^tDsr^ Scope of the Federal Pesticide Containment Regulations \ The purpose of this document is to help you determine whether the federal containment regulations require you to have a secondary containment unit and/or a containment pad. 1. Do I need a secondary containment unit? Are You: 1. A refilling establishment whose principal business (50% or more) is retail sales; AND/OR 2. A commercial pesticide applicator; AND/OR 3. A custom blender? The containment regs do not apply to you. NO YES Do you handle agricultural pesticides? The containment regs do not apply to you. YES 1 Do you have: One or more stationary pesticide containers* that hold 500 gallons or more of a liquid pesticide or 4,000 pounds or more of dry pesticides? (See notes below) NO YES Secondary containment is not required. / See next page to determine if you need a Containment Pad. You must have Secondary Containment unit.** Also, see next page to determine if you need a Containment Pad. *NOTE: A stationary pesticide container is a refillable container that is fixed at a single facility or establishment, or if not fixed that remains at a facility for 30 consecutive days or more and holds pesticide the entire time. **NOTE: The following Exempt Containers are not required to be in secondary containment: 1. Empty containers; 2. Containers holding rinsate or wash water (and are labeled to indicate this); 3. Containers holding gaseous pesticides at normal atmospheric pressure; and 4. Containers dedicated to non-pesticide use ------- 2. Do I need a containment pad? Are You: 1. A refilling establishment whose principal business (50% or more) is retail sales; AND/OR 2. NO NO Do you do one OR more of the following activities? 1 Empty*, clean or rinse refillable containers; 2. Dispense pesticides from a stationary container designed to hold 500 gallons or more of liquid pesticide or 4,000 pounds or more of dry pesticide for any purpose; 3. Dispense pesticides from a transport vehicle for the purpose of refilling a refillable container (bulk container or minibulk); 4. Dispense pesticides from any container to refill a refillable container for sale or distribution? The containment regs do not apply to you. The containment regs do not apply to you. NO A containment pad is not required. YES You Must Have Containment Pad. ** •Containment pad requirements DO NOT apply if the pesticide is dispensed from containers LESS than 500 gallons (liquid) or 4,000 pounds (dry) for USE, APPLICATION or purposes other than refilling for sale or distribution. ** Dispensing areas are Exempt from needing a containment pad if: 1. You only have gaseous pesticides; 2. You only have stationary containers already protected by a secondary containment unit; AND/OR 3. The area is used only for dispensing from a (non-stationary) rail car (in place less than 30 days). ------- |
