Introduction

This "TSDF Toolkit" serves as a user-friendly
reference to assist permit writers and permittees in
locating and understanding the Hazardous Waste
Treatment, Storage, and Disposal Facilities (TSDF)

Regulations promulgated under the Resource
Conservation and Recovery Act (RCRA).

These requirements are primarily located in Title 40
Code of Federal Regulations (CFR) Part 264 for
permitted facilities and Part 265 for interim status
facilities. The requirements as laid out in this
reference document are organized by the type of
hazardous waste management activity, which
encompasses hazardous waste treatment, storage,
and disposal in specific units (containers,
incinerators, landfills, land treatment, surface
impoundments, tank systems, and waste piles).

The objective of this document is to consolidate the references for TSDF regulatory requirements into a
helpful reference tool including links to references and guidance documents that EPA has provided to the
public to help owners, operators, and state and federal regulatory officials interpret the existing TSDF
regulations. This document does not change any of the existing TSDF regulatory requirements.

How to Use This Tool

This document is navigable in several ways. First,
permit writers and permittees can use the "Summary
Chart of Permitting Regulations" to link directly to the
regulatory citation of interest.

Secondly, permit writers and permittees can take
advantage of the Table of Contents or the bookmarks to
navigate through the body of the document. The Table of Contents and bookmarks include resources for
management at hazardous waste units (i.e., containers, tank systems, drip pads, surface impoundments,
waste piles, land treatment, landfills, containment buildings, and incinerators). In, addition, some
resources will be applicable to all categories of TSDFs. Readers can use the Table of Contents and
bookmarks to navigate by left-clicking the mouse on the link of interest to move within the document.

To help readers better understand specific requirements, we also have provided, where applicable, links
to resources including training materials, letters, and memoranda issued by EPA, as well as guidance
documents developed by EPA that provide further clarification of the TSDF regulations and permitting
process.

Note: This web-based document is not a substitute
for the CFR itself, the requirements in the CFR, or
State requirements (that may be different from
those reflected herein). This document references
existing policy documents. Additionally, this
reference document presents only the federal
requirements for TSDFs. Most states are
authorized to implement their hazardous waste
program.

Therefore, states may have their own set of
regulations that apply in lieu of federal regulations,
and while most state TSDF regulations are based
on the federal requirements, some states have
developed regulations more stringent than the
federal program. Go to the state permitting
websites to access state regulatory programs.

Note: The Primary RCRA Permitting
references are included, but EPA has not
captured every relevant document. Also, the
documents included in this tool have already
been issued and are in the public domain, but
they might not be the most current version.

Overview of the Hazardous Waste RCRA Permitting Processes

(Flowcharts)

The following RCRA permitting process flowcharts identify agency actions, permittee actions, and public
participation actions for the following processes:

•	Issue an Operating Hazardous Waste Permit (Initial or Renewal)

•	Modify a RCRA Hazardous Waste Permit

Refer to the Public Participation Materials for additional information and guidance on how to implement
public participation activities throughout the RCRA permitting and corrective action processes. In addition,
state regulations, as adopted, may vary.

The regulations for the main permitting "decisionmaking" processes are located in 40 CFR part 124 for the
RCRA hazardous waste permitting flowcharts while the regulations for the facility-specific requirements in
the permit are mainly in 40 CFR parts 264 and 270. (Permit modifications regulations are in Part 124 and
Part 270.)

* The permitting Agency may need additional information from the facility in order to make a decision and these interactions can be lengthy. The Permitting Agency may also determine that the class should be higher or lower (or decide if a Class
1 needs prior approval) based on the change being made. The separate temporary authorization process can be used for Class 2 or 3 as appropriate (although not referenced in the Class 3 process above).

Boilers and Industrial Furnaces - RCRA, Superfund & EPCRA Hotline Training Module: Introduction to:
Boilers and Industrial Furnaces (40 CFR Part 266, Subpart H) - February 2000.

Boilers are enclosed devices that use controlled flame combustion to recover and export
energy in the form of steam, heated fluids, or heated gases. Industrial furnaces are
enclosed units that are integral parts of a manufacturing process and use thermal
treatment to recover materials or energy from hazardous waste (e.g., cement kilns,
aggregate kilns).

Containers RCRA Training Module: Introduction to Containers (40 CFR Parts 264/265; Subpart I; Section 261.7) -
September 2005.

A hazardous waste container is any portable device in which a hazardous waste is
stored, transported, treated, disposed, or otherwise handled. The most common
hazardous waste container is the 55-gallon drum. Other examples of containers are
tanker trucks, railroad cars, buckets, bags, and even test tubes.

Containment Buildings (PDF 14 pp, 58K) - RCRA Training Module: Introduction to Containment Buildings (40
Subpart DD) - September 2005.

Containment buildings are completely enclosed, self-supporting structures (i.e., they have
four walls, a roof, and a floor) used to store or treat non-containerized hazardous waste.

Drip Pads (PDF 12 pp, 33K) - RCRA, Superfund & EPCRA Hotline Training Module: Introduction to Drip Pads (40
; 264/265, Subpart W) - October 2001.

A drip pad is a wood drying structure used by the pressure-treated wood industry to
collect excess wood preservative drippage. Drip pads are constructed of non-earthen
materials with a curbed, free-draining base that is designed to convey wood preservative
drippage to a collection system for proper management.

Incinerators RCRA, Superfund & EPCRA Hotline Training Module: Introduction to: Hazardous Waste Incinerators
(40 CFR Parts 264/265, Subpart O) - Published February 2000

Incinerators are enclosed devices that use controlled flame combustion for the thermal
treatment of hazardous waste. When performed properly, this process destroys toxic
organic constituents in hazardous waste and reduces the volume of waste that needs to
be disposed.

Land Disposal Units or Hazardous Waste Disposal Units (pdf 16 pp, 165K) - rcra Training

Module: Introduction to Land Disposal Units (40 CFR Parts 264/265; this module includes Subparts K - Surface
Impoundments, L - Waste Piles, M - Land Treatment Units, N - Landfills) - September 2005.

These disposal units are at hazardous waste facilities.

Surface Impoundments - A surface impoundment unit is a natural topographical
depression, man-made excavation, or diked area such as a holding pond,
storage pit, or settling lagoon. Surface impoundments are formed primarily of
earthen materials and are lined with synthetic plastic liners to prevent liquids from
escaping.

Waste Piles - Waste pile units are non-containerized piles of solid, non-liquid
hazardous waste that are used for temporary storage or treatment.

Landfills - A landfill is a disposal unit where hazardous waste is placed in or on
land and which is not a pile, a land treatment facility, a surface impoundment, an
underground injection well, a salt dome formation, a salt bed formation, an
underground mine, a cave, or a corrective action management unit.

Land Treatment Units - A land treatment unit has hazardous waste applied onto
or incorporated into the soil surface; they are disposal units if the waste will
remain after closure.

Tanks RCRA Training Module: Introduction to Tanks (40 CFR Parts 264/265; Subpart J) - September 2005.

Tanks are stationary devices constructed of non-earthen materials used to store or treat
hazardous waste. Tanks can be open-topped or completely enclosed and are
constructed of a wide variety of materials including steel, plastic, fiberglass, and concrete.

Miscellaneous and Other Units - RCRA, Superfund & EPCRA Hotline Training Module: Introduction to:
Miscellaneous and Other Units (40 CFR Part 264, Subpart X and 40 CFR Part 265, Subparts P, Q, and R - October
2001.

Miscellaneous units are defined as hazardous waste management units where
hazardous waste is managed in a unit other than a container, tank, surface
impoundment, pile, land treatment unit, landfill, incinerator, boiler, industrial furnace, UIC
well, containment building, or unit eligible for a research, development, and
demonstration (RD&D) permit. Since Subpart X is intended to serve as a "catch all"
category, the Agency did not develop an all-inclusive list of units designated as
miscellaneous units.
