
capacity incentive includes for small systems (less than 25 kW), $2,000/kW
up to $20,000 per project site; and for  large systems (greater than or equal
to 25 kW), $1,000/kW up to $200,000 per project site. Bonus and
performance incentives are also available.
                                                               Net Metering

                                                               Allows net metering for qualifying commercial, industrial, residential, and
                                                               agricultural systems. In August 2008, New York enacted bills amending the
                                                               state's net metering laws, most notably expanding net metering eligibility to
                                                               non-residential PV and wind systems.

                    Incentives for Development of Contaminated Land

 Brownfields Opportunity Areas Program

 Provides technical and financial assistance through grant funding to
 municipalities and community based organizations, for up to 90% of eligible
 project costs, to complete revitalization plans and site assessments for
 specific property projects. Funding is based on project need and eligible
 state funding for the fiscal year application.

 Environmental Restoration Program (ERP)

 Provides grants to municipalities to reimburse up to 90% of onsite eligible
 costs and 100% of off-site eligible costs for site investigation and
 remediation activities. Funding amounts are project-specific and are made
 available from a $200 million fund.

Empire Zone Tax Credit

Provides multiple tax credits available within specific state-designated Empire
Zones. A real property tax abatement of 100% tax abatement for up to seven
years is provided for properties with improvements to real property. Technical
assistance is also offered within these designated zones.

Brownfield Cleanup Program Tax Credit

Provides three income tax credit opportunities, offering up to a 22% credit
for assessment, cleanup, and redevelopment projects participating in the
Brownfields Cleanup Program (BCP) and having received a Certificate of
Completion. The Redevelopment Credit provides an income tax credit up
to 22%, based on individual taxpayer or business and location of the site.
Credits are applicable for the cost of site preparation; investigation and
remediation costs; development or redevelopment of the site; and ground
water remediation. The Remediated Brownfield Credit for Real Property
offers up to a 25% income tax credit based on job creation and location
within an En-Zone. An Environmental Remediation Insurance Credit
provides reimbursement up to $30,000 or 50% of the costs of
environmental insurance.

Brownfield Cleanup Program (BCP)

Provides technical assistance and liability comfort for the assessment and
remediation of contaminated properties. The applicant reimburses all state
staff technical assistance support and receives  a Certificate of Completion
(CoC) for liability comfort at the end of the project. The BCP also provides
a credit for environmental remediation insurance of up to $30,000 or 50%
of the cost of the premium, whichever is less.

Provides liability protection under a  Certificate of Completion following
completion of the project under the BCP. Projects completed in the
Voluntary Cleanup Program are assigned a release and a Covenant Not to
Sue.
