FORMER ASARCO FACILITY SITE
PERTH AMBOY, NEW JERSEY

The U.S. Environmental Protection Agency (EPA) is
proposing to approve a polychlorinated biphenyl
(PCB) waste cleanup plan submitted by First
Environment, Inc. on behalf of Perth Amboy 1160,
LLC (Perth Amboy) for Block 430, Lot 1.03 (Site).
EPA's PCB Cleanup and Disposal Program, under
the Toxic Substances Control Act (TSCA), focuses
on the cleanup of PCB-contaminated sites so that
they can be returned to beneficial use.

The Proposed Plan

Under the proposed cleanup plan, Perth Amboy will
install a lot-wide cap over the PCB-contaminated
soils on the Site. The cap will consist of four feet of
approved fill with a minimum of six inches of asphalt
for parking lots and roadways, a minimum six inches
of concrete for building slabs or two feet of certified
clean fill for landscaped areas on top. Once capping
is completed, long-term maintenance and
monitoring of the cap will continue. In addition, the
owner will conduct quarterly sampling of
groundwater at two wells located at the Site for a
period of one year. The owner will also file a deed
restriction for the Site which will include the
requirement to maintain the lot-wide cap in
perpetuity and restrict the use of the Site to
commercial /industrial purposes. To prevent further
migration or unacceptable exposures of PCB
contamination at the Site, Perth Amboy 1160 will
also take other actions if needed.

What are Polychlorinated
biphenyls (PCBs)?

PCBs are organic chlorine
compounds used in various
commercial and industrial
products. They have a range of
toxicity and vary in consistency
from thin, light-colored liquids
to yeilow or black waxy solids.

Public Participation

The draft Approval for PCB cleanup is available for
public comment from January 27, 2023 through
February 27, 2023. This 30-day public comment
period allows the public to participate in and
contribute to site cleanup decisions by providing
EPA with comments. To provide comments to EPA:

EPA must receive your comments online or in an
envelope postmarked by February 27, 2023. EPA
will consider comments submitted during the
comment period before making a final decision. If
EPA issues an approval, the property owner must
accept the approval in writing. Site cleanup
activities will follow.

The ASARCO Site is located at 1160 State Street, in an industrial area of Perth Amboy, New Jersey. It is
bounded by State Street on the west, a petroleum bulk storage facility on the north, the Arthur Kill on the east,
and a former industrial site on the south. A portion of the southern property line is next to Cranes Creek. In
December 2020 the ASARCO site was divided into two lots: Block 430, Lot 1.02 and Block 430, Lot 1.03.

Past Activities

During a 2010 investigation, First Environment, Inc.
identified RGB contaminated material at the former
ASARCO Facility Site, Block 430 (ASARCO Site). Based
on the results, First Environment, Inc. submitted a Self-
Implementing Plan to cleanup PCB contamination to EPA
in November 2011, which EPA approved in April 2012.
First Environment, Inc. removed and disposed of PCB-
contaminated materials offsite in 2014; however,
additional investigations in 2017 and 2018 revealed
additional PCB contaminated material. In December
2020, the ASARCO Site was divided into 2 lots; Perth
Amboy 1160 retained the Site and Eport Phase II Urban
Renewal, LLC purchased Block 430, Lot 1.02 for which an
