Advancing Watershed Protection
Through Land Conservation:

Eligibilities & Approaches in the Clean Water Act
Section 319 Program

Clean Water Act Section 319

Congress enacted Section 319 of the Clean Water Act in 1987, establishing a national program to control
nonpoint sources of water pollution. Through Section 319, the U.S. Environmental Protection Agency
(EPA) awards grant funding to states, territories and Tribes to implement their nonpoint source (NPS)
programs. NPS programs can include regulatory or
nonregulatory programs, technical assistance,
financial assistance, education, training, technology
transfer, watershed projects and monitoring to assess
the success of specific NPS implementation projects.

Collectively, this work has restored over 12,300 miles
of rivers and streams and over 230,000 acres of lakes
and other waters across the United States.

NPS pollution, unlike pollution from
industrial and sewage treatment plants,
comes from many diffuse sources. NPS
pollution is caused by rainfall or snowmelt
moving over and through the ground. As the
runoff moves, it picks up and carries away
natural and human-made pollutants, finally
depositing them into lakes, rivers, streams,
wetlands, coastal waters and ground waters.

How NPS Programs Work

Each state implements its NPS program consistent

with an EPA-approved NPS Management Program Plan. States implement their NPS program with
Section 319 funding support, which ranges from approximately $1 million to $9 million per state per
year based on the EPA's national allocation formula. States are required to provide 40 percent non-
federal cost share/match to their Section 319 grant. Match funds are subject to the same eligibility
restrictions as Section 319 funds. Each state must use at least 50% of its Section 319 grant for local
projects that support the implementation of watershed-based plans (WBPs). Most states issue annual,
competitive requests for proposals from local partners to implement Section 319-funded watershed
projects. Consistent with EPA guidance, states primarily target Section 319 funding to restore
waterbodies impaired by NPS pollution. States may
also use Section 319 funds to protect healthy waters,
consistent with the goals of their NPS Management
Program Plan. Land conservation can play a key role
in efforts to protect healthy waters threatened by
NPS pollution, as well as complement work to
restore NPS-impaired waters.

Land conservation (or land protection)

generally refers to the long-term protection
of lands to maintain conservation benefit(s)
provided by a property, such as water quality
protection, wildlife habitat, or recreation.

Who is working to conserve lands?

There are many non-governmental and governmental entities across the United States working to
conserve lands. According to the Land Trust Alliance, there are an estimated 1,200 land trusts

Land Conservation Eligibilities in the Clean Water Act Section 319 Program

Land conservation can help achieve water quality goals by preserving natural areas, such as forests,
riparian areas, and wetlands, that can serve as natural filters for NPS pollutant loadings across the
landscape. Additionally, land conservation can prevent local land use changes that may result in higher
NPS pollutant loadings.

Section 319 funds may be used to support the following land conservation approaches, provided that
these approaches are consistent with a state's EPA-approved NPS Management Program Plan.
Administrative and legal costs associated with land conservation projects may be eligible for Section 319
funding. Please note that the following definitions are provided for general informational purposes only,
and states and subrecipients should consult their state and local laws for any applicable legal definitions
of these terms:

Note that if a property purchased using Section 319
funds will be later sold and no longer used for its land
conservation purpose consistent with the Section 319
grant, federal property disposition requirements may
apply to a subrecipient's sale of the property. See 2
CFR 200.311. On existing conserved lands, Section 319
funds can also be used to implement NPS projects that
protect or improve water quality such as managing
runoff, restoring stream channels and riparian areas,
and tree plantings. Because each state identifies its
NPS program priorities, the funding of eligible projects
may vary according to the priorities of each state.

Purchase of Conservation Easements: A voluntary legal agreement that permanently restricts
development of a property to protect identified conservation benefits. Landowners retain the right
to own, use, and sell the parcel, consistent with the terms of the conservation easement.

Leasing of Land; Legal arrangement in which a landowner acting as lessor rents land to a tenant
acting as lessee.

Fee Simple Land Purchase: Purchase of complete ownership of land with the right to possess, use,
and dispose of the land at will, subject to any
recorded restrictions, such as easements, and
applicable property laws, such as local zoning
ordinances.

Habitat Conservation Priority Map, Back Creek Watershed WV

West Virginia's Back Creek Watershed Protection Plan identifies
priority forest parcels for protecting water quality and ecological
assets, as well as prevent increased flooding and erosion.

When purchased with non-federal funds or
donated by a landowner, the value of conserved
lands (i.e., conservation easement value, or total
land value) may be used to meet the Section 319

non-federal match requirement. Easements are generally considered to be a type of interest in real
property and can be used as in-kind match. See the federal grant regulations in 2 CFR. 200.306 for
specifics on cost-sharing. As with other in-kind contributions, the monetary value of the easement
would need to be calculated to be counted towards non-federal match.

Land Conservation Projects in the Clean Water Act Section 319 Program

Since 2004, 18 states have reported more than 900 conservation easements to the EPA's Section 319
Grants Reporting and Tracking System (GRTS), representing more than 100,000 land acres protected
with Section 319 grants, match funds, and/or other leveraged funding (Table 1, Appendix A). Lands
protected through these projects have included forests, wetlands, riparian areas, shorelines, and
agricultural land.

Getting Started Tips: Incorporating Land
Conservation in NPS Work

Learn where land conservation efforts are underway
within your state, and who is leading them.

•	The Protected Areas Database (PAD-US) is the
official national inventory of protected areas.

•	The Land Trust Alliance's Find A Land Trust tool
provides information on land conservation
organizations by location, conservation priorities,
acres protected, and other filters.

Consider how land conservation can help achieve
goals outlined in your State NPS Management
Program Plan. Want to learn how states are currently
incorporating land conservation in their plans?
Michigan. Ohio, and South Carolina are good places to
start!

Encourage local partners to incorporate land
conservation in WBPs, where appropriate.

•	Identify priority parcels, based on their ability to
protect waters (e.g., proximity to waterbodies,
development threat).

•	Quantify NPS pollutant loads that can be
prevented by conserving lands (e.g., via EPA's
Pollutant Load Estimation Tool).

Explore partnerships to augment funding for land
conservation, such as the Clean Water SRF Program.
Drinking Water SRF Program, and USDA-NRCS
Easement Programs.

NPS Land Conservation Project Spotlights

South Carolina

In support of its goal to prevent NPS-reiated impairments of unimpaired waterbodies, South Carolina's
2020-2024 NPS Management Program Plan includes a focus on state coordination with watershed
groups, land management agencies, and land trusts to protect healthy waters. Additionally, the Plan
includes a NPS program milestone to incorporate protection strategies, such as conservation easements,
into ail WBPs developed within the state.

Project Spotlight: South Carolina awarded a
total of $773,804 in Section 319 funds across
two project phases in 2018 and 2021 to
Upstate Forever, a nonprofit conservation
organization, to support implementation of the
Watershed-Based Plan for the South. Middle,
and North Tyger Subwatersheds. The WBP
prioritized the protection of lands in good
condition to benefit water quality and limit
future impairments. The project included the
purchase of conservation easements on
approximately 450 acres of high priority
undeveloped riverfront land. By preventing
potential land use conversion, this project
prevents an estimated 1,309 lbs of nitrogen,
122 lbs of phosphorus, and 30.2 tons of
sediment from entering adjacent waterways
each year (calculated using state pollutant
loading model). This project also supported
implementation of other BMPs in the
watershed, including septic repair and stream
bank enhancements, to address existing
waterbody impairments. Project partners
emphasize the role of conservation easements
in complementing other BMPs and preventing
further water quality degradation in the future.

Michigan

Michigan's 2019-2023 NPS Program Management Plan includes statewide targets for total acreage and
linear feet of river, lake and wetland protected in priority watersheds, primarily via conservation
easements. In addition, the Plan includes statewide targets for sediment, nitrogen, and phosphorus
reductions achieved as a result of long-term protection practices implemented in priority watersheds.
Michigan's NPS Program has partnered with land conservancies across the state to protect healthy rivers
and lakes through conservation easements for over 25 years. This work has resulted in 274 conservation
easements totaling over 22,000 acres, including over 416,000 linear feet of rivers and lakes protected.

Project Spotlight: In 2019, Michigan's NPS
Program awarded a state Clean Michigan Initiative
(CMI) grant, used as non-federal 319 match, to the
Grand Traverse Regional Land Conservancy
(GTRLC) to facilitate the purchase of a large parcel
encompassing 900' of frontage to Lake Skegemog
and 1,400' of tributary frontage. This project
supported implementation of the Grand Traverse
Bay Watershed Protection Plan, an EPA-approved
WBP focused primarily on preventative protection
of priority watershed areas through conservation
easements. This project prevents erosion, as
sections of the 192-acre property are situated on
sloping hillsides adjacent to Lake Skegemog. By
preventing potential land use conversion, this
project prevents an estimated 537 lbs of nitrogen,

67 lbs of phosphorus and 3 tons of sediment from
entering nearby Lake Skegemog each year
(calculated using the EPA's STEPL tool).

Additionally, this newly protected parcel creates a
continuous 525-acre wildlife corridor by
connecting two existing nature preserves.
