National Emission Standards for Hazardous Air Pollutants: Municipal Solid
Waste Landfills Residual Risk and Technology Review; Correction: Fact Sheet

ACTION

•	On January 11, 2021, the US. Environmental Protection Agency (EPA) proposed technical
revisions and clarifications for the National Emission Standards for Hazardous Air
Pollutants (NESHAP) for Municipal Solid Waste (MSW) Landfills established in the March
26, 2020, final rule.

•	In this action, EPA is proposing technical revisions and clarifications. These changes
correct inadvertent errors and clarify:

o Wellhead monitoring requirements for the purpose of identifying excess air
infiltration;

o Delegation of authority to state, local or tribal agencies for "emission standards";
o Applicability of the General Provisions to affected MSW landfills; and
o Handling of monitoring data for combustion devices during periods of

monitoring system breakdowns, repairs, calibration checks and adjustments.

•	Additionally, EPA is proposing further amendments to the MSW Landfills New Source
Performance Standards (NSPS) at 40 CFR part 60, subpart XXX, to clarify the timing of
compliance for certain requirements for existing MSW landfills that have modified, but
previously triggered, the requirement to install a gas collection and control system
under related MSW landfill rules.

BACKGROUND

•	On March 26, 2020, EPA issued a final rule for the residual risk and technology review
(RTR) of the NESHAP for MSW Landfills. The Landfills NESHAP, subpart AAAA, was
promulgated pursuant to section 112(d) of the Clean Air Act in January 2003.

•	On October 13, 2020, EPA corrected inadvertent errors in the cross-referencing and
formatting in the Federal Register; as well as clarifies two operational and reporting
requirements in the March 26, 2020, final rule.
