National Emission Standards for Hazardous Air Pollutants for
Chemical Recovery Combustion Sources at Kraft, Soda, Sulfite,
and Stand-Alone Semichemical Pulp Mi Is

This action finalizes the residual risk and technology
review conducted for the chemical recovery
combustion sources at kraft, soda, sulfite, and stand-
alone semichemical pulp mills regulated under the
national emission standards for hazardous air
pollutants. EPA is finalizing its proposed
determination that risks from the source category are
acceptable and that the standards provide an ample
margin of safety to protect public health. We are
also finalizing amendments to the NESITAP based
on developments in practices, processes, and control
technologies identified as part of the technology
review. These final amendments include revisions to
the opacity monitoring provisions and the addition
of requirements to maintain proper operation of the
electrostatic precipitator automatic voltage control.
Additional amendments are also being finalized
including the requirement to conduct five-year
periodic emissions testing, and submit electronic
reports; revisions to provisions addressing periods of
startup, shutdown, and malfunction; and technical
and editorial changes. These amendments are made
under the authority of the Clean Air Act (CAA) and

will improve the effectiveness of the rule. For

Air Plan Approval: South Carolina; Standards for Volatile Organic

Compounds and Oxides of Nitrogen

Due to the receipt of an adverse comment, the Environmental Protection Agency (EPA) is withdrawing a portion
of the August 16, 2017, direct final rule that approved changes to South Carolina's state implementation plan
related to the regulation of volatile organic compounds and oxides of nitrogen. EPA addressed the comment in a
separate final action based upon the proposed rulemaking action, published on August 16, 2017. EPA will not
institute a second comment period on this action. For further information, contact: Brad Akers, at

Air Plan Approval; Florida; Stationary Sources Emissions Monitoring

The Environmental Protection Agency (EPA) approved a portion of a State Implementation Plan (SIP) revision
submitted by the State of Florida, through the Florida Department of Environmental Protection (FDEP) on
February 1, 2017, for the purpose of revising Florida's requirements and procedures for emissions monitoring at
stationary sources. Florida's February 1, 2017, SIP submittal included amendments to three Florida
Administrative Code (F.A.C.) rule sections, as well as the removal of one F.A.C. rule section from the Florida
SIP in order to eliminate redundant language and make updates to the requirements for emissions monitoring at
stationary sources. Additionally, this action included a correction to remove an additional F.A.C. rule that was
previously approved for removal from the SIP in a separate action but was never removed. EPA acted on
Florida's February 1, 2017, SIP submittal as a direct final rule without prior proposal because the Agency views
this as a noncontroversial submittal and anticipates no adverse comments. This action was taken pursuant to the

Delaware's New Dry Cleaner Permits

Delaware Dept. of Natural Resources and Environmental
Control's Division of Air Quality has overhauled the
Perchloroethylene Dry Cleaner Source Category Permits. The
permits were updated to clarify permit language and remove
references to outdated technology no longer in use in
Delaware. Additionally, facility size classifications have been
removed and the previous permit variations are now
consolidated into one dry cleaner permit. The requirement to
accurately record the pounds cleaned per load is reinforced
and is now more prominently stated in the new permit.

Division staff enlisted the help of the Small Business
Ombudsman to develop a fact sheet that is being distributed

along with the permit. In addition to explaining why the new permits were developed, the fact sheet contains
a list of important things to remember and a list of the top non-compliance issues. Also being distributed is a
hazardous waste management fact sheet developed specifically for dry cleaners. The new permits are being
hand delivered to facilities and the hope is to have all 45 delivered by the middle of 2018. For more

ASBO News

Office of Water (OW) Small Entity Webinar and Public Hearing: ASBO facilitated a small entity
outreach meeting on behalf of EPA's Office of Water (OW). The September 19, 2017 outreach webinar
was held for small entities for the pre-proposal rulemaking on Waters of the U.S. There were
approximately 140 participants. Mike Shapiro, Acting Assistant Administrator for OW, provided
welcoming remarks, followed by OW's Mindy Eisenberg who provided a brief background presentation.
ASBO then facilitated the oral input provided by the small entity participants. ASBO will also host and
facilitate an in-person public meeting for small entities at EPA Headquarters on Monday, October 23,

National Ombudsman Hearing: ASBO is coordinating Agency responses to written concerns submitted

Agency (EPA) is extending the comment period for
the notice, "Request for Public Comments To Be
Sent to EPA on Peer Review Materials To Inform
the Safe Drinking Water Act Decision Making on
Perchlorate." In response to stakeholder requests,
EPA is extending the comment period for the "Draft
Report: Proposed Approaches to Inform the
Derivation of a Maximum Contaminant Level Goal
for Perchlorate in Drinking Water" (draft MCLG
Approaches Report)" an additional 21 days, from
October 30, 2017, to November 20, 2017.

SUMMARY: The Environmental Protection
Agency (EPA) is taking final action to approve
revisions to the Kentucky State Implementation Plan
(SIP), submitted by the Commonwealth of
Kentucky, through the Kentucky Division for Air
Quality (KDAQ), on March 21, 2011, October 29,
2013, October 28, 2016, and March 24, 2017. The
revisions were submitted by KDAQ on behalf of the
Louisville Metro Air Pollution Control District,
which has jurisdiction over Jefferson County,
Kentucky. The revisions include changes to
Jefferson County Regulations regarding Reasonably
Available Control Technology (RACT) for two
major sources of nitrogen oxides (NOx) and the
removal of a volatile organic compounds (VOC)
bubble rule.
