EPA Considers Heritage-WTI,
Inc. RCRA Permit; Asks for
Comments	
Heritage - WTI, Inc. Hazardous Waste Storage Permit
U.S. Environmental Protection Agency (U.S. EPA) is accepting
public comments on its intent to issue a Resource Conservation and
Recovery Act (RCRA) Hazardous Waste Storage permit to cover air
emissions from tanks, containers and other equipment that store, treat,
or handle hazardous waste at Heritage-WTI, Inc.'s (d.b.a. WTI)
facility in East Liverpool. Heritage-WTI, Inc. is better known for its
hazardous waste incineration. The federal RCRA permit contains
conditions that Heritage-WTI, Inc. (WTI) must comply in order to
continue their operations.
Officials with U.S. EPA Region 5 in Chicago have determined that
WTI has shown it can comply with the RCRA rules and a federal
RCRA permit should be issued. Before it does so, however, the
Agency will accept public comments or new information on the draft
permit (see adjacent box for contact information). U.S. EPA will also
hold a public hearing if citizens request one.
WTI receives many types of hazardous waste and non-hazardous
wastes for incineration from several different industries around the
country and Canada at its facility located at 1250 St. George St. WTI
received its initial RCRA permit to operate its incinerator and its
associated hazardous waste storage/treatment equipment in 1985. A
federal permit which incorporates new federal requirements would
allow the company to continue handling hazardous wastes.
U.S. EPA and Ohio EPA split oversight of RCRA requirements for
the WTI operations. U.S. EPA's permit covers federal regulations
which have not been authorized to Ohio EPA for management in
lieu of the federal programs. The federal RCRA permit specifies
requirements for design and operations of WTI's container storage,
tanks, piping and associated equipment (such as pumps, valves,
fittings, etc.), and miscellaneous units to minimize the emissions of
pollutants from these equipment.
Specifically, the federal permit covers three (3) major areas, namely,
1.	Air emissions standards for equipment leaks (40 CFR Part 264,
Subpart BB)
2.	Air emission standards for tanks and containers (40 CFR Part
264, Subpart CC)
3.	Air emission standards for miscellaneous units (40 CFR
Part 264, Subpart X )

The federal RCRA permit contains conditions specific to the design, operations, and maintenance
of the facility. Compliance with the this federal permit would further ensure: (1) minimizing the
releases of organic pollutants into the environment and (2) an additional safety for the operations
of WTI's hazardous waste storage facility, hazardous waste handling equipment (e.g., pumps), and
waste treatment equipment, which includes the newly installed emission control equipment (i.e.,
carbon adsorption system) for the waste storage and handling equipment.
Ohio EPA oversees federal requirements for treatment of hazardous waste in the incinerator,
storage of hazardous wastes in containers and tanks, and other RCRA-approved units. Ohio EPA
issued its portion of WTI's RCRA permit in March 2005. If U.S. EPA issues this federal RCRA
permit, the expiration date of the federal permit will be the same as the Ohio EPA permit, which
expires on March 23, 2015.
After the close of the public comment period, U.S. EPA will review and consider the comments
before making a final decision on the draft permit. To those who submit comments, U.S. EPA
will send a document summarizing the significant comments received with responses to the
comments as well as its final decision on the draft permit. Within 30 days of the final
determination, anyone who submitted written comments may petition U.S. EPA's Environmental
Appeals Board to review the decision.
