UNITED STATES ENVIRONMENTAL PROTECTION AGENCY WASHINGTON, D.C. 20460 OFFICE OF WATER March 30, 2023 MEMORANDUM SUBJECT: FY 2023 Clean Water State Revolving Fund Base Allotment Availability FROM: RadhikaFox Assistant Administrator TO: Regional Water Division Directors, Regions I-X This memorandum provides FY 2023 Clean Water State Revolving Fund (CWSRF) allotments for states, tribes, and territories for funding provided through the Consolidated Appropriations Act, 2023 (PL. 117-328). Terms and conditions will be available to the EPA Regions on the EPA SRF SharePoint site. When combined with the funding provided by the Infrastructure Investment and Jobs Act (PL 117-58), also referred to as the Bipartisan Infrastructure Law (BIL), over $3.2 billion will be provided to the CWSRF in fiscal year 2023 to assist states, tribes, and territories with infrastructure projects that help provide clean water to communities across the United States. This sustained level of funding reflects the Administration's commitment to strengthen the nation's wastewater and stormwater systems, while also providing significant resources for mitigating nonpoint source pollution and improving energy and water efficiency through targeted investments. It also reinforces the ability of the CWSRF program to address the priorities established in the BIL Implementation Memorandum of March 8, 2022, including increasing investment in disadvantaged communities, building wastewater systems' resilience to all threats, and supporting American workers and domestic manufacturing. The base allotment amounts reflect the appropriation of $1,638,861,000 reduced by the funds directed by Congress towards Community Project Funding/Congressionally Directed Spending projects. Therefore, the amount of funds available to the base CWSRF program this year is $775,752,358. Attached are the allotments, along with the required additional subsidy and Green Project Reserve amounts. A consolidated chart showing final 2023 BIL and base 604(b)1 grant amounts is also included. Per the Clean Water Act (CWA), states must provide at least a 20 percent match to the capitalization grant amount. 1 Section 604(b) of the Clean Water Act provides approximately 1% of CWSRF allotments for water quality management planning grants. ------- 2023 Base Additional Subsidy Provisions Two distinct and additive subsidy authorities are included in the base 2023 capitalization grant. 1) Congressional Additional Subsidy Authority Under this authority, states may provide this subsidy to any CWSRF-eligible recipient. States must use 10 percent of the funds made available in the base 2023 CWSRF capitalization grant to provide additional subsidization to eligible recipients in the form of forgiveness of principal, negative interest loans, or grants (or any combination of these) to be used where such funds are provided as initial financing for an eligible recipient or to buy, refinance, or restructure the debt obligations of eligible recipients only where such debt was incurred after December 29, 2022. 2) Clean Water Act Additional Subsidy Authority As amended by BIL (PL. 117-58), the CWA mandates that states use at least 10 percent but no more than 30 percent of the capitalization grant amount to provide additional subsidy to the following: • any municipalities that meet the state's affordability criteria; • municipalities that do not meet the state's affordability criteria but seek additional subsidization to benefit individual ratepayers in the residential user rate class; or • entities that implement a process, material, technique, or technology that addresses water or energy efficiency goals; mitigates stormwater runoff; or encourages sustainable project planning, design, and construction. Additional subsidy provided from this authority may be in the form of forgiveness of principal, grants, negative interest loans, other loan forgiveness, and through buying, refinancing, or restructuring debt.
