State Incentives for Achieving Clean and  Renewable  Energy

Development on Contaminated  Lands

The development of clean and renewable energy on formerly used land offers many economic and environmental benefits. Combining clean and
renewable energy and contaminated land cleanup incentives can allow investors and communities to create economically viable clean and renewable energy redevelopme
projects. This document provides information about incentives in your state that can be leveraged for clean and renewable energy and development of contaminated land.

Provides rebates up to 50% of the installed system cost for PV, solar water
heating, wind, fuel cells, and geothermal heat pump systems. These
incentives take the form of grants to offset a portion of the cost of the
renewable energy system. The Green Energy Program consists of three
separate programs: one for Delmarva Power & Light (DP&L), the state's
only investor-owned utility; one for the state's municipal utilities; and one
for the Delaware Electric Cooperative (DEC). All three programs are
currently managed by the Delaware Energy Office. Customers may only
apply for incentives from the fund to which they contribute through a
surcharge on their utility bills.

Offers grants to commercial or institutional entities up to $250,000 per
project that improve the engineering adaptation, or development of
products that directly relate to renewable energy technology in the state.
Eligible technologies include thermal electric, solar thermal process heat,
PV, landfill gas, wind, biomass, hydroelectric, renewable fuel, geothermal
electric, fuel cells, municipal solid waste, hydrogen, daylighting, anaerobic
digestion, and renewable fuels.

Delaware Green Energy Fund's Technology and
Demonstration Grants

Provides grants to commercial or institutional entities up to $200,000 per
project that demonstrate the market potential for new renewable energy
technologies and accelerate the commercialization of these technologies in
Delaware. Eligible technologies include hydroelectric, fuel cells, biodiesel
manufacturing facilities, storage, conversion, and conditioning equipment.
Note that grant limits are different for passive solar projects.
Net Metering

Offers net metering to non-residential customers statewide that generate
electricity using solar, wind or hydro resources, anaerobic digesters, or fuel
cells powered by renewable fuels. The maximum capacity of a net-metered
system is 2 MW per meter for non-residential customers of Delmarva
Power; and 500 kW per meter for non-residential customers of DEC. Note
that Delmarva and DEC also offer net metering for residential customers.

                    Incentives for Development of Contaminated  Land

Delaware Department of Natural Resources and Environmental
Control (DNREC) - Brownfields Grant Program

Offers brownfields grants to private parties up to $225,000 per project for
assessment, investigation, and cleanup activities. Of the $225,000, the first
potential $125,000 is a dollar-for-dollar reimbursement, and the second
potential $100,000 is a 50 cents to the dollar reimbursement. No more than
$1 million can be allocated to any one single entity in one fiscal year. The
site must be a certified brownfields and the eligible entity must not have
caused or contributed to the contamination. Public and nonprofit entities
may receive up to $1 million for a certified site, but may not receive more
than $1 million in any single fiscal year. These  entities also must not have
caused or contributed to any release(s) of hazardous substances.

Provides up to $250,000 in low interest loans (not to exceed 3%) to
businesses for environmental investigations and remediation activities.
Loans offered for a 10-year term.

DEDO - Brownfield Assistance Program

Allows reimbursement for either of the qualified assessment and
remediation costs up to $100,000 per project. The site must be a certified
brownfield, and create at least five jobs as a result of assessment and
cleanup activities.

Underground Storage Tank Remediation Loan Program

Offers financing at a low-interest rate of 3%,  for seven to 10 years, with a
minimum loan of $5,000 and a maximum loan of $250,000 to owners or
lessees of underground storage tank facilities that need rehabilitation in
order to meet regulatory requirements and where the applicant
demonstrates the ability to repay the loan.

Provides tax credits to any brownfield developer that invests $200,000 in a
qualified brownfield facility and who  has hired at least five qualified
employees during any taxable year.  Companies that locate on a brownfield
are eligible to receive tax credits for: 1) New employees ($650 for each
new employee); 2) Capital investment ($650 per each $100,000 of
investment); and 3) A 15-year graduated gross receipts tax credit. Credits
for employees and investment are enhanced by $250 if business is located
in a targeted area.

Offers complete liability protection for existing contamination to qualified
brownfield developers provided that they enter into a Brownfields
Development Agreement (BDA) prior to taking title of a property, and agree
to an approved work plan for cleanup of contamination prior to
development of the site. BDAs offer a Certificate of Completion of Remedy
(COCR) for the entire site or for geographic or media operable units (OUs).

Delaware Brownfields Voluntary Cleanup Program (VCP)

Offers full liability protection from existing environmental conditions to
property title holders/potential responsible parties (PRPs) that enter into a
Brownfields Voluntary Cleanup Agreement. Property owners must receive
a COCR before any liability protections engage, and before construction
can begin.
