EPA's e-Manifest program
remains committed to robust
and engaging communication
with stakeholders.

The purpose of this bulletin is
to provide a digest of
e-Manifest news, including
newly released and upcoming
functionality. This bulletin is
designed to complement
monthly public webinars,
the e-Manifest website, and
iistserv communications.

Highlights

Open Public Comment Period fore-Manifest's Proposed Rule

The EPA Administrator signed
e-Manifest's proposed "Third
Rule" on March 1, 2022, and it
was published in the Federal
Register on April 1, 2022. The
60-day public comment
period for this proposed rule
will end on May 31, 2022.	•

This rule proposes to amend
certain aspects of the
hazardous waste manifest
regulations under RCRA,
specifically concerning the •
e-Manifest system, and
addresses the following:

•	Incorporating hazardous
waste export manifests
into the e-Manifest
system, which includes
designating the exporter
as the entity responsible
for submitting the
manifest and paying the
requisite user fee.

•	Expanding the required
international shipment

data elements on the	•

manifest form.

•	Revising the movement
document requirements

to improve manifest
tracking, as well as to
assist with integration of
EPA's Waste Import
Export Tracking System
(WIETS) into RCRAInfo.

Revising aspects of the
manifest form to improve
compliance with import
and export consents and
tracking requirements.

Regulatory changes
regarding Exception
Reports, Discrepancy
Reports, and
Unmanifested Waste
Reports, which includes
using the system to
identify when reports
may be required,
allowing electronic
submittal of required
reports in e-Manifest,
and adjusting timeframes
to account for EPA's
Paper Processing Center.

Conforming changes to
PCB manifest regulations
under the Toxic
Substances Control Act

(TSCA), and other
technical corrections to
remove obsolete
requirements, correct
typographical errors,
establish definitions, and/
or improve alignment
with the e-Manifest
program.

• Discussion regarding
potential future
integration of the
e-Manifest system with
Biennial Reporting
requirements.

EPA Planning for Upcoming e-Manifest Advisory Board Meeting

EPA accepted nominations
for the Hazardous Waste
Electronic Manifest System
Advisory Board from
December 14, 2021, to
January 13, 2022.

EPA anticipates selecting
new members to serve on
the Advisory Board by
spring/summer 2022.

A major goal of the
e-Manifest program is to
increase electronic manifest
adoption. EPA hosted two
public meetings on October
27 and November 3, 2021,
to solicit feedback from

stakeholders on how to
increase electronic
adoption. The meetings
covered current electronic
manifest functionality and
the feasibility of several
potential policy options.

As a next step in this effort,
EPA expects to convene its
next public meeting of the
e-Manifest System Advisory
Board in the fall of 2022.
The meeting will include
discussion of the comments
EPA received from the
public meetings, as well as
related policy and technical

changes EPA is considering
for the e-Manifest system
in view of the comments
received. The purpose of
this meeting is for the
Board to advise the Agency
on these potential changes
with the aim of increasing
the use of electronic
manifests.

Data Quality Corner: the Five W's of e-Manifest Corrections

A useful and empowering
feature of the e-Manifest
system is the ability it
provides to all hazardous
waste handlers to make
post-receipt manifest
corrections. To help convey
the value of this feature, we
can break down the
e-Manifest corrections
process into the 5 W's
(who, what, when, where,
and why!):

1. Why should I make
corrections? Accidents will
happen, and the
digitization of the paper
manifest when submitted
to the e-Manifest system is
no exception. A fat-
thumbed waste quantity or
EPA ID number entry,
uploading the wrong pdf,
or forgetting to include
information in the digital
copy can prove a headache
for you and others later
down the road. Whether it's

an accident or not, the data
affiliated with your sites
matter and are used for
numerous purposes by
regulators and industry.
Ensuring that your sites
remain in compliance is
time well spent.

2.	Where can I make
corrections? Online in
RCRAInfo at https://
rcrainfo.epa.gov! Just
navigate to the manifest in
question and click to make
corrections.

3.	When can I make
corrections? Anytime after
the manifest has been
submitted to the
e-Manifest system by the
designated receiving
facility. If the receiving
facility submitted the
manifest as a scanned
image only, it will need to
be processed by the EPA
Paper Processing Center

first.

4.	Who can make
corrections? Any RCRAInfo
registered user that is
affiliated with one of the
EPA ID numbers listed on
the manifest and with at
least "Certifier" level access
to the e-Manifest module
for that site. RCRA-
authorized state programs
where the handlers are
located can make
corrections as well.

5.	What fields can be
corrected? e-Manifest only
prevents corrections on two
fields of the manifests once
submitted: Field 8, The
Designated Receiving
Facility information (for
billing purposes) and field
4, the Manifest Tracking
Number (MTN). All other
fields can accept
corrections.
