United States l-:iJA-3O0-K-O3-Of)l Environmental Protection Revised December 2002 Agency Office of Knlorcement and Compliance Assurance (2261 A) ------- Federal Facilities Enforcement Office (FFEO) As part of EPA's Office of Enforcement and Compliance Assurance (OECA), FFEO is responsible for ensuring that federal facilities take all necessary actions to prevent, control and abate environmental pollution. Major FFEO functions include: • Policy and guidance development, • Regional program support, • Interagency agreement negotiation support, • Compliance monitoring and targeting suppoit and • Technical assistance and capacity building. FFEO is divided into two groups: the Site Remediation and Enforcement Staff and the Planning, Prevention and Compliance Staff. Together, these groups develop national policy and guidance to address the broad range of enforcement and compliance issues confronting federal facilities. Site Remediation and Enforcement Staff (SRES) SRES's efforts primarily involve working with the EPA Regional offices, other EPA headquarters offices, and federal agencies to facilitate enforcement under all environmental statutes and cleanup at federal facilities. For cleanup issues, SRES works closely with the EPA Federal Facilities Restoration and Reuse Office (FFRRO) on many of these issues. Specific SRES responsibilities affect every aspect of federal facility enforcement, from planning to implementation. For example, SRES reviews proposed federal legislation and develops EPA positions on appropriate federal responsibilities under such legislation. SRES also is involved in developing federal facility Page 1 ------- enforcement strategies and in preparing guidance to assist Regions in their implementation. Finally, SRES is directly involved in enforcement negotiation, including Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA) interagency agreements, administrative penalty and/or compliance orders, and in litigation and enforcement support at federal facilities. Planning, Prevention, and Compliance Staff (PPCS) PPCS is responsible for initiatives to prevent noncompliance at federal facilities and overseeing compliance assistance and targeting activities. PPCS tracks and evaluates compliance at Federal facilities to identify high priority compliance issues and develop proactive multi-media measures to prevent pollution and reduce future noncompliance at federal facilities. PPCS works on enforcement and inspection targeting at federal facilities with environmental laws, regulations, and Executive Orders; promotes pollution prevention, multi-media enforcement, compliance, and environmental justice activities at federal facilities; and encourages the use of innovative technologies to attain pollution prevention, compliance, and cleanup goals. Page 2 ------- Representative FFEQ Program Activities • Enforcement Actions and Negotiations - FFEO participates in enforcement negotiations, oversees enforcement activities undertaken by the Regions, and is responsible for resolving enforcement disputes between EPA and other agencies. FFEO coordinates with the Regions on issuing penalty and compliance orders and agreements. Actions against Federal agencies include notices of violation, interagency agreements, penalty and compliance orders, and agreements under ail relevant environmental statutes. • Enforcement Strategies and Policies - FFEO develops strategies for inspections and enforcement actions to address noncompliance at federal facilities. FFEO aiso issues enforcement policies and guidance on conducting federal facility enforcement actions under environmental laws, including the Clean Air Act, the Safe Drinking Water Act. and the Resource Conservation and Recovery Act. • Planning of Cleanup Activities - FFEO supports the implementation of the Superfund program at federal facilities by helping to establish specific cleanup goals and objectives, identifying appropriate funding levels, and assessing progress in meeting goals and objectives using the Superfund Comprehensive Accomplishments Plan (SCAP) and Strategic Targeted Activities for Results System (STARS). • Federal Facility Compliance Assistance and Pollution Prevention Activities - FFEO advises federal agencies on how to comply with environmental laws, regulations, and Executive Orders and how to prevent pollution. FFEO and EPA Regional offices provide compliance assistance and pollution prevention information through training, written policy and guidance, funding pilot projects. EPA's web Page 3 ------- sites, and FedSite - CPA's online web-based compliance assistance center for federal facilities. FFEO also publishes 'TedFacs." a newsletter on current topics impacting federal facilities. • Environmental Management Systems — FFEO advocates the use of Environmental Management Systems and conducts Environmental Management Reviews (EMRs) at federal facilities. EMRs are evaluations of a facility's program and management systems to determine how well the facility has developed and implemented specific environmental protection programs to ensure compliance and environmental excellence. An EMR report contains recommendations to improve those programs and a facility's environmental performance. • FedEnviroNews - Subscribers to this free computerized information service receive environmental news and information of interest to federal facilities. • jFederal Facilities Environmental Justice Activities — FFEO coordinates environmental justice initiatives related to federal facilities and works closely with the Regions on these issues. FFEO supports the Regional enforcement actions at federal facilities when environmental justice concerns exist. Page 4 ------- Regional Federal Facilities Program Managers (FFPMs) Federal Facilities Program Managers, in conjunction with other EPA Regional staff, are responsible for coordinating the implementation of EPA's federal facilities policies and programs in EPA's Regional offices. FFPMs serve as the primary Regional point between EPA and the federal facilities. Specific FFPM responsibilities include: • Providing program assistance, training, and outreach for federal facilities. • Managing tracking, oversight, and compliance planning activities. • Encouraging pollution prevention at federal facilities. 0 Coordinating with Regional media program staff to implement federal facilities enforcement programs. By providing a contact for enforcement, compliance, and outreach activities, FFPMs streamline the federal facility compliance and enforcement process for both federal facilities and Regional and headquarters personnel.
