RCRABrownfleids Brownfields Funding for RCRA Facilities Some RCRA facilities can be addressed with Brownfields funding from EPA. Information about the Brownfields program, including the application form and instructions, is available at www. epa. gov/brownfields The U.S. Environmental Protection Agency (EPA) is committed to revitalizing our nation's brownfields. Brownfields are real property, the expansion, redevelopment, or reuse of which may be complicated by the presence or potential presence of a hazardous substance, pollutant, or contaminant. Under the Small Business Liability Relief and Brownfields Revitalization Act (the Brownfields Law), eligible entities may be able to receive Brownfields funding for some properties subject to the Resource Conservation and Recovery Act (RCRA). RCRA-regulated Brownfields sometimes can pose the same drain on community resources as other types of brownfields. Brownfields grants for some RCRA-regulated sites can help communities bring new life to blighted neighborhoods. EPA awards Brownfields funding to communities throughout the United States. There are three types of annual grants that can be used to address Brownfields: assessment grants, revolving loan fund grants, and site cleanup grants. Assessment grants provide funding for a grant recipient to inventory, characterize, assess, and conduct planning and community involvement related to brownfields. Revolving loan fund grants provide funding for a grant recipient to capitalize a revolving loan fund and provide subgrants to carry out cleanup activities at brownfield sites. Cleanup grants provide funding for a grant recipient to carry out cleanup activities at brownfield properties that they own. How the Grants Will Be Awarded Brownfields grants are awarded through a competitive process. Due to limited availability of funds, not all qualified proposals may be funded. To receive Brownfields funding, eligible entities must submit a Brownfields grant application that addresses the requirements included in the proposal guidelines published in October 2002 for brownfields assessment, revolving loan fund, and cleanup grants (October 2002). The proposal guidelines can be found at: http://www.epa.gov/brownfields. Who Can Apply for Funding? Eligible entities that can apply for Brownfields assessment funding, revolving loan funding, and cleanup grants include: local governments; land clearance authorities or other quasi-governmental entities under the control of or as an agent for a local government; regional councils; redevelopment agencies; states; entities created by a state legislature; Indian Tribes (otherthan in Alaska); Alaska Native Regional Corporations; and Alaska Native Village Corporations. In addition, nonprofit organizations1 can apply for direct cleanup grants to clean up properties that they own. 'The term "nonprofit organization" means any corporation, trust, association, cooperative, or other organization that is operated primarily for scientific, educational, service, charitable, or similar purpose in the public interest; is not organized primarily for profit; and uses net proceeds to maintain, improve, or expand the operation of the organization. ------- ^ '' -^"T-.l-jg^ :g ;|f :-&fc-$|£ 5 *2ft?^ -^*"'' -fr$ f ife RCRA Facilities Automatically Eligible for Brownf ields Funding The Brownfields law divides RCRA facilities into two categories: 1) facilities that are automatically eligible to be funded under the program; and 2) facilities that require a property-specific funding determination by EPA to be funded under the program. RCRA facilities that are automatically eligible for Brownfields funding (subject to meeting all other Brownfields grant eligibility requirements), include: • RCRA interim status facilities that are not subject to any administrative or judicial order or consent decree; • RCRA interim status facilities that are subject to administrative or judicial orders or consent decrees that do not include corrective action requirements or any other clean up provisions (e.g., RCRA section 3008(a) orders without provisions requiring the owner/operator to address contamination); and • Parcels of RCRA facilities that are not under the scope of a RCRA permit or administrative or judicial order to conduct corrective action. RCRA Property-Specific Funding Determinations There are several types of RCRA facilities that require a property-specific determination by EPA in order to receive funding. These are RCRA facilities that have a RCRA permit issued by the U.S. EPA or a RCRA-authorized state, are subject to RCRA orders requiring corrective action (§3004(u) or §3008(h)), or are land disposal units that have submitted a RCRA closure notification or that are subject to closure requirements specified in a closure plan or permit. When making this property-specific determination, EPA assesses whether Brownfields funding for assessment, revolving loan fund, or cleanup activities will: • ensure protection of human health and the environment; AND • either promote economic development OR enable the creation, preservation, or addition to parks, green ways, undeveloped property, other recreational property, or other property used for nonprofit purposes.
