A EPA i U.S. Environmental Protection Agency 4i Pacific Southwest, Region 9 Land Division September 2014 Fact Sheet Regarding RCRA Permit Decision Process For The Parker, AZ Evoqua Water Technologies LLC Facility (Formerly known as the Siemens Water Technologies LLC Facility) September 2014 Facility Summary Evoqua Water Technologies, LLC, (Evoqua), formerly known as Siemens Water Technologies, LLC, Siemens Industries, Inc., US Filter, US Filter Westates, and Westates, operates a carbon regeneration facility located on the Colorado River Indian Tribes (CRIT) Reservation near Parker, Arizona at 2523 Mutahar Street. Evoqua treats spent carbon in a regeneration furnace to purify it and make it a commercial product. Evoqua receives over 5,000 tons of spent carbon from 30 - 35 states across the United States. On average, about 11% of the spent carbon treated at the facility is considered hazardous waste and is regulated by US EPA. Please note that earlier documents, including some of the information on US EPA's website, might still show the earlier facility names. RCRA Regulatory History The US EPAis responsible underthe Resource Conservation and Recovery Act (RCRA) for permitting facilities that manage RCRA-regulated hazardous wastes in Indian country. US EPA first began regulating carbon regeneration furnaces as hazardous waste treatment facilities under RCRA in 1991. Several facilities were already operating or hadbegun construction of carbon regeneration furnaces, including the Evoqua facility (then known as US Filter Westates). These existing facilities were eligible for RCRA "interim status," which allowed these facilities to operate under RCRA's hazardous waste provisions while applying for a RCR4 hazardous waste permit. The Evoqua facility achieved interim status in August of 1991, and has, since that time, operated the facility subject to EPA's RCRA interim status hazardous waste regulations. The original RCRA permit application for the facility was submitted to US EPA in 1995. U S EPA reviewed the permit application, provided comments and requested additional information. A revised application was submitted to US EPA in February 2003, and US EPA responded with additional comments and requested additional information in 2005. Another revised application was subm itted to US EPA in 2007. Meanwhile, CRIT, the beneficial landowner of the tribal trust lands where the facility is located, submitted a certification as a co-applicant on the permit application in December of 2009. Serving Arizona, California, Hawaii, Nevada, the Pacific Island, and 148 Tribes 75 Hawthorne Street, San Francisco, CA 94105 800-EPA-WEST • www.epa.gov/region9 ------- Current Status US EPA transmitted another round of comments on the Part B application to Evoqua in September of 2011, and sent the facility comments on the Closure Plans and the Financial Assurance mechanism in December of 2011. The Part B application was revised to incorporate both sets of US EPA's comments, and was resubmitted to US EPA on April 26, 2012. US EPA sent additional comments to the facility operator on the April 2012 Part B application on May 15, 2014. Evoqua provided US EPA with a response to the comments and revised the Part B application on July 22, 2014, with additional information remaining to be submitted. After all information is received regarding the permit application, US EPA staff will review the revised permit application and the Agency will determine if the permit application is complete and technically adequate. US EPA will then make a proposed permit decision on whether to deny or grant the permit and open a 45 day Public Comment Period for its proposed permit decision. Since only about 11% of the spent carbon coming into the facility is considered RCRA hazardous waste, Evoqua could still continue to operate and regenerate non- hazardous carbon at the facility even if US EPA denies the facility's RCRA permit. Community Involvement US EPA invites members of the public who have questions, concerns or comments about the facility, the permit decision process or any other matter pertaining to the facility's management of hazardous waste at anytime to contact the Project Manager, Mike Zabaneh, whose contact information is listed below. After the proposed permit decision is made, US EPA will hold a public meeting in Parker, Arizona and will provide information about the facility and respond to any additional community questions or concerns at that time. In conjunction with that public meeting, US EPA will also schedule a formal public hearing so that members of the public may provide comments on the proposed permit decision in person directly to the Agency officials attending the hearing. Members of the public may also submit written comments to US EPA about the proposed permit decision at any time during the public comment period.
