Scope of the Federal Pesticide Containment Regulations

The purpose of this document is to help you determine whether the federal containment
regulations require you to have a secondary containment unit and/or a containment pad.
1. Do I need a secondary containment unit?

1.	A refilling establishment whose principal
business (50% or more) is retail sales; AND/OR
2.	A commercial pesticide applicator; AND/OR
3.	A custom blender?

*NOTE: A stationary pesticide
container is a refillable container that is
fixed at a single facility or establishment, or
if not fixed that remains at a facility for 30
consecutive days or more and holds
pesticide the entire time.
**NOTE: The following Exempt Containers are
not required to be in secondary containment:
1.	Empty containers;
2.	Containers holding rinsate or wash water (and
are labeled to indicate this);
3.	Containers holding gaseous pesticides at
normal atmospheric pressure; and
4.	Containers dedicated to non-pesticide use

of refilling a refillable container (bulk container or minibulk);
4.	Dispense pesticides from any container to refill a refillable
container for sale or distribution?

**
•Containment pad requirements DO NOT apply if the pesticide
is dispensed from containers LESS than 500 gallons (liquid)
or 4,000 pounds (dry) for USE, APPLICATION or purposes
other than refilling for sale or distribution.
** Dispensing areas are Exempt from
needing a containment pad if:
1.	You only have gaseous pesticides;
2.	You only have stationary containers
already protected by a secondary
containment unit; AND/OR
3.	The area is used only for dispensing
from a (non-stationary) rail car (in
place less than 30 days).
