Subpart RR, Geologic Sequestration of Carbon Dioxide
Final decisions of the Administrator under 40 CFR Part 98, Subpart RR are appealable to EPA's Environmental
Appeals Board (www.epa.gov/eab) under the regulations that are set forth in 40 CFR Part 78. Final decisions
that may be appealed include:
•	Determination of eligibility for a research and development (R&D) project exemption from 40 CFR
Part 98, Subpart RR
•	Approval or disapproval of a geologic sequestration monitoring, reporting, and verification (MRV) plan
•	Approval or disapproval of a request for discontinuation of reporting
Appeal Submission
The definition of "interested person" can be found at 40 CFR 72.2. A person who does not own or operate a
facility covered by a final decision under 40 CFR Part 98, Subpart RR will need to submit his or her name to be
included by the Administrator on an "interested persons list" in order to be able to appeal—by filing a petition
for an administrative appeal—that final decision. In order to be included on the interested persons list for a
decision, please contact us at ghgreporting@epa.gov. Please include "Interested Persons List" in the subject
line.

Posting of Final Decisions
Final decisions of the Administrator under 40 CFR Part 98, Subpart RR are posted on the Subpart RR page
(http://www.epa.gov/ghgreporting/subpart-rr-geologic-seauestration-carbon-dioxide) of the Greenhouse
Gas Reporting Program website. Note that the actual, signed and dated final decision sent to the facility's
designated representative constitutes EPA's official response and governs. When a final decision is posted, EPA
is not aware of any differences between the posted final decision and the actual, signed and dated final decision.
EPA intends, and believes, that such differences - if any - will be minor and nonsubstantive. If you have
