Introduction
This Fact Sheet is to notify the public of proposed
environmental activities at Clean Harbors
Tennessee, LLC. (CHT), located in Greenbrier,
Tennessee. CHT provides environmental services
to companies that generate waste in nearby
states. CHT is seeking a renewal of their approval
for the management of chemicals called
polychlorinated biphenyls (PCBs) at the facility.
The environmental activities identified in the
draft Toxic Substance Control Act (TSCA) PCB
Approval include the commercial storage of PCB
wastes. This is a ten-year proposed renewal of	Arial View of Clean Harbors-Greenbrier, TN
their current authority to store PCBs in two designated storage locations. The purpose of the Approval is to
ensure the facility operates in a manner that protects human health and the environment and complies with
federal regulations.
This PCB Approval renewal action only covers environmental activities related to PCB wastes. All other
hazardous waste activities are regulated under the Resource Conservation and Recovery Act (RCRA).
Hazardous waste management is regulated under a separate permit issued by the Tennessee Department of
Environmental Conservation (TDEC).
This fact sheet provides an opportunity to learn more about
the TSCA Approval process, as well as the upcoming public
comment period. The main subject of this notification is the
TSCA PCB Approval document.
Upcoming Public Comment Period
The EPA is committed to fostering meaningful public
involvement in environmental decision making. The draft
TSCA PCB Approval document is open for a 30-day public
comment from June 24, 2019 to July 24, 2019. On page 2 of
this document, you will find the link to the draft TSCA PCB
Approval document on the EPA's public notice website and the address of where the hard copy of the
draft Approval and application may be reviewed. The public may provide written comments during the
30-day comment period. Please submit your comments by letter or email, postmarked by the deadline
to the EPA's Technical Project Manager (contact information on page 2). The EPA will evaluate public
input and finalize its decision after responses have been prepared to all written comments received.

What is TSCA?
TSCA stands for the Toxic Substances Control
Act regulations. The Toxic Substances
Control Act of 1976 provides the EPA with
authority to require reporting, record-
keeping and testing requirements, and
restrictions relating to chemical substances
and/or mixtures, which include PCBs.

Background
Under the TSCA regulations, CHT must obtain a PCB Approval from the
EPA to receive PCB waste from off-site and to store the PCB waste at its
facility. The EPA has reviewed CHT's application for operation of the
Greenbrier facility. The draft PCB approval document lists the maximum
volume of PCB waste that may be stored for disposal in designated
areas at CHT, It is proposed that PCB waste may be stored in 55-gallon
containers, shipping containers or non-leaking units legal for shipping
as is. The two cited locations for storage are the warehouse and the
storage bay. PCB wastes and PCB Items must be stored in a manner that presents no unreasonable risk of
injury to health and the environment and that does not impede routine inspections carried out by CHT as
required by this Approval.
The draft TSCA PCB Approval has four sections:
•	General Conditions - CHT must operate its facility in
compliance with the conditions of the Approval and
consistent with the information included in the CHT
Application and in accordance with TSCA and the PCB
Regulations, including the requirements of the "PCB
Spill Cleanup Policy" (found at 40 C.F.R. Part 761);
•	PCB Storage Management - The PCB storage areas
must meet certain inspection requirements and
maintain proper engineering standards to prevent
chemical releases. CHT may store PCB wastes and
PCB Items in a manner that allows maximum use of
space within certain conditions and PCB storage in any other non-designated area will be a violation of
the Approval;
•	Maximum Storage Capacities - The maximum storage capacity for PCB wastes and PCB Items is limited
to two designated storage areas for a total of 13,750 gallons; and
•	Facility Operation and Limitation of Exposure and Control of Releases - CHT will maintain and operate
the facility in a manner that prevents the likelihood of fire, explosion, and release of PCBs to the
environment, and the exposure of workers to PCBs.
The draft TSCA Approval is scheduled to be issued for a term of ten years. The EPA has the authority to
suspend or revoke the PCB TSCA Approval at any time when the EPA has reason to believe that the continued
operation of this facility presents an unreasonable risk to human health or the environment. At this time, the
EPA has determined that the commercial storage of PCB waste in accordance with the draft TSCA PCB
Approval Conditions established will not pose an unreasonable risk of injury to health or the environment.
