Smithfield Recycle Center (SRC), located in Smithfield, Kentucky. SRC is seeking approval for the continued management of chemicals called polychlorinated biphenyls (PCBs) at the facility. The environmental activities identified in the draft Toxic Substance Control Act (TSCA) PCB Approval include the commercial storage of PCB waste. This is a proposed ten-year renewal of SRC's current authority to store PCBs. The purpose of the Approval is to ensure the facility operates in a manner that protects human health and the environment and complies with federal regulations. This PCB Approval renewal action covers environmental activities related to PCB waste. Hazardous waste activity regulated under the Resource Conservation and Recovery Act (RCRA) at SRC is regulated under a separate permit issued by Kentucky Department for Environmental Protection (KDEP). This fact sheet provides an opportunity to learn more about the TSCA Approval process, as well as the upcoming public comment period. The main subject of this notification is a TSCA PCB Approval document. Public Comment Period The EPA is committed to fostering meaningful public involvement in environmental decision making. The draft TSCA PCB Approval document is open for a 30-day public comment period from January 29, 2020 to February 28, 2020. On page 2 of this document, under "For More Information," you will find the link to the draft TSCA PCB Approval document on EPA's public notice website and the address of where the hard copy of the draft Approval and application is located. The public may provide written comments during the 30-day comment period. Please submit your comments by letter or email, postmarked by the deadline to EPA's Technical Project Manager (contact information on page 2). EPA will evaluate public input and finalize its decision after responses have been prepared to all written comments received. What is TSCA? TSCA stands for the Toxic Substances Control Act regulations. The Toxic Substances Control Act of 1976 provides EPA with authority to require reporting, record- keeping and testing requirements, and restrictions relating to chemical substances and/or mixtures, which include PCBs. We want to hear from you! The 30-day public comment period for the proposed PCB Approval is: January 29, 2020 to February 28, 2020. Follow the instructions on p. 1 to submit your comments. ------- Background Under the TSCA regulations, SRC must obtain a PCB Approval from the EPA, to receive PCB waste from off-site and to store the PCB waste at its facility. SRC has applied for a renewal of its pre- existing approval. The EPA has reviewed SRC's application for operation of the Smithfield facility. The draft PCB Approval document lists the maximum volume of PCB waste that may be stored for disposal in designated areas at SRC. It's proposed that PCB waste may be stored in 55-gallon containers, shipping containers or non-leaking units legal for shipping as is, within the single location in the main warehouse. PCBs and PCB waste must be stored in a manner that presents no unreasonable risk of injury to health and the environment and that does not impede routine inspections carried out by SRC as required by this Approval. The draft TSCA PCB Approval is comprised of four Sections: • General Information - SRC must operate its facility in compliance with the conditions of the Approval and consistent with the information included in SRC Application and in accordance with TSCA and the PCB Regulations, including the requirements of the "PCB Spill Cleanup Policy" (found at 40 C.F.R. Part 761); • Commercial Storage Operations - The PCB storage areas must meet certain inspection requirements and maintain proper engineering standards to prevent chemical releases. SRC may store PCBs and PCB Items in a manner that allows maximum use of space, it is noted PCB storage in any other non- designated area will be a violation of the Approval; • Storage Capacity - The maximum storage capacity for PCBs and PCB waste is limited to the designated storage area for a total of 13,750 gallons; and • Closure - SRC will maintain and operate the facility in a manner that prevents the likelihood of fire, explosion, and release of PCBs to the environment, and the exposure of workers to PCBs. The draft TSCA Approval is scheduled to be issued for ten years. The EPA has the authority to suspend or revoke the PCB TSCA Approval at any time when the EPA has reason to believe that the continued operation of this facility presents an unreasonable risk to human health or the environment. At this time, the EPA has determined that the commercial storage of PCB waste is in accordance with the draft TSCA PCB Approval Conditions and will not pose an unreasonable risk of injury to human health or the environment.
