AMENDMENTS TO THE AIR TOXICS STANDARDS FOR
SECONDARY ALUMINUM PRODUCTION
FACT SHEET
ACTION
•	On June 13, 2016, the Environmental Protection Agency (EPA) issued a direct final rule and
parallel proposal to amend its 2015 rule, limiting toxic air pollution from secondary
aluminum production.
•	This action corrects inadvertent errors, clarifies rule requirements for initial
performance tests and submittal of malfunction reports, provides an additional option
for new round top furnaces to account for unmeasured emissions during compliance
testing, and clarifies what constitutes a change in furnace operating mode. This action
also updates web site addresses for EPA's Electronic Reporting Tool (ERT) and the
Compliance and Emissions Data Reporting Interface (CEDRI). Specific clarifications the
EPA is making include the following:
o All existing and reconstructed round top furnaces are exempt from the
requirements to install temporary hooding during testing, use 80-percent
capture efficiency assumption, or petition EPA for an impracticability
determination
o The deadline for initial performance testing for new and reconstructed sources is
180 days after the applicable compliance date
o Allow new round top furnaces to account for unmeasured emissions during
compliance testing using an approach that is already available to uncontrolled
group 1 furnaces
o Update web site addresses for EPA's Electronic Reporting Tool (ERT) and the
Compliance and Emissions Data Reporting Interface (CEDRI)
o Reestablish paragraphs related to equipment accuracy and calibration that were
inadvertently deleted
•	The EPA is publishing these corrections and clarifications to ensure the requirements in the
2015 final rule are understandable to the regulated community. This action does not
impose additional costs and does not change environmental impacts of the rule.
•	These direct final rule technical amendments will be effective 90 days after publication of
the direct final rule in the Federal Register.
BACKGROUND
•	In 2015, the EPA published a final rule revising the air toxics standards for secondary
aluminum production based on the residual risk and technology reviews required under
the Clean Air Act.

• After publication of the final rule, the EPA received one petition for review from industry
requesting clarification and amendments to the rule in a few areas. This direct final
action addresses most of the issues raised in the petition.
HOW TO COMMENT
•	The EPA will accept comments for 45 days after the direct final action and parallel proposal
are published in the Federal Register.
