1. Hazardous Waste Transport

Between Contiguous Properties

A company owns three contiguous
properties along a public right-of-way. The
company operates a large quantity generator
facility (LQG) on one of the properties, and a
permitted treatment, storage, and disposal
facility (TSDF) on another property (as shown
by Figure 1: Site Map). An industrial park,
ovmed by the same company, is situated
between the LQG and TSDF. Is a manifest
required if the LQG chooses to send
hazardous waste to the TSDF?

The LQG would not have to manifest the
shipment of hazardous waste destined for the
TSDF. The manifesting requirements in 40
CFR Pari 262, Subpart B and the pre-transport
marking requirements in §262.32(b) do not
apply to the transport of hazardous waste
along the border of contiguous property, under
the control of the same person, even if such
contiguous property is divided by a public or
private right-of-way (§262.20(f)). (The
requirements for hazardous waste discharges,
located in Part 263, Subpart C, continue to
apply to this situation.) In this scenario,
assuming that all three properties tire under the
control of the same person and arc contiguous,
a manifest need not accompany the waste
being shipped from the LQG to the TSDF.

2. Post-Deadline Use of the

Combination Release Detection
Method

An underground storage tank (UST) owner
and operator installed a new tank at their
facility one month after the December 22,
1998, deadline for upgrading, replacing, or
closing substandard USTs. The owner and
operator would like to employ the
combination leak detection method specified
in 40 CFR §280.4l(a)(l): inventory control
(or manual tank gauging) combined with tank
tightness testing. Can the owner and operator
use this method after December 22, 1998, or
is it limited to tanks upgraded or installed
before the deadline?

The alternative combination leak detection
method, monthly inventory control (or manual
tank gauging) combined with lank tightness
testing performed at least every five years, is
available lo owners and operators who install
their tank systems after December 22, 1998.

In developing the combination method,
EPA studied the likelihood of leaks from new
or newly upgraded tanks in relation to the
effectiveness of the prescribed release
detection methods. EPA determined that, few
new or upgraded tanks leak during the 10 years
after installation or upgrading (53 FR 37082,
37150; September 23, 1988). The Agency
further determined that inventory control can
provide "nearly continuous (daily) release
detection that can reliably detect larger
releases" (53 FR 37150), and that manual tank
gauging is as effective as inventory control for
tanks smaller than 2,000 gallons (53 FR
37158). EPA also determined that tank
tightness testing reliably detects smaller leaks
and, in combination with manual tank gauging
or inventory control, serves as an effective
release detection method for new or newly
upgraded tanks (53 FR 37150").

EPA allows owners and operators of new
or fully upgraded UST systems to use this
combination method until December 22, 1998,
or until 10 years after the tank is installed or
upgraded, whichever is later (§280.41(a)(1)).
Therefore, owners and operators who install
tanks after the deadline can use the method for
10 years from the date of installation.

Similarly, owners and operators of existing
tanks who temporarily closed on or before the
deadline can employ the combination method
when they reopen their compliant UST
systems. Owners and operators can not use
this combination method to satisfy the release
detection requirements for their UST piping.

3. Presumptive Response Strategy

The Superfund Accelerated Cleanup Model
(SACM) is a response approach aimed at
moving sites more quickly through the
Superfund cleanup process while still meeting
all CERCIA statutory and regulatory
requirements. One acceleration tool EPA
developed under the SACM is the presumptive
remedy concept. Presumptive remedies are
preferred technologies for common categories
of sites. They are based on historical patterns
of remedy selection and EPA's scientific and
engineering evaluation of performance data on
technology implementation. EPA has
developed presumptive remedies for several
types of sites such as former wood treatment
facilities, municipal landfills, and sites with
volatile organic compounds (VOCs) in soils.
In October 1996, EPA published "Presumptive
Response Strategy and Ex-Situ Treatment
Technologies for Contaminated Ground Water
at CERCIA Sites. " What is a presumptive
response strategy and how does it differ from a
presumptive remedy?

A presumptive response strategy (PRS)
expands upon presumptive remedies by
integrating site characterization, early actions,
remedy selection, performance monitoring,
remedial design, and remedy implementation
activities into a comprehensive, overall
response strategy for sites. Although the PRS
will not necessarily streamline the remedial
investigation/feasibility study (RI/FS) phase,
liPA expects that the use of the PRS will result
in significant time and cost savings for the
overall response to contaminated groundwater.
By providing a mechanism for selecting
achievable remediation objectives, tiic PRS
will minimize the need for changing these
objectives during remedy implementation. The
October 1996 guidance illustrates how to

employ the SACM at sites needing
groundwater remediation by using a phased
approach to site characterization and response
actions. In a phased approach, site response
activities occur in a sequence of steps that use
information gained from earlier phases to
refine subsequent investigations, objectives, or
actions.

EPA recognizes that phased
implementation of groundwater remedies may
not be appropriate for all sites, however, the
Agency expects that some elements of the PRS
will be appropriate for all sites with
contaminated groundwater and that all
elements will be appropriate for many of these
sites. EPA plans to publish additional
presumptive response strategies for other types
of sites in the future.

wastes, oil combustion wastes, and natural gas

costs and to develop a financial strategy to
close a landfill.

postconsumer wastepaper by 50 tons per day.

in Ohio by the Recycling Economic
Development Advocate, a position established
by a JTR grant. In fact, the REDA cultivated a
relationship between the Ohio Department of

Development. The REDA also directed over
60 recycling businesses to sources of financial,
technical, and business assistance, which in
turn, created close to 100 jobs.

TITLE: Disposal Tips for Home Health Care
(Professional Brochure)

and sites fitting within the categories of Part II
(B)(3) of this document. The guidance that is
provided in this document is not applicable to
other classes of parties or situations. EPA and

discretion to decline to enter into an
administrative cashout settlement
notwithstanding that a party or site meets the
criteria outlined in Part II (B)(3). The

Pipe Line Disposal Pit Site, located in South
Dakota, from the National Priorities List
(NPL). EPA published its intent to delete (he
site on November 25, 1998 (63 FR 65161).
EPA and the State of South Dakota have
determined that the site poses no significant
threat to human health and the environment,
and therefore, no further response actions are
necessary.

EPA announced the deletion of the operable
unit No. 1, or Parcel A, of Treasure Island
Naval Station-Hunters Point Annex Site, also
known as Hunters Point Naval Shipyard,
located in California, from the NPL. EPA
published its intent to delete Parcel A on
December 15, 1998 (63 FR 69032). After
performing a preliminary assessment, a site
inspection, and a remedial investigation, the
Navy issued a "No Action" Record of
Decision for Parcel A. The Navy has
implemented all appropriate response actions
required under CERCLA on Parcel A. All
other parcels of this site are undergoing
remedial actions and arc not being removed
from the NPL at this time.

EPA made available the Agency's Report to
Congress on Fossil Fuel Combustion that is
required by RCRA §8002(n). The Report to
Congress contains a detailed study of fossil
fuel combustion wastes not previously studied
("the remaining wastes"), including oil, natural
gas, and certain coal combustion wastes. The
purpose of the report is to determine whether
the remaining wastes should retain their
exemption from hazardous waste regulations
as codified in §261.4(b)(4).
