FACT SHEET Proposed Amendments to Automobile and Light Duty Truck Surface Coating Operations New Source Performance Standards ACTION • On April 29, 2022, the U.S. Environmental Protection Agency (EPA) proposed to amend the New Source Performance Standards (NSPS) for Automobile and Light Duty Truck (ALDT) Surface Coating Operations and proposed a new NSPS subpart. • The current ALDT NSPS subpart (40 CFR 60 subpart MM) applies to sources that were new, modified, and reconstructed after October 5, 1979, and before the Federal Register publication date of this proposed action. • For subpart MM, we are proposing the addition of electronic reporting of performance test results and semiannual compliance reports. • The new ALDT NSPS subpart (40 CFR 60 subpart MMa) would apply to sources that are new, modified, and reconstructed on or after the Federal Register publication date of this proposed action. Proposed amendments to be included in the new subpart MMa include: o Revised volatile organic compound (VOC) emission limits for the three primary automobile and light duty truck surface coating operations: the prime coat, guide coat, and topcoat operations; o Addition of work practices to minimize fugitive VOC emissions; o Revision of the exemption that applies to the coating of all-plastic bodies; o Addition of control devices, control device testing, and monitoring requirements; o Revision of the coating transfer efficiency provisions; o Addition of periodic performance testing of control devices once every five years; o Revisions to clarify the SSM provisions; and o Addition of electronic reporting of performance test results and semiannual compliance reports. • The proposed new subpart MMa will ensure national consistency and will provide a new baseline for future best achievable control technology (BACT) and lowest achievable emission rate (LAER) determinations for ALDT surface coating operations. • EPA expects the proposed new NSPS subpart will be beneficial for local populations due to the more stringent standards. • EPA will accept comment on the proposed amendments for 60 days after publication in the Federal Register. NSPS REVIEW • The Clean Air Act (CAA) section 111 requires EPA to review and revise, as necessary, the NSPS at least every eight years. • EPA's review of the current ALDT NSPS subpart focused on whether there are any emission reduction techniques that are used in practice that achieve greater emission reductions than those currently required for ALDT surface coating operations and whether any of these techniques have become the BSER. • EPA has determined that there are emission reduction techniques used in practice that achieve greater emission reductions than those currently required by the NSPS for ALDT surface coating operations. 1 ------- BACKGROUND • On December 24, 1980, EPA promulgated the NSPS for ALDT surface coating (subpart MM), establishing standards of performance to limit emissions of VOC emissions from new, modified, and reconstructed (after October 5, 1979) automobile and light duty truck surface coatings operations. • The ALDT NSPS established VOC emission limits for the three primary surface coating operations at automobile and light-duty truck assembly plants, the prime coat, guide coat, and topcoat operations. • Other actions affecting this source category include the 2004 ALDT National Emission Standards for Hazardous Air Pollutants (NESHAP), the 2008 ALDT Control Techniques Guidelines update, and the 2020 Risk and Technology Review. • There are currently 44 ALDT assembly plants in the Unites States subject to the current NSPS.
