The effective date of this rulemaking is September 8, 2009, unless EPA receives adverse comments by August 6, 2009. "National Oil and Hazardous Substance Pollution Contingency Plan; National Priorities List" July 20, 2009 (74 FR 35126) EPA announced the deletion of the Central Wood Preserving Company Superfund Site from the NPL. The effective date of this rulemaking is September 18, 2009, unless EPA receives adverse comments by August 19, 2009. "National Oil and Hazardous Substances Pollution Contingency Plan; National Priorities List" July 27, 2009 (74 FR 36943) EPA announced the deletion of the Southern California Edison Visalia Pole Yard Superfund Site from the NPL. The effective date of this rulemaking is September 25, 2009, unless EPA receives adverse comments by August 26, 2009. "National Oil and Hazardous Substance Pollution Contingency Plan; National Priorities List" July 20, 2009 (74 FR 35153) EPA announced its intent to delete the Central Wood Preserving Company Superfund Site from the NPL. Comments must be received by August 19, 2009. "National Oil and Hazardous Substances Pollution Contingency Plan; National Priorities List" July 27, 2009 (74 FR 36994) EPA announced its intent to delete the Southern California Edison Visalia Pole Yard Superfund Site from the NPL. Comments must be received by August 26, 2009. 2 ------- July 2009 Federal Registers NOTICES CERCLA "American Recovery and Reinvestment Act of 2009 (Recovery Act) Clarification of April 30, 2009 Addendum to Supplemental Funding for Brownfields Revolving Loan Fund (RLF) Grantees" July 2, 2009 (74 FR 31732) EPA clarified a notice from April 30, 2009, concerning the applicability of the Recovery Act, Title XVI, §1605 to certain loans and subgrants (74 FR 19954). These loans and subgrants would be made with approximately $40 million in Recovery Act funding that the Agency will use to supplement RLF capitalization grants, previously awarded competitively under CERCLA §104(k)(3). Specifically, EPA clarified that if a nongovernmental or tribal borrower or subgrantee uses RLF supplemental funds to remediate a public building or public work, the Buy American provision of the Recovery Act will apply to that loan or subgrant. The effective date of this action is July 2, 2009. "Availability of Draft Toxicological Profile for Perfluoroalkyls" July 23, 2009 (74 FR 36492) The Agency for Toxic Substances and Disease Registry (ATSDR) announced the availability of the draft toxicological profile of a priority hazardous substance. Comments must be received by October 30, 2009. "Notice of Development of Set 23 Toxicological Profiles" July 23, 2009 (74 FR 36493) These profiles will be available for public review and comment on October 17, 2009. "Identification of Priority Classes of Facilities for Development of CERCLA Section 108(b) Financial Responsibility Requirements" July 28, 2009 (74 FR 37213) EPA announced the identification of classes of facilities within the hardrock mining industry for which financial responsibility requirements will be developed under CERCLA § 108(b). For the purposes of the notice, hardrock mining facilities include those which extract, beneficiate, or process metals and non- metallic, non-fuel minerals. CROSS-PROGRAM "Agency Information Collection Activities OMB Responses" July 22, 2009 (74 FR 36195) This document announced OMB responses to Agency clearance requests, in compliance with the Paperwork Reduction Act (44 U.S.C. 3501 et seq.). Specifically, Information Collection Request (ICR) Number 1395.07, "Emergency Planning and Release Notification Requirements under Emergency Planning and Community Right- to-Know Act Sections 302, 303, and 304 (Renewal)," was approved on July 4, 2009. This ICR, OMB Control Number 2050- 0092, expires July 31, 2012. Additionally, ICR Number 1656.13, "Risk Management Program Requirements and Petitions to Modify the List of Regulated Substances under Section 112(r) of the Clean Air Act (Renewal)," was approved on July 10, 2009.
