Introduction
The United States Environmental Protection Agency
(EPA) is requesting comment on its proposed permit
renewal for the Veolia Environmental Services Techni-
cal Solutions (Veolia) facility located at 5736 West
Jefferson St. in Phoenix, Arizona. The facility is
approximately six miles west of downtown Phoenix
and one mile south of Interstate 10 (1-10).
The proposed action is a renewal of a permit issued to
the facility by EPA in 1994. EPA's proposed permit
will allow Veolia to continue to manage poly chlorinat-
ed biphenyls (PCBs) under the Toxic Substances Con-
trol Act (TSCA). Activities conducted at the Veolia
facility include receiving, storing, processing, and
shipping PCB waste. The proposed permit renewal
will also cover procedures the Veolia facility must
follow to recover metals from PCB equipment for off-
site recycling.
EPA is also requesting public comment on its determi-
nation that historic properties will not be affected by
the permit decision, as required by Section 106 of the
National Historic Preservation Act (NHPA).
Proposed Decision
The proposed permit renewal for the Veolia facility in
Phoenix, Arizona includes conditions that must be
followed in order to comply with TSCA to safely store,
process, and ship PCB waste. An example of a condi-
tion in the permit is to ensure concrete surfaces are
sealed with epoxy coating to prevent PCB liquids from
leaching through. EPA also prepared a Statement of
Basis that summarizes and provides rationale for the
terms of the proposed permit. The Statement of Basis
is a part of the Administrative Record, and it is located

The proposed permit allows Veolia to:
•	Receive PCB-containing equipment and container-
ized PCB liquid waste;
•	Process certain PCB-contaming equipment at the
facility;
•	Store PCB waste at the facility;
•	Ship processed PCB waste for disposal off-site; and
•	Recover metals from the equipment and clean them
for shipping to an off-site recycling facility.

The proposed permit will also require Veolia to make
the following changes:
•	Collect wipe samples in PCB storage and other
areas of the facility on a quarterly basis to help
ensure that PCBs are not being tracked thoughout
the facility; and
•	Cease PCB ballast processing at the facility. PCB
ballasts received at the facility may be stored at the
facility but must be shipped off-site for processing
or disposal.
The proposed permit will be valid for ten years, and
includes the following requirements:
•	Regular worker health and safety training;
•	Monitoring requirements and regular reporting to
EPA;
•	Immediate notification to EPA if there are any PCB
spills over one pound; and
•	Procedures for modifying the permit conditions
(including seeking public comment on proposed
modifications).
Facility Inspections
EPA conducts unannounced inspections every two to
three years to ensure compliance with environmental
requirements and, when warranted, takes enforcement
actions. The Veolia facility was inspected by EPA in
Veolia Environmental Services Technical Solutions Facility-

2008 and 2010. Violations noted in the 2008 and 2010
inspections pertained to use, disposal, marking, and
labeling. EPA issued an Administrative Complaint on
April 30, 2013. Veolia resolved the violations that were
discovered during the 2008 and 2010 EPA inspections
and settled the violations with EPA.
Historic Properties Not Affected
EPA has made a determination under Section 106 of
the Nil PA that historic properties will not be affected
by renewal and modification of the proposed permit for
management of PCB wastes at the facility. This deter-
mination is further discussed in the Statement of Basis

Endangered Species

EPA has also determined under Section 7 of the Endan-
gered Species Act that management of PCB wastes at
the Veolia facility, as allowed in the permit, "will not
affect" any listed species or designated critical habitat.
This determination is further discussed in the State-
ment of Basis.
Next Steps in the
Permitting Process
EPA will make a final decision on the renewal of the
proposed PCB permit for Veolia after we have consid-
ered all public comments submitted during the 45-day
comment period. Anyone commenting on the proposed
decision will receive a copy of our response to com-
ments. The schedule for issuing the final permit
decision is shown in the figure below.
