The Fiscal Year (FY) 2012 Consolidated Appropriations Act (P.L. 112-74) (Appropriations Act)
required that not less than 20 percent but not more than 30 percent of the funds made available
for CWSRF capitalization grants over $1 billion and not less than 20 percent but not more than
30 percent of the funds made available for DWSRF capitalization grants shall be used by the
State to provide additional subsidy to eligible recipients. The Joint Explanatory Statement
accompanying the Appropriations Act directed the EPA to report on how States have
implemented their additional subsidization authority since its inception.
This report provides Congress with information on the number and amounts of loans that
included additional subsidization from the FY 2010 appropriation. This includes information on
additional subsidization, recipients, and projects. Due to the multi-year nature of the SRF
funding process, complete data state use of additional subsidy through the SRFs is only available
for the FY 2010 appropriation. The report encompasses $637,390,450 in CWSRF subsidization
across 657 assistance agreements and $399,576,892 in DWSRF subsidization across 623
assistance agreements.
Part I
Introduction ami Background
The SRF Programs
The United States Environmental Protection Agency (EPA) has a long standing history of
providing financial support in the interests of public health and water quality. Beginning in the
1970s, the Construction Grants program oversaw considerable federal investment in our nation's
wastewater infrastructure. Despite this infusion of federal dollars, later decades brought
increased need for repair and replacement of assets. EPA began to consider alternative strategies
to provide states with a permanent source of funding that would not be fully dependent on
federal contributions.
With this goal in mind, Congress introduced a new model for providing financial assistance. The
Clean Water State Revolving Fund (CWSRF) was established by the 1987 amendments to the
Clean Water Act (CWA) providing states with a continuous source of funding for water quality
projects, including nonpoint source, watershed protection and restoration, estuary management,
as well as traditional municipal wastewater treatment.
Further, in 1996, Congress established the Drinking Water State Revolving Fund (DWSRF) as
an integral part of the Safe Drinking Water Act (SDWA) Amendments, which reflect a
comprehensive "source to tap" approach to protecting public health. The DWSRF provides states
with a continuous source of funding for infrastructure improvements to drinking water systems,
including construction related to water treatment, transmission and distribution, storage, and
source. It also allows states to use set-aside funds to carry out a range of public health protection
activities, including providing technical assistance to water systems that need help in becoming
ready to use DWSRF funds for infrastructure improvements.
Funds to capitalize SRF programs are provided through federal grants and state matching funds
equal to twenty percent of the federal contribution. At the state level, CWSRF and DWSRF

monies are loaned to communities while repayments are recycled back into the program to fund
additional projects. The revolving nature of these programs provides a self-sustaining source of
funding for communities in need of drinking water and wastewater infrastructure improvements.
This collaboration between EPA and the states is the largest source of federal funding for
wastewater and drinking water infrastructure projects in the country. However, the vast majority
of funding for water and wastewater infrastructure is non-federal.
The SRF Funding Process
States have the remainder of the fiscal year in which their funds were appropriated, as well as the
following fiscal year, to apply for and receive their capitalization grants. Capitalization grant
funds are made available to states based on a payment schedule negotiated between the state and
EPA. Capitalization grant payments are not actual cash disbursements; rather, they represent
increases to the total amount of capitalization grant funds available from the state's Federal
Treasury account for cash draw. All payments must be made within eight quarters after the
capitalization grant is awarded or twelve quarters after the funds are allotted to states, whichever
occurs first. Within one year of taking payment, the state must enter into binding commitments
equal to 120 percent of the payment. A binding commitment is a legal obligation by the state to
the assistance recipient that defines the terms of assistance from the SRF. It is important to
recognize that not all states utilize assistance agreements as binding commitments. Letters or
other legally binding forms of communication also may serve this purpose, in which case the
state and assistance recipient may have reached a clear understanding of how assistance will be
provided, but not have executed a final loan agreement.
As SRF assistance recipients incur costs, the SRF program submits a request for a cash draw
covering the federal share of the incurred costs. The intent in using this mechanism is to make
SRF capitalization grant funds available, when needed, for actual construction-related costs.
Additional Subsidization Requirements
The 1996 SDWA amendments created within the DWSRF a discretionary subsidy program for
"disadvantaged communities" as defined by the state based on publicly-reviewed criteria
approved by EPA. Under this provision, states could decide to provide a subsidy to those
communities of up to 30% of the grant in the form of negative interest rates, principal
forgiveness or loan-term extension. Nineteen states used that capability prior to the American
Recovery and Reinvestment Act (ARRA).
ARRA introduced new requirements to both the CWSRF and DWSRF communities. Of the $6
billion appropriated to both programs, not less than 50 percent of a state's ARRA allotment had
to be provided in the form of grants, principal forgiveness, or negative interest rate loans. These
options have the effect of reducing the repayment amount or absolving the loan altogether. A key
driver in the provision of additional subsidization under ARRA was the requirement that all
dollars be under contract by February 17, 2010. As a result, subsidy requirements were met
within a one-year time frame. Subsequent to ARRA, additional subsidization is required to be
provided within a capitalization grant's period of performance, typically seven years.

Figure 1 indicates how appropriations following ARRA carried forward different variations of
the additional subsidization requirement. The Fiscal Year (FY) 2012 Consolidated
Appropriations Act (P.L. 112-74) (Appropriations Act) required that not less than 20 percent but
not more than 30 percent of the funds made available for CWSRF capitalization grants over $1
billion and not less than 20 percent but not more than 30 percent of the funds made available for
DWSRF capitalization grants shall be used by the State to provide additional subsidy to eligible
recipients. The Joint Explanatory Statement accompanying the Appropriations Act directed the
EPA to report on how States have implemented their additional subsidization authority since its
inception. This report provides Congress with information on the number and amounts of loans
awarded with FY 2010 additional subsidization, recipients, and projects funded.
Report Methodology
This report contains data entered into the Clean Water Benefits Reporting (CBR) and Drinking
Water Project Benefits Reporting (PBR) data systems. CBR and PBR, respectively, are the
primary mechanisms for project level data collection in the CWSRF and DWSRF programs.
Beginning in FY 2010, capitalization grant conditions require states to report on the use of all
SRF funds in CBR and PBR. Required data fields include the use of funds for additional
subsidization, as well as information on the projected environmental and public health benefits of
SRF assistance agreements. Data must be entered in the quarter in which the final loan
agreement was executed. Until such time as a loan agreement is executed, the terms of assistance
and project information will not be reflected in CBR and PBR.

Due to the multi-year nature of the SRF funding process, this report only contains data for loans
that were provided subsidy under the FY 2010 appropriation. These data most completely reflect
how states implemented their additional subsidization authority.
Part II
CWSRF Utilization of Additional Subsidy Authority
The FY 2010 Appropriations Act required that not less than 30% of the funds made available to
each State for CWSRF capitalization grants be used by the state to provide additional subsidy to
eligible recipients in the form of principal forgiveness, negative interest loans, or grants. The
provision only applied to $996,915,000 of the total appropriation, which was the portion of the
amount available for CWSRF capitalization grants that exceeded $1 billion. The CWSRFs were
required to provide at least 30% of this amount or, $299,074,500, with the option of being able to
provide up to $996,915,000. Therefore, States were required to provide between 15 and 50
percent of their capitalization grant as additional subsidization. These percentages are based on
the total amount available for capitalizations grants or $1,996,915,000.
In addition to the additional subsidization requirement, the Joint Explanatory Statement
accompanying the Appropriations Act encouraged states to give priority for additional
subsidization to projects in communities that could not otherwise afford an SRF loan. Which
applicants meet that criterion is left to the discretion of the states; however, for many states
median household income (MHI) is a key indicator of affordability. Appendix D to this report
contains recipient and project information, including a comparison of recipient to state MHI.
The figure below displays the distribution of FY 2010 additional subsidization across four MHI
ranges:

To date, 75 percent of loans that included FY 2010 additional subsidization were made to
communities that were below or equal to their state MHI. The four MHI categories above also
reveal that as community MHI increases the average amount of subsidy per project decreases.
These figures indicate that states are generally prioritizing additional subsidization in a manner
consistent with congressional direction. Communities with the greatest financial need are
receiving the highest amount of subsidization.
Appendix A shows the minimum and maximum amounts of additional subsidization states were
required to provide. The table reveals a wide distribution between states in terms of the amount
of additional subsidization provided. Fifteen states provided more than 40 percent of their
capitalization grants as additional subsidization. Of these, South Carolina, Kansas, South Dakota,
Puerto Rico, Illinois, and West Virginia provided the full maximum. Seventeen states formed the
middle ground of the distribution, providing between 20 and 40 percent of their capitalization
grant as additional subsidization. On the low end of the spectrum, nineteen states provided less
than 20 percent as additional subsidization. At 7 percent, Louisiana is currently below the
minimum additional subsidization for FY 2010.
It should be emphasized that under the authority of post-ARRA appropriations, no time frame
was specified during which additional subsidization must be provided. Unlike ARRA, which
required that all dollars had to be in executed loan agreements and under contract within one
year, states are now executing loan agreements in accordance with the traditional SRF funding
process described above. Although Louisiana is currently below the minimum requirement for
FY 2010, their SRF program has binding commitments in place that will meet the requirement in
full. Based on status updates from EPA Regional staff, the agency anticipates these loan
agreements will be executed during calendar year 2014.

EPA also examined data on the population served by CWSRF loans with additional subsidization
from the FY 2010 appropriation. 58 percent of the loans receiving subsidization serve
populations of 10,000 or less. While not directly examining community wealth demographics,
EPA considers this information important to understanding additional subsidization as well,
since smaller populations may lack the financial capability of larger assistance recipients. 19
percent of loans receiving subsidization serve populations of 10,000 to 99,999 and the final 11
percent serve populations greater than 100,000. These data are subject to change as 12 percent of
the loans in CBR did not have an amount specified for project population served. The number of
loans receiving additional subsidy under the FY 2010 authority also is expected to increase
during 2014, but EPA expects that new data will reflect the funding trends identified in Figure 3.

Loan Purpose
States used the FY 2010 funding for additional subsidy in a manner broadly similar to the use of
their traditional loan funds. The CWSRF program was designed to allow states the flexibility to
fund projects based on water quality priorities. As a result, state programs use additional
subsidization to fund a wide range of projects ranging from wastewater treatment to nonpoint
source and estuary protection.
Traditionally, the largest amount of CWSRF funding finances publicly owned treatment works
under Section 212 of the CWA. This trend holds true with the states' provision of additional
subsidization. Out of a broad spectrum of needs categories, which are not mutually exclusive, 85
percent of projects receiving additional subsidy are classified as Section 212 projects, while the
remaining 15 percent fund nonpoint source and estuary protection.

The FY 2010 Appropriations Act required that not less than 30% of the funds made available to
each State for DWSRF capitalization grants be used by the state to provide additional subsidy to
eligible recipients in the form of forgiveness of principal, negative interest loans, or grants. As
noted previously, the requirement was a change from the historical DWSRF provision allowing
States to establish a "disadvantaged assistance" program that could include additional reductions
to interest charged, extended loan terms, and forgiveness of principal up to 30% of their grant.
In addition to the additional subsidization requirement, the Conference Committee's Joint
Explanatory Statement for the Appropriations Act encouraged states to give priority for
additional subsidization to projects in communities that could not otherwise afford an SRF loan.
Which applicants meet that criterion is left to the discretion of the states. However, for many
states, median household income (MHI) is a key indicator of affordability. Appendix E to this
report contains recipient and project information, including a comparison of recipient to state
MHI. The figure below displays the distribution of FY 2010 additional subsidization across four
MHI ranges:

The table included in Appendix B shows the minimum amounts of additional subsidization states
were required to provide for their 2010 grant. Forty one states provided 30 percent or more of
their grants as additional subsidization. Of these, South Dakota, New Mexico, Maryland,
Virginia, South Carolina, and Puerto Rico provided 40% of their grant as subsidy as of the
reporting period. Eight States reported between 15% and 30% of their grant amounts as
committed to loans with subsidy. Two States reported less than 15% of their grant amount as
committed to loans with subsidy. All States not yet at the minimum required subsidy level are
either: 1) waiting for final loan agreements to be executed that will raise their additional
subsidization provided to the minimum amount required, 2) at 30% already, but the data will not
be uploaded until the next reporting period, or 3) waiting to finalize subsidy amounts at project
completion. Loan amounts can change over the life of a project and final amounts are not
reported until the projects are completed. If needed, unused subsidy is put into new loans. For
example, three States below 30% currently had been above 30% in the summer of 2013.
It should be emphasized that under the authority of post-ARRA appropriations, grant awards do
not specify a time frame during which additional subsidization must be provided. Unlike ARRA,
which specified that all funds had to be in executed loan agreements and under contract within
one year, states are now executing loan agreements in accordance with the traditional SRF
funding process described above. Although there are states that provided less than the required
minimum of 30 percent through February 10, 2014, these states have not yet completed
executing assistance agreements with subsidy, and know they are required to do so.
