Pio Pico Energy Center - Final PSD Permit Issuance

Action

•	On February 28, 2014, U.S. EPA Region 9 issued a final Prevention of Significant Deterioration
(PSD) permit to Pio Pico LLC (PPLLC) for the Pio Pico Energy Center (PPEC or Project).

•	The Project consists of three General Electric (GE) LMS100 natural gas-fired combustion turbines
(CTs) with a total net generating capacity of 100 megawatts each. The proposed location for the
Project is an unincorporated area of San Diego County known as Otay Mesa.

•	In November of 2013, in response to an Order from EPA's Environmental Appeals Board, Region 9
prepared a revised particulate matter (PM) Best Available Control Technology (BACT) analysis
and proposed revisions to the PPEC's PSD permit.

o In addition, Region 9 reopened the public comment period to take comment on our revised
PM BACT analysis and revised permit conditions. A public hearing was held in San Ysidro,
California on December 17, 2013.

•	Based on EPA's revised analysis, we proposed the following changes to the PPEC's PSD Permit:

o Revise the 0.0065 lb/MMBtu PM limit to 0.0053 lb/MMBtu

o Revise the 5.5 lb/hr PM limit to 5.0 lb/hr

o Revise the PM testing conditions to require collecting a minimum 120 cubic dry standard
cubic feet (dscf) per test run (equivalent to a 4 hour test run) from 90 dscf per test run
(equivalent to a 3 hour test run)

•	EPA carefully reviewed each of the comments submitted during the public comment period and,
after consideration of the expressed views of all commenters, the pertinent Federal statutes and
regulations, and additional material relevant to the application and contained in our
Administrative Record, EPA made a decision in accordance with 40 CFR 52.21 to issue a final PSD
permit to PPLLC.

o The proposed changes to the permit were finalized as part of our final decision.
