United States Environmental Protection Agency State Incentives for Achieving Clean and Renewable Energy Development on Contaminated Lands The development of clean and renewable energy on formerly used land offers many economic and environmental benefits. Combining clean and renewable energy and contaminated land cleanup incentives can allow investors and communities to create economically viable clean and renewable energy redevelopment projects. This document provides information about incentives in your state that can be leveraged for clean and renewable energy and development of contaminated land. Incentives for Clean and Renewable Energy Funding (grants, loans, bonds, etc.) Direct Loan Program of the West Virginia Economic Development Authority (WVEDA) www.wveda.org/program-directloan.html Provides loans in a minimum amount of $50,000 and a maximum amount of $10 million or 40% of eligible costs. Financial assistance is available to participate in the financing of fixed assets for business classifications currently targeted by the West Virginia Development Office meeting VWEDA's job creation criteria; this includes any renewable energy project. The applicant may be an existing or prospective West Virginia business. Tax Incentives (abatements, deductions, credits, etc.) Special Assessment for Wind Energy Systems www.awea.org/smallwind/westvirginia_sw.htmiiocal%20or%20State%20lnc entive%20Programs%20for%20Wind%20Energy%20lnvestments Lowers the appraised property tax value on wind towers and turbines to 5% of original cost with a limit on the amount of property eligible for salvage valuation to be no more than 79% of the total value of the facility. Property other than the tower and turbine is to be appraised at fair market value. Technical Assistance and Other Incentives West Virginia Renewable Energy Program www.energywv.org/community/renewable.html Advances the use of West Virginia's wind and renewable resources through technical assistance and public-private partnerships. The program can assist developers by providing detailed wind maps, interfacing with West Virginia utilities, and contacting local economic developers. Tax Exemption for Wind Energy Generation www.awea.org/smallwind/westvirginia_sw.html#Local%20or%20State%2 Olncentive0/c20Programs%20for%20Wind°/c20Energy%20lnvestments Lowers the Business and Operation Tax (B&O) on utilities using wind- power generation. For most types of electricity-generating units, the B&O tax is 40% of the generating capacity; the B&O tax on a wind turbine is 12% of the generating capacity of the turbine. Industrial Expansion and Industrial Revitalization Credit for Electrical Power Producers www.state.wv.us/taxrev/uploads/schi.pdf Provides a tax credit for power generation companies that invest in new, expanded, or revitalized generation facilities. The credit is equal to 10% of the qualified investment and may be used to offset up to 50% of annual liability for Business Occupation Tax, Severance Tax, and Business Franchise Tax. Net Metering www.psc.state.wv.us/ Applies to residential and commercial systems up to 25 kW capacity that generate electricity using any renewable resource. West Virginia Incentives for Clean and Renewable Energy - Page ' ------- Incentives for Development of Contaminated Land Technical Assistance and Other Incentives Northern and Southern WV Brownfields Assistance Centers www.wvbrownfields.org/wvbrownfieldsProgram/about/defaultO.htm Provides technical assistance to eligible entities undertaking brownfields redevelopment efforts. Some support options include: property acquisition; serving as a developer of a property to manage remediation and redevelopment; maintaining an inventory of brownfield sites; providing training and technical assistance on brownfields development, grant writing, site assessments, remediation, community involvement, and site preparation; administering federal brownfields assistance programs; and coordinating with the West Virginia Development Office and Department of Environmental Protection. Limitations on Liability West Virginia Voluntary Remediation Program (VRP) www.wvdep.org/ltem.cfm?ssid=18&SS1ID=33 Provides a Certificates of Completion (COC) that offers liability relief for entities enrolled in the VRP. Once the VRP agreement is executed, the state is barred from conducting any enforcement actions against the applicant for the site and any contamination on the site, unless there is an imminent threat to public health.
