Update: Statement of Basis for Cleanup

INTRODUCTION: The Environmental
Protection Agency (EPA) has issued an
Administrative Order on Consent to the
Union Pacific Railroad (UPRR). The
order requires UPRR to investigate and
clean up releases of hazardous wastes
or hazardous constituents at the Omaha
Shops facility, 9th and Webster. The
order was issued under the Resource
Conservation and Recovery Act (RCRA)
because UPRR stored containers of
hazardous wastes.
BACKGROUND: The order divided the
investigation and cleanup of the facility
into 3 parts that are called "operable
units." The first part, "Operable Unit #1,"
(OU1) is about 100 acres on which the
City of Omaha has proposed to
construct a convention center and
arena. UPRR submitted the RCRA
Facility Investigation (June 1999) and
Corrective Measures Study (February
2000) forOUl to EPA.
STATEMENT OF BASIS: EPA
prepared a Statement of Basis that
proposes a corrective measure to clean
up OU1. EPA requests public comments
on the Statement of Basis. The
document is available for public review
at locations listed at the end of this fact
sheet.
PROPOSED CORRECTIVE
MEASURE: The corrective measure
proposed for OU1 includes:
•	Excavating contaminated soil
from construction areas
•	Placement of excavated soil in an
onsite disposal area
The Statement of Basis describes how
this corrective measure meets EPA's
requirements for cleanups. EPA will
make a final decision on a corrective
measure only after the public comment
period has ended and all written
comments have been reviewed. EPA
may modify the proposed corrective
measure based upon public comments.
Comments on the proposed corrective
measure and the other alternatives is
important to the corrective action and
community involvement process.

Public Comment Period for the Statement of Basis on OU1
A comment period is open from April l. 2000 to
Max 5,2000. EPA representatives will be available
on Tuesday. May 2 at the Omaha School District's
Teachers Administration Center Boardroom located
at 3215 Cuming from 3 p.m.- 6 p.m. to answer
questions from the public about cleanup of the
facility.
A public hearing also will be held starting
at 7 p.m. on the same date and at the same loca-
tion.
Written comments must be submitted to the EPA
project manager by May 5. 2000 using the address
listed on the back under "For More Information."
