TOUTED STATES ENVIRONMENTAL PROTICTION AGENCY REGION 4 Notice of Final Determination of Permit Issuance for Clean Air Act Permit to Construct DPA-EPA-R4001 Port Dolphin Energy, LLC On October 14,2011, the Region 4 office of the U.S. Environmental Protection Agency requested public comment on a draft Clean Air Act (CAA) Prevention of Significant Deterioration (PSD) air permit for Port Dolphin Energy, LLC (Port Dolphin). The permit will regulate air pollutant emissions from the operation of a liquefied natural gas (LNG) deepwater port located in federal waters of the Gulf of Mexico, approximately 28 miles off the west coast of Florida, and 42 miles southwest of the pipeline landing at Port Manatee, Florida, The EPA is responsible for implementing and enforcing CAA requirements, including PSD permitting requirements for deepwater ports in federal waters that are outside state seaward boundaries. Pursuant to the CAA and the applicable air quality regulations for the State of Florida, a new source is required to obtain an air quality permit before beginning construction. The permit incorporates the applicable requirements from the federal and Florida Department of Environmental Protection (FDEP) air quality regulations. The EPA prepared a preliminary determination and statement of basis document that explains the derivation of the permit conditions. The preliminary determination and the draft permit are available on the EPA Region 4's website at: http://www.epa.gov/remon4/air/permits/LNGPermits/LNGpermits.html. During the public comment period, which ended on November 14,2011, the EPA received no comments. After consideration of the pertinent federal and state statutes and regulations, the application and additional material relevant to the application and contained in the administrative record, the EPA has made a final determination in accordance with the provisions of the Deepwater Port Act (DP A) of 1974, as amended, 33 U.S.C. § 1501 et seq., and in accordance with the provisions of Title I of the Federal Clean Air Act (CAA), 42 U.S.C. §§ 7401 et seq., and applicable rules and regulations approved or promulgated under the CAA, including air permitting rules promulgated by the Florida Department of Environmental Protection (FDEP), to issue an air permit to Port Dolphin for their proposed deepwater port. Section 307(b)(1) of the CAA provides for review of final Agency action that is locally or regionally applicable in the United States Court of Appeals for the appropriate circuit.
