23 February 2001 FACT SHEET National Emission Standards for Hazardous Air Pollutants: Publicly Owned Treatment Works - Final Rule Corrections TODAY'S ACTION... ! The Environmental Protection Agency (EPA) is correcting the October 1999 promulgated rule. These corrections do not change the emission control requirements or the impact of the rule. ! The action corrects grammatical, typographic, formatting, and cross-reference errors. SUMMARY OF THE CORRECTIONS TO THE EPA'S PUBLICLY OWNED TREATMENT WORKS RULE ! The action corrects an error in §63.1589 (a) where we incorrectly cross-reference performance standards (i.e., §63.1586 (b)) instead of the intended equipment standard provisions (i.e., §63.1586 (a)). ! The amendments correct typographic and formatting errors. BACKGROUND ! The EPA promulgated National Emission Standards for Hazardous Air Pollutants (NESHAP) for Publicly Owned Treatment Works (POTW) on October 26, 1999 (see 64 FR 57572). ! Emissions of HAP from POTW facilities occur during the treatment of wastewater received from residential and commercial sources and industrial sources. ! In developing these NESHAP, the EPA established two source "subcategories": (1) the industrial POTW treatment plants subcategory, which comprises the wastewater treatment portion of POTW used by industry to treat their specific industrial waste streams to meet other regulations under the Clean Air Act (e.g., benzene waste operations NESHAP, hazardous organic NESHAP); and (2) the non-industrial POTW treatment plants subcategory, which comprises the wastewater treatment portion of all other POTW that are major sources. ENVIRONMENTAL BENEFITS OF EPA'S CORRECTIONS TO THE PTTBLTCLY 1 ------- OWNED TREATMENT WORKS RULE ! Today's corrections will not change the costs or emission reductions of the final rule issued in October 1999. AFFECT ON INDUSTRY !
