Final Rule Establishing Notification Requirements for Lead-
Based Paint Abatement Activities and Training
EPA has issued a final rule (69 FR 18489, April 8, 2004) that establishes reporting procedures
that support the effort of 40 CFR part 745, subpart L to ensure that lead abatement professionals
are trained and certified. The final rule includes procedures to notify the Agency: 1) prior to
commencement of lead-based paint abatement activities; 2) prior to providing lead-based paint
activities training courses; and 3) following completion of lead-based paint activities training
courses. These requirements are necessary to provide EPA compliance monitoring and
enforcement personnel with information necessary to track compliance activity and to prioritize
inspections.
To Whom Does this Final Rule Apply?
This action applies only in those States and
Indian country without authorized lead
programs. Therefore, you are affected if you
operate a training program required to be
accredited under 40 CFR 745.225, or if you
are a lead abatement professional who must
be certified to conduct lead-based paint
abatement activities in accordance with 40
CFR 745.226. Information regarding the
authorization status of a particular State or
Tribe can be found on the Internet at

contacting the National Lead Information
Center (NLIC) at 1-800-424-LEAD.
What are the Final Notification Provisions?
Notice prior to lead-based paint activities
training. The training manager must notify
EPA at least 7 business days prior to offering a
lead-based paint activities course. In addition,
the training manager must notify EPA of any of
the following changes to the original notice:
• If the course will begin before the original
start date, or if the location changed, notice
must provided at least 7 business days
before the start date.
• For other changes, such as cancellation or
delay, notice must be provided at least 2
business days prior to the start date.
Each notice must include the following:
• Notification type (original, update,
cancellation);
• Training program name, EPA accreditation
number, address, and phone number;
• Course discipline, type (initial/refresher),
and the language in which instruction will be
given;
• Date(s) and time(s) of training;
• Training location(s) phone number, and
street address;
• Principal instructors name; and
• Training manager's name and signature.
Notice following completion of lead-based
paint activities training. The training manager
must notify EPA within 10 business days of
lead-based paint activities course completion.
Each notice must include the following:
• Training program name, EPA accreditation
number, address, and phone number;
• Course discipline and type (initial/refresher);
• Date(s) of training;
• Training managers's name and signature;
and
• The following student information: name,
address, date of birth, course completion
certificate number, and course test score.
Notice prior to conducting lead-based paint
abatement activities. A certified firm must
notify EPA at least 5 business days prior to
conducting lead-based paint abatement
activities, with one exception. When
abatement activities are required in response
to either an Elevated Blood Lead Level
determination or emergency abatement order,
notice must be provided no later than the day

abatement activities began. In addition, a
certified firm must notify EPA of any of the
following changes to the original notice:
• If the abatement activity will begin before
the original start date, or if the location
changes, notice must be provided at least 5
business days before the start date.
• If the abatement activity is delayed, notice
of the new start date must be provided to
EPA on or before the original start date.
• For other changes, such as cancellation,
notice must be provided on or before the
start date, or after work has begun within 24
hours of the change.
Each notice must include the following:
• Notification type (original, updated,
cancellation);
• Date when abatement activities will start;
• Date when abatement activities are
expected to end;
• Firm's name, EPA certification number,
address, phone number;
• Type of building;
• Property name (if applicable);
• Property address, including apartment or
unit number;
• Documentation showing evidence of an
EBL determination or a copy of the
Federal/State/Tribal/Local emergency
abatement order (if applicable);
• Name and EPA certification number of the
project supervisor;
• Approximate square footage/acreage to be
abated;
• Brief description of the abatement activities
being preformed; and
• Name, title, and signature of the
representative of the certified firm who
prepared the notification.
How do I Deliver this Notification?
Notification of lead-based paint abatement
activities and training can be delivered in one
of the following ways:
1) By mail to U.S. Environmental Protection

2) By commercial or hand delivery to U.S.
Environmental Protection Agency, LBP

4) Beginning in the Summer of 2004 notice
can be provided electronically using EPA's
Central Data Exchange (CDX). Keep an

information about the availability of this
electronic submission option.
Sample forms are available to facilitate the
notification process. Other forms are also
acceptable if all of the required information is
included.
